DECLARATION
Ministry of Health
of 23 July 1999
on protection zones of the natural medical resources of the spa site Charles Studánka
The Ministry of Health provides pursuant to § 46 (1) of Act No. 20 / 1966 Coll., on the Care of People, as amended by Act No. 548 / 1991 Coll.:
Preliminary provisions
(1) In order to protect the natural medical resources of the spa site of Charles Studánka, protection zones are established at 1st and 2nd degrees (1)
(2) The first-degree protection zone consists of the territory in which the routes of exit of natural medical resources are located. The 2nd stage protection zone consists of the territory of the base mineral water structure with an infiltration area given by the White Opava basin and the Belan water disturbance in the Central Opava basin.
(3) The first-degree protection zone is graphically marked on the map in the scale 1: 10 000, annexed to No 1 of this Decree. The 2nd degree protection zone is graphically marked on the 1: 50 000 scale map, which is annexed to No 2 of this decree.
Level 1 protection zone
(1) Level 1 protection zone (2)
(a) to carry out drainage and treatment on water streams which could jeopardise the natural groundwater regime;
(b) to build or operate:
1. objects for agricultural production, industrial production and other objects in which it is a significant component of the technology of handling harmful water substances, 3)
2. landfills of hazardous waste and storage of hazardous waste, 4)
3. Parking not secured against oil losses into the field,
4. Objects which make it impossible to receive natural medical resources and apply the protection zone; 1)
(c) apply liquid ammonia fertilisers, cattle and pigs;
(d) to discharge, discharge or drip liquids into soil or surface water which could adversely affect the quality of natural medical resources; 3)
(e) to draw groundwater, with the exception of those authorised until the date of application of this decree;
(f) transport by vehicles substances which could adversely affect natural medical resources, (4) except for the removal of sludge from fat separators and oil separators;
(g) camp (in tents, trailers, etc.) outside the reserved places;
(h) use chemical sprinkler materials which could cause contamination of natural medical resources;
(i) park with motor vehicles outside the marked parking lot or closed garage;
(j) manage a special purpose forest (5) in such a way that the natural groundwater regime could be adversely affected.
(2) In the protection zone 1st stage (2), contrary to the binding opinion of the Czech Health and Safety Inspectorate (hereinafter referred to as "Inspectorate"), 6
(a) carry out:
1. ground work to a depth greater than 1 m;
2. drilling and shredding,
3. Mining and mining activities, 7) including the extraction of peat, which is not declared a natural source of medicine;
(b) apply industrial and livestock fertilisers and chemical plant protection products.
Level 2 protection zone
(1) Level 2 protection zone 8)
(a) to carry out drainage and treatment on water streams which could jeopardise the natural groundwater regime;
(b) to build or operate:
1. objects for agricultural production, industrial production and other objects in which it is a significant component of the technology of handling harmful water substances, 3)
2. landfills of hazardous waste and storage of hazardous waste, 4)
3. Parking not secured against oil losses into the field;
(c) discharge, discharge or drip liquids into soil or surface water which could adversely affect the quality of natural medical resources; 3)
(d) draw groundwater, except for withdrawals authorised until the date of application of this decree;
(e) transport by vehicles substances which could adversely affect natural medical resources, (4) except for the removal of sludge from fat separators and oil separators;
(f) manage a special purpose in the forests (5) such that the natural groundwater regime could be adversely affected.
(2) In the protection zone, step 2 (8), contrary to the binding opinion of the Inspection6), the
(a) carry out:
1. ground work to a depth greater than 6 m;
2. drilling and shredding,
3. mining and mining activities; 7)
(b) apply industrial and livestock fertilisers and chemical plant protection products.
(1) The maps of the scale 1: 50 000 and 1: 10 000 with marked protection band 1 and 2 are stored at the Municipal Office of the Charles Studánek, the district offices of Bruntal, Šumperk and Jeseník, the Czech Mining Office and the Ministry of Health.
(2) The roadmap for the border of the protection zones to the cadastral map (9) is kept at the Ministry of Health, the District Office of Bruntal and the municipal offices of the municipalities of Charles Studánka, Malá Morávka, Vrbno pod Pradida and the Svlá Hora.
Objects and activities still in operation on the territory which constitutes the protection zone 1 and the protection zone 2 must be brought into line with the provisions of Sections 2 (1) (b) (1) to (3) and 3 (1) (b) within two years of the entry into force of this Decree.
This Decree shall take effect three months from the date of its publication.
