THE LAW
of 21 May 2003
amending Act No 359 / 1992 Coll., on Geographical and cadastral bodies, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Geographic and cadastral bodies Act
Act No. 359 / 1992 Coll., on Geographical and Catastral Bodies, as amended by Act No. 107 / 1994 Coll., Act No. 200 / 1994 Coll., Act No. 62 / 1997 Coll., Act No. 132 / 2000 Coll. and Act No. 186 / 2001 Coll., is amended as follows:
1. In Article 1 (1), the words "the administration of geodesy and cartography (hereinafter referred to as" the surveyor ") 'are replaced by the words" the administrative authority of the surveyor' and at the end of the paragraph the sentence "the accounting officer is unit 1) 'is added.
footnote 1 is replaced by the following:
"1) Paragraph 3 of Act No. 219 / 2000 Coll., on the assets of the Czech Republic and its presentation in legal relations, as amended by Act No. 492 / 2000 Coll., Act No. 229 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 501 / 2001 Coll., Act No. 202 / 2002 Coll., Act No. 280 / 2002 Coll. and Act No. 476 / 2002 Coll. '.
footnote (1) shall be renumbered footnote (1a), including the references to that footnote.
2. In Paragraph 2 (1), the words "government authority 'are replaced by the words" other administrative authority' and the sentence "The Geometry Authority is the accounting unit (1) 'is added at the end of the paragraph.
3. In Paragraph 2 (2), the words "administrative authorities of the State 'are replaced by the words" other administrative offices for'; the words "the register 'are replaced by the words" the register'; at the end of the paragraph, the sentence "Inspectorates and cadastral offices are account.1) ';
4. in Article 3 (a) (2), the word "detailed" shall be deleted;
5. in Paragraph 3 (e):
"(e) the management of the central database of the Czech Real Estate Register, which is managed in a national scale by computer means, contains real estate data and provides data of the Real Estate Register by remote access,"
footnote 3 is deleted;
6. in Article 3, the following point (m) is inserted after point (l):
"(m) issues basic state map works 5a) and thematic state map works 5b)
5a) § 2 (g) of Act No. 200 / 1994 Coll.
5b) § 2 (h) of Act No. 200 / 1994 Coll. '.
Point (m) shall be renumbered as point (n).
7. In Article 3, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The Ministry of Defence shall carry out similar tasks to those of the Office in carrying out surveying activities for the defence of the State."
8. in Paragraph 3a (b), including footnote 6a, the following shall be added:
"(b) decide on the location, transfer or removal of the measuring marks of the base point field, 6a, including the signalling and protection equipment of the point point field;
6a) § 2 (c) and (e) of Act No. 200 / 1994 Coll., as amended by Act No. 186 / 2001 Coll. '.
9. in Article 3a (c):
"(c) carry out the administration of basic national map sections (5a) and thematic state map sections (5b) established by the Office,"
10. in Article 3a, the following point (d) is inserted after point (c):
"(d) keeps database sets of point field points registered in technical units,"
Points (d) to (h) shall be renumbered as points (e) to (i).
11. in Article 3a (e), the words "manages the base base" shall be replaced by the words "manages the base base."
12. in Article 5, the following point (f) is inserted after point (e):
"(f) carry out the administration of the basic national map division (5a) established by the Office,"
Point (f) shall be renumbered as point (g).
13. in Article 5, the current text shall become paragraph 1 and the following paragraph 2 shall be added:
"(2) The list of cadastral centres which are the internal organizational units of the cadastral offices under the special legislation, 10a) their names, registered offices and territorial districts in which they exercise the competence of the relevant cadastral office, shall be published by the Office by a communication in the Collection of Laws. 10b)
10a) § 52 of Act No. 218 / 2000 Coll., on budgetary rules and amending certain laws (budgetary rules).
10b) § 2 (1) (e) of Act No. 309 / 1999 Coll., on the Collection of Laws and on the Collection of International Contracts. '
14. in Article 6, "§ 5 (a), (b) and (d)" is replaced by "§ 5 (1) (a), (c) and (e)";
15. In the first sentence of Annex No 1, the word "Brno 'is replaced by the word" South Moravian' and the word "South Moravian Region 'is replaced by the word" Highlands'.
16. In the second sentence of Annex 1, the word "Budejovice 'is replaced by the word" South Bohemia'.
17. In Annex 1, in the fourth sentence, the word "Ostrava 'is replaced by the word" Moravian-Silesian'.
18. Annex 2 shall read as follows:

1. The following cadastral offices shall be deleted from the date of application of this Act:

2. From the date of entry into force of this Act, the catastral authorities established by this Act shall exercise the jurisdiction of the existing cadastral offices.
3. The cadastral offices set up by this Act are transferred to the date of the entry into force of this Act the exercise of rights and obligations from the service, from the employment and other relationships of the existing cadastral offices, exercising their responsibilities in the counties of the respective county.
4. At the date of the entry into force of this Act, the Catastral Offices established by this Act are responsible for managing all the property of the Czech Republic with which the cadastral authorities were responsible at that date in the territorial districts of each region. At the same time, on that date, they will begin to carry out the responsibilities of the State in relation to this property.
PERFORMANCE TO DECLARATION OF THE COMPLETE VERSION OF THE LAW
The Prime Minister is hereby authorised to declare in the Collection of Laws the full text of Act No. 359 / 1992 Coll., on the Geographical and Catastral Authorities, as is apparent from the laws amending it.
EFFECTIVE
This Act shall take effect on 1 January 2004.
