DECLARATION
Ministry of Finance
of 15 June 2000
amending Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (Law on the valuation of assets), as amended by Decree No. 127 / 1999 Coll.
According to § 33 (1) of Act No. 151 / 1997 Coll., on the valuation of assets and on the amendment of certain laws (the law on the valuation of assets), the Ministry of Finance provides:
Čl. I
Decree No. 279 / 1997 Coll., implementing certain provisions of Act No. 151 / 1997 Coll., on the valuation of assets and amending certain laws (the Law on the valuation of assets), as amended by Decree No. 127 / 1999 Coll., is amended as follows:
1. in Paragraph 2, the following point (j) is replaced at the end of the dot:
"(j) population is the number of residents permanently resident in the territory of the respective municipality according to their status published by the Czech Statistical Office in the current edition of the Small lexicon of the municipalities of the Czech Republic."
2. in Article 5 (1), the reference to footnote 3), after the word "house," shall be moved after the word "house."
3. in Article 13 (2), in respect of coefficient K4... the words "or non-residential space" shall be inserted after the words "or non-residential space" and the words "or non-residential space" shall be inserted after the words "the furniture of the apartment."
4. In Paragraph 21 (1), the comma after number 12 is deleted and the number "13 'is deleted. At the end of paragraph 1, the following sentence shall be added:" If the land of the same owner as the building referred to in the previous sentence is situated on it, the price of the building shall be established, including that land, if it is kept in the property register as a built-up area and courtyard, or if part of the land in the area corresponding to the built-up area of the valued building, if it is carried out in the property register in another type of land.'
5. In Paragraph 21 (2), the words "or land 'shall be inserted after the word" buildings'.
6. In Article 21, the following paragraph 3 is added:
"(3) Where a lease is leased by an award-winning set of buildings and land, including permanent crops owned by the same entity, as a whole, without distinction of rent to individual buildings, or land, the property shall be valued as the arithmetic average of the prices of buildings, land and permanent crops determined in a cost-free manner, without a Kp coefficient and the prices determined in a yield-based manner. ';
7. In Article 22, at the end of paragraph 1, the dot is replaced by a semicolon and the following words are added: "The capitalisation rate shall be applied to the valuation of the set of structures, land and permanent crops referred to in Article 21 (3) according to its basic purpose of use."
8. In Article 22 (4) (c), the words "kept in the accounts' are deleted and the words" kept in the accounts' are inserted after the words "administration '.
9. in Article 23 (1) (b) to (e):
"(b) in the statutory cities, (11) Františková Lázně a Mariánské Lázně and in the municipalities whose cadastral territories are adjacent to them,
1. 800 CZK in statutory cities, Františková Lazne and Mariánské Lazne,
2. 300 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the cities referred to in point 1,
(c) in Český Krumlov, Jáchymov, Karviné, Luhačovice, Poděbrady and Teplice, and in the municipalities whose cadastral territory is adjacent to them,
1. 500 CZK in Český Krumlov, Jáchymov, Karviné, Luhačovice, Poděbrady and Teplice,
2. 200 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the cities referred to in point 1,
(d) in municipalities with a population above 25 000 and in municipalities whose cadastral territories are adjacent to them,
1. 250 CZK in municipalities with population over 25 000,
2. 100 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one municipality referred to in point 1,
(e) in municipalities of more than 15 000 inhabitants up to 25 000 inhabitants, in Jeseník and in municipalities whose cadastral territories are adjacent to them,
1. 150 CZK in municipalities of over 15,000 inhabitants up to 25,000 inhabitants and in Jeseník,
2. 50 CZK in municipalities whose cadastral territory is adjacent to the cadastral territory of at least one of the municipalities referred to in point 1, "
10. in Paragraph 23 (1), the sentence "Population shall be determined according to the last census." shall be deleted;
11. in Article 23 (6), "§ 26 (3)" is replaced by "§ 26 (4)";
12. in Article 23 (7), "§ 26 (2)" is replaced by "§ 26 (3)";
13. in the first and second sentences of Paragraph 23 (8), the coefficient "0,70" is replaced by the coefficient "0,60."
14. In the first sentence of Article 23 (9), the word "building" shall be deleted and the word "sandpit" shall be replaced by the word "sandpit," after the word "sprinkler," the words "except for parcels for remediation, 15b)" shall be inserted.
footnote 15b is replaced by the following:
"15b) Paragraph 31 (5) of Act No. 44 / 1988 Coll., on the Protection and Use of Mineral Wealth (Mining Act), as amended by Act No. 541 / 1991 Coll. '.
15. Paragraph 23 (12) reads:
"(12) The criteria for the valuation of land are set out in the various paragraphs. If the measured plot meets the criteria set out in several paragraphs at the same time, the following order of measurement shall apply to the valuation method: 4, 5, 1, 2, 3, 9, 8, 6. ';
16. The following Section 23a is inserted after Section 23:
„§ 23a
Price map of the village building land
(1) The price map of the construction land of the municipality contains the text and graphic part.
(2) The text part contains:
(a) a substantive analysis of the local real estate market base and the possibility of further development, in particular in relation to the size and nature of the municipality, internal and external factors and local specificities affecting its quality;
(b) a description of the draft map material used and its quality in terms of compliance with the legal status of the cadastral property with the actual state of the field;
(c) a comment on the price sources used for drawing up the graphic part and the results of their analysis;
(d) a description of the processing process and the assumption of the period of effectiveness.
(3) The graphic section contains:
(a) a map showing the construction land in the municipality on a scale equal to or greater than 1: 5 000;
(b) identification and information (name of municipality, cadastral territory of local areas of the municipality, square and street, or partariff numbers of the land),
(c) the prices of each building plot and, where applicable, the prices of the defined parcel groups with the same use and the same construction equipment. "
17. in the first sentence of Paragraph 25 (1), the words "the predominant set" shall be replaced by the words "the predominant sets" and the sentence of the second sentence shall be replaced by the following sentence: "The price of forest land shall be the sum of the prices of its parts in the individual crop groups defined therein."
18. In Article 26, the following paragraph 1 is inserted:
"(1) Land which, according to § 9 (1) (a) of Act No 151 / 1997 Coll. is not building land but which is included in a valid urban plan of the municipality or regulatory plan 15a) as land for construction, is valued in accordance with § 23 (1) and multiplied by a coefficient of 0,30. This price may not be lower than the price established under Paragraph 26 (4). '
Paragraphs 1 to 3 shall be renumbered paragraphs 2 to 4.
19. In Paragraph 26 (2), the following sentence is added at the end: "This price may not be lower than the price determined in accordance with paragraph 4. '.
20. In Paragraph 28 (4), the sentence behind the semicolon is replaced by the following: "for non-scheduled washing where, within the margin of washing, it is associated with groups of timber in Annex 21, the price of the Au toll extract shall be determined as a reasonable value by interpolation. '
21. In Paragraph 28 (8), the following shall be inserted after the words "Annex No 25": "if, within the limits of washing, it is associated with groups of timber in Annex No 21,"
22. In Paragraph 28 (9), the following shall be added at the end of the sentence: "and the price per m2 of the group of timber shall be calculated using the formula:
Ha = Au × Ba '.
23. In Paragraph 30 (1), the words "a" shall be replaced by a comma after "Table 1" and the words "and 3" shall be inserted after "2."
24. in Article 33 (1), the following shall be added at the end of point (a): "Part I for intensive planting and Part II for garden planting,"
25. In Annex 1 (5) (4):
"(4) The enclosed roof area, including the attic at the roof of the sloping, whatever its shape, shall be calculated by multiplying the surface of the soil and the attic by the sum of the average height of the soil cover and half the height of the ridge above the average height of the soil cover. If other shapes of roof structures prevail, the enclosed roof space shall be calculated as the volume of the geometric body. '
26. In Annex No 14, point 4, the word "always' shall be inserted after the word" apply '.
27. In Annex No 14, point 6, the words "in particular 'shall be inserted after the words" all buildings' and the words "in the same way as the original part 'shall be deleted.
28. In Annex No 15, Table 1, entry 1 reads as follows:

30. The second sentence of Annex 15 to the text under Table 1 reads: "The use of surpluses and haircuts under headings 1, 12 and 13 must be shown to be justified. '
31. In Annex No 15, Table 2, headings 8 and 9, a comma is added at the end of the texts set out in the second column and the words "not applicable to gardening chats'.
32. in Annex No 15, under Table 2, points (1) and (2) are deleted;

34. Forest type files (SLT) are units of a typology system that pool forest types according to ecological affinity expressed by significant habitat characteristics. Forest types are drawn in forest type maps.
SLT are defined by vegetative forest stages and edafic categories, with related categories forming series. The specific properties of SLT are expressed by a two-digit code; the figure at first place of the code (0-9) indicates belonging to the vegetative forest stage, while the letter at second place of the code characterises the characteristics of forest land, including water content and influence, and the edafic species combination. Individual letters (total 24) refer to basic, secondary and transitional categories, which are the basis for sorting within rows (total 8).
SLT data are part of the forest economic plan or forest economic curriculum of forest owners. '
36. In Annex No 19, entries 1.4 to 1.9, 2, 3.7 to 3.11 are deleted.
37. In Annex 19, the following entries 4 and 5 are added:

Depending on the nature of the fruit privileges and the production systems used, basic prices for fruit trees are divided into two separate parts, the first of which includes prices in CZK / m2 for planting intensive plantations of fruit orchards, while the second part contains prices in CZK / pcs for all extensive planting of garden type.

* The lowest basic price of each fruit tree, which applies also to ages exceeding their defined table age.
1. The lowest basic prices of each fruit tree cannot be reduced by any price adjustment.
2. Consistent, integrated planting of one fruit species with an area of more than 0,25 ha, planted in a single tree or shrub buckle, shall be regarded as an intensive type of fruit industry.
3. The basic prices of each fruit tree include an appropriate proportion of the cost of their normal support (stakes, wire, etc.).
4. The basic prices may be increased by up to 25% on the grounds that the planting has been proven to have been carried out from healed, viral crops of the best quality varieties and is in excellent or very good growing condition at the valuation date.
5. Basic prices can be reduced by up to 80% with justification in the event of consequences of inadequate care, external manifestations of mechanical, health or other specifically specified damage. The adjusted price shall not fall below the lowest basic price of the relevant fruit material. ';
