amending Act No. 438 / 2020 Coll., on adjustments to the provision of medical care in connection with exceptional measures in the event of an epidemic and amending Act No. 187 / 2006 Coll., on sickness insurance, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 438 / 2020 Coll., on the arrangements for the provision of medical care in connection with emergency measures for the epidemic and amending Act No. 187 / 2006 Coll., on sickness insurance, as amended, is amended as follows:
1. In Article 2 (3), "point 1 'is replaced by" points 1 and 2';
2. In Article 3 (1), at the end of point (b), the semicolon is replaced by a comma and the following point (c) is inserted, including footnotes 4 and 5:
"(c) an unprovided child with special educational needs under the Education Act, if there is a child with serious developmental behavioural disorders, multiple defects or autisme4), who has been issued a recommendation from a school counselling institution for the purpose of establishing supportive measures for his or her education (5) (hereinafter referred to as" a child with special educational needs "), if he / she cannot attend school due to an exceptional epidemic measure;
4) Paragraph 16 (9) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act).
5) Article 15 (2) and (5) of Decree No. 27 / 2016 Coll., on the education of pupils with special educational needs and of pupils gifted, as amended. '
3. In Paragraph 3 (1) of the final part of the provision, "and (b) 'is replaced by" to (c)'.
4. In Paragraph 4 (4), "70 'is replaced by" 80'.
5. In Article 5 (2), the sentence "Entitlement to the payment of medical fees in the case referred to in Article 3 (1) (c) shall be further certified by the confirmation of the school, stating that it is a child with special educational needs as referred to in Article 3 (1) (c)."
6. In the last sentence of Article 5 (2), the words "if the certificate of closure referred to in the first sentence" shall be inserted after the word "insurance,"
7. In Article 5, the following paragraph 4 is added:
"(4) At the request of the staff member, the school is required to certify, for the purposes of nursing care, that the child is a child with special educational needs in accordance with § 3 (1) (c). A breach of obligations under the first sentence and under the first sentence of Paragraph 6 shall be considered an infringement under Section 106 of the sickness insurance law. '
Transitional provisions
1. The medical fees shall be payable for calendar days from 1 March 2021 until the date of entry into force of this Act, in accordance with Article 4 (4) of Act No. 438 / 2020 Coll., as effective from the date of entry into force of this Act.
2. The medical fees paid for calendar days between 1 March 2021 and the date of entry into force of this Act shall be paid without application at the latest by the end of the second calendar month following the calendar month for which the medical fees are due.
3. Entitlement to medical fees for childcare purposes pursuant to § 3 (1) (c) of Act No. 438 / 2020 Coll., as effective from the date of entry into force of this Act, shall take effect from 1 March 2021.
Efficacy
This Act shall take effect on the day of its publication.
