GOVERNMENT REGULATION
of 25 June 1997
determining the selected products for conformity assessment
The Government orders pursuant to § 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Laws ("the Act ') to implement § 12 (1) (a), § 12 (4) and § 13 (2) and (4) of the Act:
§ 1
(1) For the purposes of this Regulation, the products provided for in Paragraph 12 (1) of the Act are those listed in Annexes 1 and 2.
(2) The characteristics of the specified products must comply with the requirements of the legislation applicable to them (hereinafter referred to as "essential requirements for products"). Compliance with the essential requirements for products is considered to comply with the relevant provisions of the relevant Czech technical standards. Where a manufacturer, importer or distributor intends to place on the market a product whose characteristics are not in conformity with the provisions of Czech technical standards, ensuring the safety of such products at least at the same level as the level of protection laid down in Czech technical standards shall be deemed to meet the essential requirements for products.
§ 2
The manufacturer, importer or distributor shall ensure, for the products listed in Annex 1, a conformity assessment of the product by:
(a) procure the technical documentation referred to in Article 4;
(b) carry out a conformity assessment in accordance with Article 12 (3) (a) of the Act before placing the product on the market and on the basis of the technical documentation referred to in Article 4 and on the basis of tests on a sample of the product which it shall carry out or enter into the product, assess whether the characteristics of the product meet the essential requirements for the products,
(c) take measures to ensure that all products placed on the market comply with the technical documentation.
§ 3
(1) The manufacturer, importer or distributor of the products listed in Annex 2 provides for an assessment of the conformity of the product sample (prototype) with the essential requirements for the products (Article 12 (3) (b) of the Act) with the authorised person (Article 11 (1) of the Act).
(2) The authorised person shall assess the conformity of the sample of the product with the essential requirements for the products and shall issue a document to the manufacturer, importer or distributor on conformity assessment.
(3) For type examination, the manufacturer, importer or distributor shall provide the authorised person:
(a) identification data (name and surname, place of residence, place of business and identification number of the natural person or business name, registered office and identification number of the legal person and place of manufacture of the products);
(b) technical documentation;
(c) a sample of the product.
(4) The authorised person shall carry out the type-examination by:
(a) examine the supporting documents submitted by the manufacturer, importer or distributor and assess whether they comply with the requirements of this Regulation;
(b) test a sample of the product and verify that the product as a type meets the essential requirements for the products.
(5) Where a product sample complies with the requirements set out in Section 1 (2), the authorised person shall issue a certificate of the product type and transmit it to the manufacturer, importer or distributor. The product type certificate shall contain the conclusions of the detection, verification and test results, the description or, where appropriate, the representation of the product necessary for its identification.
(6) The manufacturer, importer or distributor shall ensure that all products placed on the market conform to a certified type.
(7) The manufacturer, importer or distributor may, in agreement with the authorised person, choose other procedures referred to in Section 12 (3) of the Act, if this is more appropriate for the product concerned.
§ 4
(1) The manufacturer, importer or distributor shall obtain technical documentation which shall allow conformity assessment of the product.
(2) The technical documentation shall include, taking into account the nature of the product,
(a) a general description of the product;
(b) production drawings and diagrams of assembly, components, circuits, product composition, technological process, fire-technical, chemical, physical and biological characteristics of the product, in relation to the protection of the life and health of persons, their property or the protection of the natural environment;
(c) descriptions and explanations necessary for the clarity of the drawings, diagrams and functions of the product, instructions for use, including, where appropriate, service requirements, including marking of fire-fighting technical characteristics;
(d) warnings and warnings of hazards and instructions for safe use as part of the documentation shall be in the Czech language; where the warning is to be indicated directly on the products, it shall be made legibly and permanently;
(e) a summary of the technical regulations and a list of the Czech technical standards used (Section 4 (1) of the Act) and, where applicable, of their articles and a description of the solutions adopted to meet the essential requirements for products;
(f) the results of the design calculations and tests carried out;
(g) test reports and, where appropriate, certificates.
§ 5
The documents (Section 13 (4) of the Act) on the method of assessment of conformity used include technical documentation or documents issued when assessing conformity by an authorised or accredited person (Section 14 of the Act).
§ 6
(1) The declaration of conformity shall be drawn up in the Czech language and shall contain the following particulars:
(a) identification details of the manufacturer, importer or distributor issuing the certificate of conformity (name and surname, residence, place of business and natural person identification number or trade name, registered office and legal person identification number),
(b) product identification data (e.g. name, type, brand, model, production number), for imported products, also manufacturer and manufacturing site identification data;
(c) description and designation of the product (manufacturer, importer or distributor designated for use), other product information, e.g. class of interference, toxicity, class of ignition;
(d) a description of the method of conformity assessment used;
(e) a list of technical regulations (Section 3 of the Act) and of Czech technical standards used in conformity assessment;
(f) where the conformity assessment has been carried out in the form of a type-examination, details of the authorised person (trade name, registered office, identification number of the authorised person) who carried out the type-examination, the number and date of issue of the certificate (including its period of validity); the same information shall be provided by the manufacturer, importer or distributor in the event that he has used the finding (protocol, certificate, etc.) of the accredited person to assess conformity,
(g) confirmation by the manufacturer, importer or distributor that the characteristics of the product satisfy the essential requirements for the products, that the product is safe under normal and, where appropriate, by the manufacturer, importer or distributor of the intended use, and that it has taken measures to ensure that all products placed on the market comply with the technical documentation and the essential requirements for the products;
(h) the date and place of issue of the certificate of conformity; the name and function of the responsible person of the manufacturer, importer or distributor and its signature.
(2) Where there is a change in the facts on which a certificate of conformity has been issued for a product which is to continue to be placed on the market after that change and where such change may affect the characteristics of the product in terms of essential requirements for the products, manufacturer, importer or distributor, a new certificate of conformity shall be issued. Other changes to the facts on which the certificate of conformity was issued shall be indicated in the addendum to the certificate of conformity.
§ 7
For products placed on the market after the entry into force of this Regulation by 31 December 1997, the technical documentation may be supplemented by the documents referred to in Article 4 (2) (d) and (e) retrospectively and by 31 December 1997 at the latest.
§ 8
This Regulation shall enter into force on 1 September 1997.
