Government regulation on the setting of mandatory procurement conditions for road vehicle procurement contracts

of 11 May 2016
laying down binding procurement conditions for contracts for the acquisition of road vehicles
The Government orders pursuant to § 37 (7) (a) and § 118 (3) of Act No. 134 / 2016 Coll., on Public Procurement:
§ 1
Preliminary provisions
(1) This Regulation implements the relevant provisions of the European Union1) and provides for the establishment of mandatory procurement conditions for the award of public supply contracts for the acquisition of road vehicles of category N1, N2, N3, M1, M2 or M3 under the law governing the conditions of use of vehicles on the road (2).
(2) The contracting authority shall take into account, under the conditions laid down in this Regulation, the energy and environmental impacts of the operation of vehicles during their lifetime, the procurement conditions for the procurement of road vehicles of category N1, N2, N3, M1, M2 or M3. These impacts shall, for the purposes of this Regulation, mean energy consumption, carbon dioxide (CO2) emissions produced, nitrogen oxides (NOx), non-methane hydrocarbons (NMHC) and particulate matter.
§ 2
Taking into account energy and environmental impacts
(1) In the case of the award of public supply contracts for vehicles of categories N2, N3, M2 and M3 in the procurement documents, the contracting authority shall provide a reference to the EURO emission limits referred to in Annex 1 to this Regulation, unless it provides for a requirement to comply with a higher EURO emission limit standard.
(2) In the case of the award of public supply contracts for vehicles of categories N1 and M1, the contracting authority shall specify in the contract documents:
(a) a reference to the EURO emission limits referred to in Annex 1 to this Regulation, unless it provides for a requirement to meet a higher EURO emission limit standard and maximum fuel consumption for combined operations (3), which may not exceed the values set out in Annex 2 to this Regulation; or
(b) for the assessment of life-cycle costs, a common method for determining life-cycle costs in accordance with Section 4.
§ 3
Special purpose vehicles or vehicles with alternative propulsion
The contracting authority shall not be obliged to determine the maximum fuel consumption referred to in Article 2 (2) (a) in the case of public supply contracts for vehicles of categories N1 and M1 where they are the subject of:
(a) vehicles of special purpose vehicles as defined in the Ordinance on the approval of technical competence and on technical conditions for the operation of vehicles on the road (4); or
(b) alternative-propulsion vehicles with at least one alternative fuel or energy source of which are liquefied petroleum gases (LPG), compressed natural gas (CNG), liquefied natural gas (LNG), mixed motor fuel containing at least 50% biofuel, pure biofuels, hydrogen or electricity.
§ 4
Common method for determining life-cycle costs for N1 and M1 vehicles
The life cycle costs for M1 or N1 vehicles shall be determined by the contracting authority during their lifetime by the sum of:
(a) the bidding price and, where appropriate, the other acquisition costs determined by the contracting authority;
(b) the monetary value of the operating costs of energy consumption pursuant to Article 5; and
(c) the cash value of the operating costs of CO2, NOx, NMHC and particulate matter emissions referred to in Section 6.
§ 5
Determination of monetary value of operating costs for energy consumption
(1) The operating costs of energy consumption shall be determined by the contracting authority by multiplying the energy costs per kilometre and the number of kilometres over the lifetime referred to in Annex 3 to this Regulation.
(2) Where the quantity of energy per kilometre is not indicated directly, it shall be calculated on the basis of the energy content data referred to in Annex 4 to this Regulation.
(3) For the calculation of energy costs per kilometre, the lower of the cost values per unit of petrol or diesel fuel energy before tax shall be used in accordance with the value added tax or excise duty law when used as fuel for transport purposes.
§ 6
Determination of the monetary value of the operating costs of CO2, NOx, NMHC and particulate matter emissions
(1) The operating costs of CO2, NOx, NMHC and particulate matter emissions over the lifetime of the vehicle shall be determined by the contracting authority by multiplying:
(a) the number of kilometres over the lifetime referred to in Annex 3 to this Regulation;
(b) CO2, NOx, NMHC and particulate matter emissions data per kilometre identified for vehicle type-approval purposes (2); and
(c) the value of the cost of emissions from road transport as set out in Annex 5 to this Regulation.
(2) The contracting authority may determine the value of the cost of emissions from road transport higher than that referred to in paragraph 1 (c), provided that it does not exceed twice the relevant value set out in Annex 5 to this Regulation.
§ 7
Efficacy
This Regulation shall take effect on 1 October 2016.
