DECLARATION
of 27 June 2019
amending Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended
The Ministry of Agriculture shall determine, pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll., Act No. 130 / 2006 Coll., Act No. 60 / 2017 Coll. and Act No. 3 / 2019 Coll., ("the Act ') for the implementation of Sections 23 (5), 23a (4), § 23b (8) and Article 23c (4) of the Act:
Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll., Decree No. 213 / 2009 Coll., Decree No. 202 / 2010 Coll., Decree No. 64 / 2013 Coll., Decree No. 5 / 2016 Coll. and Decree No. 449 / 2017 Coll., is amended as follows:
1. in Article 1 (1) (b), the words "non-breeding fish listed in the Annex to the Act (" non-breeding fish ")" shall be replaced by "aquaculture animals."
2. In Article 2 (g), the words "moved ovine or caprine animals for domestic slaughter and slaughtered within 7 days' are replaced by the words" moved ovine, caprine or porcine animals for domestic slaughter and slaughtered within 7 days'.
3. In Article 2 (m), the words "susceptible to diseases' are deleted.
4. At the end of § 2, the dot is replaced by a comma and the following point (n) is added:
"(n) the colony of bees, capable of overwintering, fully occupying at least seven tyres of the frame measure 39 x 24 cm; the different frame measure shall be recalculated."
5. In Part 2, the text under the heading "§ 22 (13) 'is replaced by" § 22 (12)'.
6. In Article 28, the words "and Article 53 'shall be added at the end of paragraph 3.
7. Paragraph 29 (3), including footnote 13, is deleted.
Paragraphs 4 to 11 shall be renumbered paragraphs 3 to 10.
8. In Paragraph 29, the following sentence is added at the end of paragraph 9: "The breeder does not have this obligation if there are changes to the reference data recorded in the population base register, in the population register agenda information system or in the alien agenda information system. Upon notification of the change by the breeder or on the basis of information provided from the population base register, the agent information system of the population or the agency information system of the aliens concerning the data entered in the central register information system, the authorised person shall enter the farm register. The breeder may also update the contact details directly in the central registration information system. ';
9. In Article 29, the following paragraph 11 is added:
"(11) In the case of domestic pig rearing of breeders not intended for human consumption, the simplified registration note set out in Annex 6a shall be used. In the case of sows, the registration form in Annex 6 shall be used. ';
10.Paragraph 30 (3) reads as follows:
"(3) An operator, with the exception of the hatchery operator, shall submit a copy of the approval and registration in accordance with other legislation14. The hatchery operator shall submit only the registration note. ';
11. In Article 30 (5), the words "in the case of a legal person who is an entrepreneur, on the basis of the verification of the information contained therein, in accordance with a copy of the document confirming that he is an entrepreneur under a special law, 13) 'are deleted.
12. In Paragraph 32 (1), the words "in the form of a data file approved by the authorised person. The authorising officer shall approve only such a computer programme 'shall be replaced by' by a computer programme 'and the last sentence shall be deleted.
13. In Paragraph 35, the dot is replaced by a comma at the end of paragraph 1 and the following point (g) is added:
"(g) if there is a change in the shape, difficulty in giving birth and birth weight, if this is known."
14. in Paragraph 38 (1) (e), the following point 8 is added:
"8th Difficulty of childbirth and birth weight,"
15. in Article 52 (1), the words "and for temporary holdings" shall be inserted after the words "animal segregation."
16. In Paragraph 52, paragraph 6 is added:
"(6) In the case referred to in Article 29 (11), the pig register on the holding shall fulfil any record showing changes in the number of pigs kept, the identification of the pigs and the date of that change, specifying the origin or destination of the animals. ';
17. in Article 53 (1), the words "with the exception of pig breeders on a temporary holding and pig breeders referred to in Article 29 (11)" shall be inserted after the words "Each breeder," and, in the case of transfer to a temporary holding, the Annex to the notification of the birth of pigs, their mortality, loss and transfer - temporary holdings ";
18. In Article 53 (5), the words "including the Annex thereto 'shall be inserted after the words" and the transfer'.
19. In the introductory part of Section 55 of the provision, the words "except for Section 29 (11)" shall be inserted after the words "pig holdings."
20. In Paragraph 55, at the end of point (b), the dot is replaced by a comma and the following point 4 is added:
'4. in the case of movement to a temporary holding, the date of transfer, the number of pigs concerned, the address of the transfer, including the identification details of the new breeder. ';
21. In Articles 73 (1) and 77 (1), the words "pursuant to Article 23 (2) (c) of the Act" shall be inserted after the words "transmit."
22. Paragraph 80 (1) reads as follows:
"(1) Each bee farmer shall transmit to the authorised person (4), on 1 September of the calendar year, the number of hives and the location of habitats,
(a) the name and, where appropriate, the names and surname or business name of the breeder;
(b) the birth number or date of birth, if the natural person does not have a birth number; in the case of a legal person, an identification number if assigned;
(c) the address of the breeder's place of residence or residence;
(d) the name and, where appropriate, the names and surnames of the contact person, the contact address and, where appropriate, the telephone number;
(e) e-mail;
(f) the location of each hives site, the code number of the cadastral territory, the partition number, the type of parcel and, where appropriate, the name of the habitat;
(g) the number of hives on 1 September of the calendar year at each site;
(h) if the alien, in addition to the particulars referred to in (a) to (g), is involved, the identity document number and the State which issued the document;
(i) if the legal person or business alien is involved, except for the information referred to in points (a) to (g), the identification number and the State which issued the identification number. ';
23. in Paragraph 82 (e), the words "address, if known" shall be replaced by "name of the habitat."
24. in Paragraph 82 (g), the words "natural person" shall be deleted;
25. in Paragraph 82 (h):
"(h) if the legal person or business alien is involved, except for the information referred to in points (a) to (g), the identification number and the State which issued the identification number.";
26. in Paragraph 87 (4), the words "authorised person (4)" shall be replaced by the words "Ministry of Agriculture."
27. In Section 88, the words "computer database with all data and 'are deleted.
28. In section 4, the text under the heading "§ 24 (11) 'is replaced by" § 24 (12)'.
