THE LAW
of 20 December 1968
about Brno
In order to reconcile the position and competence of the National Committees of Brno with its social function and its importance as an important industrial and residential centre of the Czechoslovak Socialist Republic, the headquarters of international fairs and the traditional cultural and political centre of Moravia
The National Assembly of the Czechoslovak Socialist Republic decided on this law:
Basic provisions
§ 2
The National Committee of the City of Brno is the body of state power and administration in Brno.
§ 3
(1) The territory of the city of Brno consists of the following urban areas: the inner part of the city of Brno, Kohoutovice, New Liskovec, Jundrov, Komín, Žabovice, Husovice, Komáv, Krávo Pole, Medlánky, Wet Hora, Greek, Židenice, Černovice, Bohunice, Old Liskovec, Bystrc, Books, Lower Herspice, Upper Herspice, New Moravia, Přízenice, Líšt, Slatina, Brno Ivanovovice, Holovi, Tuřany.
(2) The territory of Brno is divided into urban districts. It is for the National Committee of the City of Brno to establish or abolish or alter the city district, which shall decide upon this after the observations of the national district committees discussed with the citizens.
§ 4
The authorities of state power and administration in the city districts of Brno are the district national committees.
§ 6
The National Committee of the City of Brno and the District National Committees in the security of the development and construction of the city are governed by the principle that the development of the city of Brno as an important industrial and residential centre of the Czechoslovak Socialist Republic, the headquarters of international trade fairs and the cultural and political centre of Moravia is an important interest of society, applied in accordance with the interests of the citizens of the city. This principle is also governed by the government and other bodies of the Czech Socialist Republic in the performance of their tasks.
Management of Brno City Development
§ 7
The main task of the National Committee of the City of Brno and the District National Committees is to take care of the versatile development of the city of Brno, in particular its planned construction, the creation and protection of a healthy environment, the development of services, the protection of cultural monuments and the safeguarding of public order.
The leading tasks of the National Committee of the City of Brno and the District National Committees include also the care of creating favourable conditions for the activities of institutions and bodies of social or national importance, which have their seat in Brno.
§ 8
The Government of the Czech Socialist Republic creates the preconditions for the participation and assistance of its institutions and organisations in dealing with the development and construction of Brno.
§ 10
The authorities and organisations may establish their headquarters in the City of Brno after prior consultation with the National Committee of the City of Brno.
Scope of the National Committee of the City of Brno and the District National Committees
§ 12
(1) The National Committee of the City of Brno, in close cooperation with the Circular National Committees, plans, manages and ensures the construction of the city and organises the planned development of economic, cultural, health and social construction within its territory. It approves the Brno City Development Plan and directs the correct proportions in the city's development.
(2) The National Committee of the City of Brno manages and directs the activities of the District National Committees, controls them, in particular oversees the implementation of laws and the maintenance of state discipline, and reviews their management. It provides comprehensive assistance to the national committees in their work and in addressing urban challenges, advising them on the performance of their tasks, building on their knowledge and discussing their initiatives and comments. Proposals for serious measures shall be prepared and discussed with the national committees.
(3) The National Committee of the City of Brno establishes and manages and, where appropriate, manages organisations and facilities which serve to meet needs beyond the perimeter and whose management (administration) is more efficient and economical to organise for the whole city.
§ 13
The District National Committees, in line with the planned development of the city, ensure the development of their districts with the widest participation of citizens. They take care of the enhancement and appearance of the circuits. They work closely with the National Committee of the City of Brno to address the city-wide issues and to make initiatives in this respect. They participate in the drawing up of long-term concepts and plans for the development of the city of Brno and draw up and approve plans for the development of their own economy and their budgets.
§ 15
The District National Committees manage the enterprises of the residential district economy, manage the district libraries and other cultural facilities; may also establish and manage other organisations and facilities which satisfy predominantly local needs or which are more efficient to organise by circuit.
§ 16
(1) The National Committee of the City of Brno and the District National Committees, their bodies and Members are developing a wide range of organisational and cultural educational activities, thereby creating the preconditions for active participation of citizens in the administration of the city.
(2) The District National Committees establish civil committees and other their assets, familiarise them with the work of the National Committees, use their initiatives in the performance of their tasks and focus their activities on active cooperation between citizens and national committees.
Organizational construction of the National Committee of the City of Brno and the District National Committees
§ 17
(1) At least 100 Members are elected to the National Committee of the City of Brno.
(2) The Circular National Committees shall determine the number of their Members, taking into account the size of their constituency, the scope of their responsibilities and the establishment of a competent working group. In so doing, the number of Members shall be such that the District National Committee shall have at least:
30 Members in districts up to 5 000 inhabitants,
40 Members in districts up to 10 000 inhabitants,
60 Members in districts up to 20 000 inhabitants,
80 Members in districts over 20,000 inhabitants.
§ 18
(1) The National Committee of the City of Brno and the District National Committees establish executive and control bodies: the Council, the Commission, the Commission of People's Control, the Administrative Commission, trade unions and other departments. The establishment of its trade unions and other departments is decided by the National Committee of the City of Brno in accordance with the principles laid down by the Government of the Czech Socialist Republic; After consultation with the National Circular Committees, they shall also decide on the establishment of trade unions and other departments of the National Circular Committees.
(2) The Council of the National Committee of the City of Brno is composed of the Mayor of Brno, its Deputy, Secretary of the National Committee of the City of Brno and other members elected by the National Committee of the City of Brno from Members. The Council of the National Committee of the City of Brno has 15 to 20 members.
(3) The primary shall perform the functions which, under the Law on National Committees, are responsible for the chairman of the National Committee. As a representative of Brno, he has the right to use historical primary insignia.
(4) The Council of the Circular National Committee shall be composed of the President, Vice-President (Vice-Presidents), Secretary and other members elected by the Circular National Committee of Members. The Council of the District National Committee shall have between 8 and 15 members.
Character and colors of the city of Brno, honorary citizenship and other honours
§ 19
(1) If the use of the State emblem is not prescribed, the National Committee of the City of Brno and the District National Committees, as well as their managed and managed organisations, may use the emblem of the City of Brno.
(2) Other organizations can only use the city emblem with the permission of the Brno National Committee.
(3) The emblem and colours of the city of Brno and the manner in which they are used will be adapted by the Statute of the National Committee of the City of Brno.
§ 20
(1) The National Committee of the City of Brno may grant the honorary citizenship of the City of Brno to persons who have in a particularly significant way deserved the city of Brno and its population or the social progress, peace and friendship between nations.
(2) The National Committee of the City of Brno can appreciate the important activities of persons who have been responsible for the construction of the city of Brno by granting public recognition for merit.
(3) Excellent creative performance, which enriches human knowledge, has contributed significantly to solving the tasks of socialist construction or further development of the culture of the city, can reward the National Committee of the City of Brno by awarding the Prize for the Liberation of the City of Brno.
(4) Details of the conditions and arrangements for granting honorary citizenship, public recognition for merit and the City of Brno Liberation Awards will be laid down in the Statute of the Brno National Committee.
Final provisions
§ 21
(1) The Statute of the National Committee of the City of Brno is approved by the National Committee of the City of Brno at its plenary session.
(2) The status of the National Committee of the City of Brno shall specify the urban districts, the arrangements of its bodies, their responsibilities and the division of work between them, which departments and other departments shall be established by the local national committees, the organisations and facilities managed or managed by the National Committee of the City of Brno and the main principles and forms of participation of citizens in the administration of the city. To the extent defined by this law, the Statute of the National Committee of the City of Brno shall also provide for the division of tasks between the National Committee of the City of Brno and the National Circuit Committees.
§ 22
Unless otherwise provided for in this law, the provisions of the Law on National Committees shall apply to the National Committee of the City of Brno and to the District National Committees.
§ 23
(3) Act No. 36 / 1964 Coll., on the organisation of courts and elections of judges, as amended by Act No. 29 / 1968 Coll., is added as follows:
1. Paragraph 1 is added to paragraph 4 of the following text:
"(4) In the territory of Brno, the jurisdiction of the District Court shall be exercised by the Municipal Court. '
2. The following sentence is added to Paragraph 33 (1):
"The Regional Court based in Brno shall also exercise jurisdiction in the territory of Brno. '
3. Paragraph 45 is added to paragraph 3 of the following text:
"(3) The judges of the Regional Court in Brno shall be elected by the South Moravian National Committee of Brno, at the request of the competent authorities of the National Front; of the elected judges of the profession, at a joint meeting of the South Moravian National Committee and the National Committee of the City of Brno, the President of the Regional Court and his Deputy (Deputy) on a proposal from the Minister of Justice of the Czech Socialist Republic. '
(4) Act No. 60 / 1965 Coll., on the Prosecutor, as amended by Act No. 29 / 1968 Coll., is amended as follows:
1. Paragraph 30 (1) reads as follows:
"(1) The Prosecutor's Office is divided into the General Prosecutor's Office, which includes the Main Military Prosecutor's Office, the Regional Prosecutor's Office and the City Prosecutor's Office in Prague, the Senior Military Prosecutor's Office, the District Prosecutor's Office in Brno, the District Prosecutor's Office in the City of Prague and the Military District Prosecutor's Office."
2. The following sentences are added to Paragraph 30 (2):
"The seat and district of the City Prosecutor's Office in Brno coincides with the seat and district of the National Committee of Brno. The Regional Prosecutor's Office in Brno shall also exercise jurisdiction in the territory of Brno. '
(5) Act No. 121 / 1962 Coll., on Economic Arbitration, as amended by Act No. 29 / 1968 Coll., is added as follows:
The following sentence is added to Paragraph 6 (1) (b):
"The Regional State Arbitration in Brno also exercises jurisdiction over the territory of Brno. '
(6) Act No. 70 / 1965 Coll., on the National Security Corps, as amended by Act No. 29 / 1968 Coll., is added as follows:
In Article 6, the following sentence is inserted after the provisions on the National Security Corps bodies in the territory of the capital of Slovakia Bratislava:
"The Municipal Public Security Administration in Brno exercises the competence of the District Department of Public Security; the Regional Administration of the National Security Corps in Brno shall also exercise jurisdiction in the territory of Brno. '
§ 24
This Act shall take effect on 1 January 1969.
