on the performance of proficiency tests on applicants for driving licences
The Federal Ministry of the Interior shall, in agreement with the participating central authorities in accordance with Article 16 (1) (a) of Decree No. 54 / 1953 Coll., on road traffic, as amended by the legal measure of the Bureau of the National Assembly No 13 / 1956 Coll.:
BODIES CONDUCTING EXAMINATION TESTS
(1) Tests from professional competence (1) for the management of motor vehicles are normally carried out by testing Commissioners of the Transport Inspectors of the District (Urban) Administration of the National Security Corps (hereinafter referred to as "VB Transport Inspectorate").
(2) In justified cases, higher level transport inspectors may reserve the carrying out of tests. (2)
(1) Workers of the Association for Cooperation with the Army (hereinafter referred to as the "Swaziland Driving Schools") may be entrusted by the Regional Administration of the National Security Corps to carry out tests
(a) teaching on motor vehicles and their maintenance and driving of motorcycles for category A drivers;
(b) teaching on motor vehicles and their maintenance of category B drivers;
(c) small motorcycle driving for applicants for category M driving licences.
(2) Workers of regional and district agricultural administrations, corporate directorates of state forests, secondary professional forestry and agricultural schools may be entrusted with the Regional Administration of the National Security Corps to carry out tractor driving tests with applicants for a T-category driving licence.
(3) The testing officer of the VB Transport Inspectorate may oversee and, where appropriate, test those applicants for a driving licence.
In training establishments in which the competent staff do not carry out proficiency tests (§ 2 (1) and (2)), applicants for driving authorisation shall be tested by the pilot-in-command of VB transport inspectors, except where, by agreement, the training of applicants has been carried out by the Svazarm driving school.
TESTS FROM COMPETITION
Basic provisions
(1) If the applicant for a driving licence has obtained the required knowledge and skills, 3) he shall apply it to the proficiency tests of the training establishment in which he has undergone the prescribed teaching and training, in the case of a VB transport inspector responsible for the location of the training establishment.
(2) If the applicant for a driving licence has undergone individual training, he shall be registered for proficiency tests by the trainer at the VB Transport Inspectorate which authorised the training.
(3) The term of the proficiency tests shall be determined by the VB Transport Inspectorate in agreement with the relevant training facility and, where appropriate, the driver of the trainer, if the applicant has undergone individual training. The scope of the proficiency tests is set out in Section 12 for each category of driving licences.
(4) The proficiency tests (road traffic rules test, test on motor vehicle teaching and maintenance and test on motor vehicle control) may be carried out in any order and the applicant must submit to all tests.
(5) The result of each test shall be assessed by the degree "benefit 'or" benefit'. A record shall be made of the outcome of all proficiency tests, which shall be confirmed by the signature of the examiner and by the stamp of the VB Transport Inspectorate or, where applicable, of the training facility, if any of the tests were carried out by an authorised official (§ 2 (1) and (2)).
(1) If the applicant for a driving licence has failed a proficiency test, the test may be repeated no more than twice.
(2) Each repeat test may be carried out no later than 7 days after the date of the failed test.
(3) If the applicant fails even in the second recurrent test, he shall undergo new teaching or training in those articles from which he has not benefited.
The required tests, including recurrent tests (Section 5), shall be subject to the applicant for a driving licence no later than one year after completion of the training; otherwise they must undergo new training in full. The period shall begin on the day following the end of the training.
Road traffic rules test
(1) The road traffic rules test shall be carried out by testing (hereinafter referred to as "tests").
(2) If the applicant for a driving licence does not control the language in which the tests are issued sufficiently or at all, an oral examination may be carried out in the presence of an interpreter, (4) to be provided by the applicant.
(1) A period of 20 minutes shall be set for the completion of the test.
(2) To pass the test, the applicant must obtain a driving licence
- groups And at least 50 points,
- Group B at least 50 points,
- group C at least 52 points,
- groups D at least 53 points,
- a minimum of 50 points in M groups,
- at least 50 points in the T group,
- to drive trams and trolleybuses at least 53 points.
Test of teaching on motor vehicles and their maintenance
(1) The test shall be carried out orally from teaching on motor vehicles and their maintenance. In the case where the examination is carried out by the drivers of the Svanzarmu school (§ 2 (1)), the oral examination may be replaced by the final procedure test laid down for the relevant category of driving licence.
(2) In the test, the applicant for a driving licence shall:
(a) Group A and B demonstrate the basic knowledge of the main groups and devices of the motor vehicle which affect the safety of its operation, their normal maintenance and the removal of normal defects and defects;
(b) Group C, D and T demonstrate the basic knowledge of the design of motor vehicles and their main groups and equipment, their maintenance and treatment, as well as the detection and disposal of emerging failures, taking into account the safety and efficiency requirements of the operation of motor vehicles.
(3) An applicant for a driving licence who does not demonstrate basic knowledge for each question referred or for the final procedure test does not reach a specified number of points is assessed by the "failed" level.
Test of motor vehicles
(1) The driving test is divided into two parts:
(a) in the first part of the test, the knowledge of basic operations, in particular the adjustment of rear-view mirrors, seat-belt fastening, starting up, climb-starting with parking brake, braking and stopping, reversing and turning when reversing, turning into a limited space on longitudinal, oblique and perpendicular standing, standing in the climb, for applicants for category A and M driving licences, also driving motor vehicles at low speed;
(b) in the second part of the test, the applicant for a driving licence shall check the driving conditions of the motor vehicle, in particular the maintenance of the correct driving direction, the correct driving direction, the correct turning to the right and left, the maintenance of the corresponding distance between the vehicles in each lane, compliance with the rule of priority in driving, the correct overtaking, the use of rear-view mirrors, the timely giving of signs of changing direction, the correct response to the signs (for example, changing direction) given by other road users, the maintenance of due care against pedestrians and other road users, the correct use of lights and other devices in the motor vehicle.
(2) The test must take at least 20 minutes.
(3) Driving a motor vehicle shall be controlled by the applicant for a driving licence in such a way as to be able to monitor the situation in road traffic, in particular the instructions of the National Safety Corps and other persons authorised to drive the road, light signals, signs and devices, and to be able to respond to and deal reliably with traffic situations in a timely, correct and without the intervention of the teacher.
(4) In order to drive motor vehicles, an eligible applicant for a driving licence who, in particular, is not able to control the motor vehicle reliably during the test while respecting the road traffic rules, responding correctly and dealing with traffic situations, or making gross errors in the operations (paragraph 1) examined. If, during the test, there is a breach of road traffic rules that has threatened or may seriously threaten road safety or a situation where a teacher had to intervene in the driving vehicle, the test shall be immediately terminated and the applicant assessed as "not '.
(1) The examination carried out by the test commissioner of the VB Transport Inspectorate shall be attended by the training equipment teacher or, where appropriate, by the trainer who sits in the training vehicle in the teacher's seat (except for category M motor vehicles). If the training vehicle is fitted with safety belts, the candidate for the driving licence shall also be restrained when driving in the municipality.
(2) The test is carried out by the applicant for a driving licence
(a) group A on a motorcycle with a lifting capacity of 250 cm3 or more;
(b) group B in a passenger or delivery car, as a general rule, of the type on which the training was carried out;
(c) category C in a vehicle with a useful mass of not less than 4500 kg;
(d) groups D on a bus having at least 28 seating positions and a length of at least 7 m,
(e) group T in a wheeled tractor with a trailer which shall have at least 2 axes with a gauge of at least 1 m;
(f) group M on a small motorcycle with a lifting capacity of up to 50 cm3.
Range of proficiency tests for motor vehicles
The scope of the proficiency tests for driving motor vehicles shall be determined as follows:
(a) category A driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 1 question,
- test from the steering of the motor vehicle;
(b) category B driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- driving a motor vehicle;
(c) category C driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 3 questions,
- performance of maintenance of the designated group or train of the motor vehicle in practice or on the model - 2 questions,
- driving a motor vehicle;
(d) category D driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 3 questions,
- performance of maintenance of the designated group or train of the motor vehicle in practice or on the model - 2 questions,
- driving a motor vehicle;
(e) category M driving licence:
- road traffic regulations - 1 test,
- driving a small motorcycle;
(f) category T driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- performance of maintenance of a specified vehicle group or system in practice or on a model - 1 question,
- driving a motor vehicle;
(g) category A + B driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- driving of category A and B motor vehicles;
(h) category A + C driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 3 questions,
- performance of maintenance of the designated group or train of the motor vehicle in practice or on the model - 2 questions,
- driving of category A and C motor vehicles;
(ch) category A + T driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- performance of maintenance of a specified vehicle group or system in practice or on a model - 1 question,
- driving of category A and T motor vehicles;
(i) category B + T driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- performance of maintenance of a specified vehicle group or system in practice or on a model - 1 question,
- driving category B and T motor vehicles;
(j) category A + B + T driving licence:
- road traffic regulations - 1 test,
- teaching on motor vehicles and their maintenance - 2 questions,
- performance of maintenance of a specified vehicle group or system in practice or on a model - 1 question,
- driving of category A, B and T motor vehicles.
REVIEW OF THE COMPETENT ELIGIBILITY FOR THE MANAGEMENT OF MOTOR VEHICLES
(1) If the VB Transport Inspectorate decides to check the professional competence of a driver to drive motor vehicles, the examination shall be carried out in accordance with this Ordinance, to the extent specified for obtaining the driving licence of the group concerned.
(2) If the VB transport inspector's decision has provided that the driver must have completed a training course at the Svazarm driving school before the examination, the driver shall demonstrate compliance with this condition by confirming the Svazarm driving school; the driving school also subscribes to the proficiency check.
(3) If the driver has not benefited from the proficiency check in a particular test, he may only repeat the test once. The repeat test may be carried out in at least 7 days. If the driver fails the repeat test, he shall undergo new training from the subject in which he did not.
(4) The driver is required to complete both the recurrent test and the examinations after completion of new teaching or training from an item within 6 months of the date of the first proficiency check; otherwise they must undergo new training in full.
TRANSITIONAL AND FINAL PROVISIONS
The mandates for carrying out proficiency tests issued before the date of application of this decree shall remain valid until the end of 1981.
This decree shall not apply to the conduct of tests on the professional competence of goaltenders in the framework of their preparation (5) in the driving schools of Swaziland and the applicants for driving licences for the management of motor service vehicles of the armed forces and the National Security Corps, as well as to the examination of the competence of drivers of the armed forces and the National Security Corps.
Paragraphs 8 (4) and 9 (2) and 9 (3) of Decree No 87 / 1964 Coll., on driving licences are hereby repealed.
This Decree shall take effect on 1 March 1981.
