issuing railway transport rules
The Ministry of Transport provides, pursuant to Sections 22 (5), 34 (7), 35 (4), 42 (3), 43c (9), 43d (5), 44 (1), 46t (2), 49o (9) and 66 (1) of Act No. 266 / 1994 Coll., on Railways:
Interpretation of certain terms
For the purposes of this decree:
(a) the transport point on the track used to control the movement of trains and the movement between transport stations;
(b) the lines defined by the part of the track intended for the running of the train, normally divided into line sections between railway lines with rail branching and rail tracks in transport stations;
(c) a railway station with a rail branch, with or without a rail branch, and with a specified range of transport services provided,
(d) a stop marked on the runway, intended for the entry and exit of passengers into and out of the train vehicle, with a limited range of transport services provided;
(e) a traction vehicle, dependent on its movement on specified parts of the track (rails, trolleys, ropes, etc.) or, in the case of the track, a trolleybus and a railway vehicle, moving at its own force outside the traction line and powered by an independent source, which is primarily intended for use when powered by a traction line; the traction vehicle is not a production service vehicle operated on a separate basis on designated track tracks, as well as a light means of transport which is not designed to be connected to the track vehicles and is dependent on human strength when moving;
(f) a traction vehicle, capable of developing a traction force, or braking force, for movement and braking, of its own and, as a rule, other traction vehicles;
(g) a non-self-propelled railway vehicle equipped with a technical device for remote control of the designated types of traction vehicles;
(h) a special vehicle driving a railway vehicle with a rated mass of more than 20 tonnes with its own propulsion, a driving railway vehicle, regardless of its own propulsion mass, enabling the railway vehicle to reach a speed of more than 10 km / h or a towed railway vehicle or a control wagon designed for the construction, maintenance, repair or reconstruction of the runway, for the control of the track condition or for the removal of the consequences of incidents;
(i) by the driver of the traction vehicle, the driving railway vehicle or the steering wagon from which the running of the train or train vehicle is controlled;
(j) the type of groove vehicle of the vehicle, determined by the relevant parameters, specifying its characteristics and its use; they are in particular the type of vehicle and the mode of operation, maximum speed, gauge and performance;
(k) a train group consisting of at least one traction and one towed track vehicle, marked with defined signals, accompanied by a train crew and running on a timetable or by an instruction from a competent person controlling the railway transport, or a separate traction track vehicle or a special vehicle with its own propulsion, or accompanied by at least two traction track vehicles, marked with specified signs, accompanied by a train crew and driving on a timetable or by an instruction from a competent person controlling the railway transport;
(l) the train path of the track section in the rolling stock transport station, intended for the train running;
(m) by driving according to the view ratios of the rail vehicle driving only by the person driving the railway vehicle, at which the driver must stop the train or shift part in front of the standing or the same direction of the driving vehicles in the common road and, as far as possible, from any other obstacle to its journey, including the anti-driving vehicles, the maximum permissible speed being not exceeded;
(n) a shift of each intended and organised journey of the train;
(o) by accompanying the train specified by the train occupancy by designated persons;
(p) a competent person designated by the railway operator or by the carrier, providing activities directly affecting the safety of the railway operation and the railway transport, which are competent under the legislation and the internal regulation of the railway operator for the operation of the railway or the legislation and the internal regulation of the carrier for the operation of the railway traffic;
(q) an exceptional event which, in the field of railway transport, threatens or threatens the safety of the operation of railway transport, the safety of persons and the safe operation of structures and equipment, or the environment;
(r) the track gauge tables of the aid containing the lists and markings of the track sections (line sections) and technical operational data relevant for the safe operation of railway transport;
(s) a main indicator of the device which, by means of its signals, allows the train to travel behind the indicator and determines the maximum speed at which the train may go or prohibits the train from driving behind the signal;
(t) by the circuit of switches adjacent to the main signal section of the track with switches from the main signal to the last switch in front of the following main signal in the circuit of the railway section but not further to the level of the input signal from the opposite direction,
(u) the excluded track track track in the transport or line section on which the regular operation of railway transport has been temporarily excluded, the journey of the railway vehicle on the excluded track may only take place if the conditions laid down are met;
(v) the spatial section of the part of the line between the two adjacent transports;
(w) reduced visibility, at which at least 100 m of visible objects and persons are not visible (between dusk and dawn, fog, snow, heavy rain and enclosed unlit spaces).
RULES FOR THE OPERATING OF THE SPECIES
(1) The rules governing the operation of the runway lay down the manner and conditions for:
(a) runway security;
(b) runway operator,
(c) organising railway transport,
(d) emergency measures.
(2) The technical conditions for the safety of track components are laid down in a separate regulation.
(3) The runway must be regularly checked and maintained to ensure its operational capability. Organise the maintenance of the runway, ensure and control the specified technical parameters of the runways (1) only persons professionally qualified.
(4) In order to ensure the activities and to determine the competence of a person (3) involved in the security of the runway, the operation of the runway and the organisation of the runway, where such activities are carried out by the staff of the railway operator, the technological procedures contained in the internal rules of the railway operator are used.
NATIONAL AND REGIONAL SPECIES
Track security
In order to ensure the runway, it is necessary to determine the method and conditions for the identification of track equipment, signalling, the conditions for the visibility of signals and the conditions for the determination of the stopping distance.
Labelling of track equipment
(1) The tracks, switches, track junctions, side protection devices for the train path and signals shall bear a number, letters or combinations thereof, as appropriate. The same marking of the device shall not be repeated in one transport station.
(2) The indication of the equipment of the part of the railway section relevant to the railway station shall be given in a uniform manner in the schematic plan to be deposited with the railway traffic controller at the railway station.
(3) The designation of the runway installation shall be uniform throughout the entire runway for which an official operating permit has been issued.
(4) Lists containing the identification of the runway equipment, relevant for its safe operation, data on the transient of the train tracks, conditions for the movement, conditions for train management according to station and line ratios, including data on the authorised length of the train and the inclination ratios, relevant for the safe braking of the train, shall be given for each line section in the track gauge tables. Only persons of professional competence may use track-side tables.
(5) The track operator shall draw up and update the Route Book to match the actual track status. The updated tables shall be transmitted by the railway operator to the carrier operating the runway at least 21 days before the date of their validity, in electronic form in PDF format and with data structure enabling automated XML processing.
Marking system
(1) The signalling system consists of a uniform system of visible signals in the defined design, shape and colour and audible audible signals in the specified design. The signalling system shall enable easy, rapid and unambiguous expression and perception of signals and ensure the safe operation of railway transport. The retro-reflective background of the signal cannot be used in combination with light signals. The basic signals of the signalling system are listed in Annex 1, Part I, which is part of this decree.
(2) The signs shall be given by means of a signal device (e.g. signal flag, lamp, signal board) or hand (hand visible signals), or by sound (audible signals), or by means of signs of mechanical or light signals and non-replaceable signals (visible signals), or by verbal instruction.
(3) The signs, provided by the train crew by the main signals in the line sections between the transport stations, must be at least at the stopping distance and at most at twice the stopping distance of the vanguard by means of the signs of the previous main signals or signs of separate signs, unless transmitted to the leading railway vehicle; on lines with an automatic block, no more than 2000 m shall be hatched In front of the light and mechanical signals of the main signals in the line sections, the distance warning devices shall be placed, the light and mechanical main signals in the line sections shall be placed according to local conditions to ensure the specified visibility of the signals.
(4) In the case of light main signals, the principle of speed signalling for the circuit of switches shall apply, adjacent to the relevant main indicator. The station track in the adjacent circuit of switches may be driven at the highest speed resulting from the signal sign of the relevant main indicator, but at the most track speed.
(5) For ease of reference, the mast main signals, premonitions, dwarf main signals valid only for the train and mast signals shall be distinguished by the colour marking of the uniform design.
(6) The signs of mechanical signals, if the signals are not made of light reflective material, are given at reduced visibility by a light signal (night sign). The hand signals shall be provided with a light-signalling signal at reduced visibility or the hand-signalling signs shall be illuminated (night signs).
(7) Changes in the construction technical parameters of railway structures and structures on the track which affect the safety and continuity of railway transport shall be indicated by the signs listed in Annex 1, Part I, which is part of this decree.
(8) Other signals not covered by this decree may be used for the operation of the runway. Their implementation, meaning and use shall be uniform on the track for which an official authorisation has been issued and shall not be interchangeable with the signs provided for in this Order.
(1) The signalling system uses lights or signal paints when flashing red, yellow, green, blue and white, as well as red, black or grey colours; for mechanical signals, it is used to indicate the individual positions of arms and targets. Intermittent lights may be used to distinguish the meaning of signals. The colour (colorimetric coordinates) of the signal lights is given in Annex 1, Part III, which is part of this decree.
(2) At the same time, no more than three signal lights may appear on the indicator. If there are three flashing lights simultaneously, one shall be white. These signal lights may be supplemented by lighting symbols indicating the different stages of speed, direction of train running, track number, gradient marker marking, or other symbols, which shall not be interchangeable with signal lights.
(3) If one signal light is lit on the signal, the essential meaning of the colour of the signal light is:
(a) red - the signal "Stop,"
(b) yellow - "Warning,"
(c) green - "Free,"
(d) blue - "Motion prohibited,"
(e) white - the indication "Movements allowed."
(4) A extinguishing signal which is not marked as invalid, or a dubious or indistinct indicator always means a signal of a more serious character or a signal prohibiting, unless otherwise specified by the instruction of the railway operator.
(5) In the case of portable signals for electrical operation, portable signals for the electric operation of the orange colour or blue with an orange frame are used to enhance the safety and stability of operation in particular in the case of lockouts and elimination of demolished traction lines.
Visibility of signals and signals
(1) The signs of the main signals and of the separate signs in the transport and on the open line and the signs of the separate repetitive signs on the open line shall be visible from the standing leader of the groove vehicle at least 100 m away and from the lead of the groove vehicle driving at the highest speed for at least 12 seconds. The visibility period can be reduced to 7 s in cases
(a) if remote warning devices are placed in front of such a signal;
(b) in the case of a departure signal or a travel signal at the end of the track at the transport station;
(c) in the case of a tell-tale in front of which there is a different main marker or a repetitive marker at a distance less than the braking distance;
(d) at the crossing and repeating crossing,
(e) if the signal is transmitted to the leading railway vehicle.
(2) The visibility of the signs from the driving leader of the groove vehicle referred to in paragraph 1 may be interrupted at the distance between the groove vehicle and the marker by moving or fixed obstacles, provided that this does not impair the possibility of stopping the groove vehicle safely in front of that marker.
(3) Information on the signals of the main signals and indicators must always be transmitted to the leading railway vehicle if the train is at a speed of more than 100 km.h-1, with signals at the station of the person driving the railway vehicle for at least 7 seconds. This provision does not apply to the track section between the national border and the first border station in the Czech Republic, operated up to a speed of 160 km / h inclusive, if the track section is equipped with a device providing automatic activation of the emergency braking in case of failure to respect the signal prohibiting the journey.
(4) Visibility of signs of separate repetitive signs in railway wagons with rail branching and visibility of other variable signals and their signals in transport and open line shall be at least 100 m away; If the visibility of another runway vehicle is prevented, the visibility shall be at least 50 m. The visibility of the distance warning devices and other non-replaceable signals shall be at least 50 m.
(5) The hand-held signs given to the person driving the railway vehicle shall be given for as long as the person driving the railway vehicle does not confirm receipt of the signal or act in accordance with its meaning. If the shift is controlled by hand signals given by the person accompanying the shift, these signals shall be given throughout the period of the shift.
Braking distance
(1) The braking distance is the distance on which the train must stop safely from the speed at which it is allowed to travel in a given section of the line. The braking distance shall be determined in a uniform manner according to the technical parameters of the line and shall be shown in the table of track ratios. The stopping distance is 400 m, 700 m and 1,000 m.
(2) The braking distance shall be determined in the design documentation of the construction, reconstruction or modernization of the track or track, which has been verified in the construction control of the building concerned.
(1) The train path must be protected by deflection switches, other technical devices or at least by a lining indicator against the running of railway vehicles not intended for the running of trains.
(2) The lines on which trains run at a speed exceeding 100 km.h-1 shall be equipped with a track-side part of the train-safety device. The track section between the state border and the first border station on the territory of the Czech Republic operating up to and including 160 km / h may be equipped with a device providing automatic activation of emergency braking when the signal prohibits driving; in that case, the receipt of the signal prohibiting the journey need not be registered.
(3) The track part of the train protection is part of the track and the mobile part of the train protection is part of the groove vehicle on which it is located. The track and mobile part of the train protection shall ensure a reliable transmission of information from the runway to the runway vehicle.
(4) The mobile part of the train protection shall ensure that the train is stopped if the person driving the railway vehicle does not react in time to the operation of the response device. In addition, they shall ensure registration of the reception of the signal prohibiting the journey.
(5) When a train is driven under the full supervision of the European Train Safety System (14), the provisions of this Regulation on the time of visibility of signals, including the transmission of information on the signals to the leading railway vehicle, the braking distance, the braking percentage and the validity of the signals shall not apply. When a train is driven under the restricted supervision of the European Train Safety System (14), the maximum permissible speed of 120 km / h shall not be exceeded, without the application of the provisions of this Regulation on the transmission of signal information to the leading railway vehicle. The conditions of operation of the European Train Safety System established by the directly applicable European Union14) shall be taken into account by the railway operator in the technological procedures for the operation of the runway and runway.
Rail service
In order to ensure the operation of the runway, the rules laying down the means and conditions for the operation of the runway by means of transports and stations and for the operation of switches and safety equipment shall apply.
Transport and habitats
(1) For the operation of the runway are designated the transport stations which are used to control the movement of railway vehicles; rail-branched transports are railway stations, switches and turns, without rail-branched transports are gates, sounds, partitions or non-replaceable signals indicating the boundaries of the spatial section.
(2) For the operation of the runway, also stations may be set up to operate the turning point from the line to the train, to operate the crossing guard or to operate the rail link or to operate the railway junction.
(3) Each transport station or station shall have a name or number.
(4) For each rolling stock, the technical procedures for the operation of the runway and for the operation of railway services shall be processed by a competent person according to the technical equipment of the railway station and its use.
Switching and operation of the safety device
(1) Exemptions may only be operated by a competent person. The switch shall not be allowed to be converted in front of the rolling stock in such a way as to jeopardise the safety of its driving, under the moving vehicles, except for switches which are converted directly by vehicles, and in cases where danger is averted.
(2) The switches of the track couplings shall be adjusted to the same position after the end of operation, allowing for direct or secondary travel.
(3) Only a competent person may operate a safety device.
(4) The controls to be carried out by emergency operations shall be fitted with safety seals or operating counters or their use shall be documented by a technical device. Any use of emergency operating controls or removal of safety conclusions shall be justified and recorded.
Organisation of railway transport
In order to ensure the organisation of railway transport, it is necessary to determine the arrangements and conditions for the management of railway transport, the simplified management of railway transport, the monitoring of the railway vehicle, the monitoring of traffic transmission and operational management of railway transport.
Railway traffic management
(1) Railway traffic management is organised according to the timetable. When operating the runway, dependencies resulting from the operation of the safety equipment are used to control railway traffic.
(2) When driving railway transport, a railway vehicle may move as a train or as a shift in the circumference of a railway station with a railway branch or as a shift between the transport stations or as a railway vehicle driving on an excluded track.
(3) Train journeys are controlled by:
(a) in the spatial sections between transport stations;
(b) by mutual distance
1. if continuous automatic train position reporting and train running control are ensured;
2. in cases where the train is driven according to the viewing conditions.
(4) Rail transport as referred to in paragraph 2 may be managed or managed by qualified persons only.
(5) The instructions given in traffic management shall be concise and comprehensible and shall not jeopardise the safety of railway transport. When issuing instructions for traffic management via a communication device, it must be clear who is issuing the order and who is receiving it. The order cannot be linked to other communications.
(6) A written record or an alert issued by technical equipment on other media shall be kept for at least 12 hours on the course of the railway traffic management process in each transport station or station occupied by the person controlling the railway transport or involved in the management of the railway transport. The date and time of the information recorded shall be registered on the alert.
(1) The entry of a train into a railway station with a railway branch, the journey of a train in a transport station and the departure of a train from a transport station may be permitted without the introduction of further measures if the following conditions are met:
(a) the train path for a given train ride shall not be occupied by other traction vehicles;
(b) the devices protecting the train path against the running of railway vehicles not intended for the running of trains, switches on or off and switches on shall be in the correct position for the train path and shall not be rebuilt until the train has released the relevant part of the train path (except for self-propelled switches, driven on the tip of languages),
(c) the journey of any other railway vehicle which meets or crosses a given train path shall not be permitted.
(2) The entry of a train into a rolling stock depot may be permitted without further measures being introduced only if the train path is properly built and free under the conditions of paragraph 1. It is forbidden for a passing train to build a train path for an unreduced speed and at the same time for departure, requiring a speed reduction that is not indicated.
(3) The entrance to a track occupied by railway vehicles may only take place in justified cases. The train crew member shall be informed of the entrance to the track occupied by the railway vehicles and the train journey shall follow the driving conditions according to the visual conditions from the first train departure before the track occupancy.
(4) The train shall not leave the station without a sign permitting departure or without the consent of the person managing the railway transport or without any other authorisation from the railway operator. The train path for the departure of the train in the circumference of the railway station with the rail branching shall be properly constructed and free in accordance with the conditions of paragraph 1. Departures of trains shall be managed in such a way as to respect the order of importance of each train. A passenger train may leave the railway station or stop only if the safety of passengers entering and leaving the train and the safety of train running is not compromised.
(5) If the train ride is organised in spatial sections, it is only allowed in the free spatial section without further measures. Exceptionally, a train may be allowed to travel to a space section which is not free only if the journey of the railway vehicles against each other can be reliably excluded and provided that it is driven according to the view ratios, in cases where:
(a) for an impossible understanding with neighbouring traffic services, only in a predetermined direction;
(b) in the event of failure of the safety device.
(6) Trains on single-track tracks shall be operated by communication between competent persons managing railway transport through the communication equipment or the activities of the track-side signalling equipment when equipped with it. In addition, train driving in the opposite direction and driving on two-way track tracks shall be provided by agreement to leave the train, either by communication via a communication device or by the operation of a signalling device.
(7) Changes in the conditions for train running, unless clearly indicated by the relevant signals or by hand signals, exceptional occurrences in the operation of the runway and runway which could affect the safety and regularity of the train running, and related instructions shall be notified to the train crew in writing or through a technical device with a demonstrable recording of communication by both parties.
(8) The activities in the security of the entry, departure and passage of the train and the way in which trains are operated are governed by the technological procedures established by the railway operator.
(1) Only the competent person may drive the shift.
(2) The competent person responsible for driving trains must always give his consent to the move on tracks intended for the carriage of trains.
(3) The speed shall not be exceeded 40 km.h-1 and 30 km.h-1. when the train is moved by pushing. When driving on a railway vehicle, the speed shall not be exceeded 5 km.h-1.
(4) In the event of the displacement of the groove vehicles by pushing, a competent person shall drive on the front vehicle when the railway vehicle is fitted to it, but not further on the other vehicle, or in front of the groove vehicles, so as not to jeopardise its safety and to overlook the track in front of the track and to give the necessary signals. This provision shall not apply to the displacement on the gradient or on the lift track.
(5) In the case of the displacement of the lashing vehicles by pushing through a crossing that is not equipped with a crossing safety device, or if the crossing safety device is defective or out of operation, the crossing shall be provided by a competent person.
(6) In the case of the displacement of the train tracks by pushing, or if the leading railway vehicle is driven from a position other than the front cab, through a level crossing of tracks which is not equipped with a track crossing warning device, or if the track crossing warning device is in or out of operation, the journey through the track level crossing shall be provided by a competent person.
(7) A signal (marker) shall be marked between the extreme switch and the input signal at a place where it is prohibited to move without further action.
(8) At a drop of more than 2,5 ° and at a distance of up to 50 m before that fall, it shall not be permitted to move with the traction vehicles which are not attached to the driving vehicle unless the grab of the traction vehicles is prevented by another traction vehicle or by a designed device for that purpose.
(9) When moving to a drop of more than 15 °, the displaced group of railway vehicles shall always be so braked as not to jeopardise the safety of the operation of railway transport.
(10) It is not permitted to reflect or run railway vehicles occupied by passengers and railway vehicles which are marked by the prohibition of reflection or launching. If it is verified that railway vehicles are reliably stopped by the manual brake, it is permitted to reflect or run railway vehicles occupied by persons, not by passengers.
(11) Stopped railway vehicles shall always be protected against drift. Railway vehicles weaned on a free track with a gradient of more than 2,5 ° shall be provided against the run before being detached from the traction train. In general, the provision of rolling stock against drift shall be done by manual brake.
(12) The shift activities, in particular for the provision of unset track vehicles, for the shift as a marker, through the ballast, the shift in multiple positions in the station simultaneously, the shift to the drop of more than 15 °, the shift to the electrified track sections, the shift to the load station operator, the shift between the transport stations and the shift in the operation of railway transport on the train shall be governed by the technological procedures established by the railway operator.
(1) A special driving vehicle can travel between the transport stations as a train or as a shift between the transport stations.
(2) The speed of a special driving vehicle which is driven as a shift between transport stations must be such that the special driving vehicle meets the driving conditions according to the viewing conditions.
(3) A special driving vehicle driving as a shift between the transport stations and to the track occupied by standing traction vehicles may enter rail branding without further measures.
(4) The shift between transport stations shall always be governed by a written order issued by the person controlling the railway transport. The shift between the transport stations with the shifting special driving vehicle usually allows for a line section not occupied by the traction vehicles. Departure between trains is permitted, unless otherwise specified. The person driving a special driving vehicle that operates as a shift between the transport stations shall be shown to be being driven behind a train or behind a track. It is not allowed to hang a special driving vehicle that drives as a shift between transport stations to a train.
(5) Movements between train-behind services are not permitted
(a) on line sections with reduced visibility to 100 m or less (e.g. fog, snow, heavy rain),
(b) in the line sections between the transports where the untransparent tunnels are intended to be moved beyond the tunnel. These sections shall be shown in the table of line ratios.
(6) A train can be set up after a special driving vehicle running as a shift between the transport stations only after the entire line section between the moving vehicles. If the moving vehicle does not release a line section between the transport stations at the time specified for its journey, the train may be driven to this section under the conditions of use according to the visual conditions and only in the direction of travel behind the moving vehicle at least 15 minutes from the specified time. At the end of this period, a special driving vehicle driving as a shift between the transports shall not move against the specified direction of travel.
(1) Only railway vehicles which provide
(a) the implementation or security of maintenance or repair or renewal work;
(b) ensuring track clearance;
(c) the removal of obstacles to track integrity; and
(d) the use of components of the integrated rescue system.
(2) Rail transport on the excluded track or parts thereof is managed by a competent person.
(3) The speed of the groove vehicle on the excluded track or part thereof shall be adjusted so that the track vehicle meets the driving conditions according to the visual conditions. When driving more than one separate train track, or the part of it excluded, the railway vehicle may drive at a speed of 30 km.h-1, unless the speed is lower.
(4) The position of stopping the train train shall be determined by the competent person in a kilometric position and the person driving the railway vehicle shall be clearly informed of the stopping position.
Simplified railway traffic management
(1) On the railway track where the railway transport is organised in such a way that only one train or a moving railway vehicle or a train crew has pre-defined transport stations where trains are crossing or overtaking, simplified runway traffic control can be used.
(2) The designated services are not permanently occupied by persons managing railway transport. In such cases, the train service is operated from one place and the train crew communicates with the person controlling the railway transport in specified transport areas. When crossing or crossing trains, the entrance track shall be determined in advance, or the train shall be determined first.
(3) On the line section, communication of the train crew to the person who controls the railway transport shall be ensured by appropriate communication equipment from the designated transport and, where appropriate, from the train.
(4) The train shall not leave the designated station without the consent of the person managing the railway transport or any other authorisation of the railway operator.
Tracking of railway operator's train vehicle
(1) The management of railway transport shall also include monitoring of the movement of railway vehicles by persons controlling and participating in the management of railway transport.
(2) If a defect is detected in the surveillance of the track or rail traffic when the train is in contact, measures shall be taken immediately to avert that danger and the carrier shall be informed thereof.
Track traffic transmission monitoring
(1) The railway operator shall determine the capacity of each section of the runway for the organisation of railway transport according to the structure of the runway, its technical equipment and the technological management of the runway, the lowest value of the capacity of each section of the runway being equal to the maximum runway capacity; the runway operator must organise the runway service in such a way that the runway capacity is used effectively.
(2) If the requirements of carriers exceed the maximum track capacity in one of the runway sections, the railway operator shall notify the Transport and Tariff Bulletin.
Organisation of railway traffic management with a planned track operating restriction
(1) The railway operator shall, according to an approved plan, prepare a proposal for an exclusive timetable for the operation of the runway or part thereof pursuant to § 23b and 23c of the Railway Act, which shall submit to each of the participating carriers at least 45 days before the date of the planned restriction on the operation of the runway. The carrier shall be entitled to apply the exclusive timetable proposal within 5 working days of the date of service. The railway operator shall assess the objections of the carrier within 10 days of receipt of the carrier's observations. In the event that the railway operator does not comply with or only partially comply with the objections of the carrier, the carrier shall inform the reasons for which it did not comply or only partially complied.
(2) In drawing up the exclusive timetable, the railway operator shall cooperate with the carriers which have allocated track capacity on the section concerned.
(3) When drawing up the exclusive timetable, the carrier shall be entitled to propose within the number of routes allocated its own priorities for the management of trains operated by it on the section concerned by the exclusion. The railway operator shall comply with the requirements of the carrier relating to the routes of public passenger trains which are used to ensure the transport service of the State, then the county and the citizen 15), to the maximum extent agreed with each carrier, if they were concluded. In the event that the agreement with the carrier has not been concluded, the runway operator shall proceed with the third and fourth sentences referred to in paragraph 1.
(4) Prior to the termination of the planned track operating limitation, the railway operator shall ensure that the correct operation of the signalling equipment is verified, which was directly affected during the course of the track operation limitation, or by changing the conditions for its operation; the restriction on the operation of the runway can only be terminated if the safety equipment concerned is properly operated.
