DECLARATION

laying down the procedure for the exercise of state regulation in the energy sector
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry ') provides, in accordance with Section 45 (6), for Article 11 (7) of Act No 222 / 1994 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on State Energy Inspection (hereinafter referred to as" the Act'):
Information to exercise regulation
(1) The information required under Article 9 (8) of the Act, as set out in the Annex to this Decree, is necessary for the exercise of state regulation ("regulation '); in particular, data on costs, revenues, profits, new investments and comments on these data.
(2) The data referred to in paragraph 1 concern unit power authorisation holders over 50 MW, gas generation authorisation holders, combined heat and power generation holders over 50 MW and power distribution authorisation holders over 50 MW.
(3) The data referred to in paragraph 1 do not concern power distribution authorisation holders whose annual supply to all customers does not exceed 2,5 TWh and gas distribution authorisation holders supplying less than 400 thousand m3 / year or 300 t / year propane, butane or mixtures thereof.
(4) The data referred to in paragraph 1 shall be processed for annual financial years, broken down by the tables set out in the Annex to this Order, and sent to the Ministry by 31 March of the following year. If, after the audit has been carried out, this information has to be notified to the Ministry within one month.
(1) Data on cogeneration shall be monitored separately.
(2) Data on electricity distribution shall be monitored separately for 400 kV and 220 kV power distribution installations and 110 kV and below.
(3) Data relating to the gas distribution are monitored separately for 4 MPa and above for the 4 MPa and for the 4 MPa and underground storage facilities.
When entering an object for the purpose of implementing the regulation, a written mandate for the performance of the regulation shall be submitted.
Submission of price change proposals
On the basis of the control and assessment of the data, proposals to change the prices of electricity, gas and heat shall be submitted at least four months before the expected start of the change.
Efficacy
This decree shall take effect on the day of its publication.
