Czech Mining Office
of 16 March 1992
amending and supplementing the Order of the Czech Mining Office No. 72 / 1988 Coll., on Explosives
The Czech Mining Office provides pursuant to § 21 (6), § 24 (3), § 27 (5), § 32 (7), § 33 (5) and § 36 (6) of the Czech National Council Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll.:
Čl. I
Decree of the Czech Mining Office No. 72 / 1988 Coll., on Explosives, is amended as follows:
1. The title of the Decree is "on the use of explosives."
2. in Article 1 (2) (b), the words "and, in the case of explosives and devices for which quality checks lead to their destruction, a proposal for a statistical acceptance assessment 1) shall be deleted."
3. in Article 1 (2) (b), point 1 is deleted;
4. The following Section 4a is inserted after Section 4:
„§ 4a
Explosives and equipment testing
(1) The Czech Mining Authority may, in its authorisation to put an explosive or device into circulation in accordance with Article 4 (2), set a date for their examination. At the same time, it shall identify the organisation which shall carry out the examination.
(2) The evaluation of the examination carried out shall be submitted by the organisation which carried out the examination to the Czech Mining Authority and the applicant.
(3) If it is found at the time of the examination that the explosive or device does not comply with the company standard (technical conditions), it shall not be put into circulation.
(4) Samples of explosives or aids needed for examination, costs of examination and evaluation shall be borne by the applicant. "
5. In the first sentence of Paragraph 12 (3), "2,1 'is replaced by" 1,8'.
6. in Paragraph 18 (5):
"5) Decree No. 22 / 1989 Coll., on safety and health at work and safety at operation in mining and mining activities in underground. Directive of the Ministry of Health of the Czech Republic on health requirements for the working environment No. HEM-340.2-30.9.77 of 11.5.1978 (Reg. in amount 21 / 1978 Coll.), as amended by the Directive of the Ministry of Health of the Czech Republic No. HEM-34-2-21.3.85 of 2.4.1985 (Reg. in amount 16 / 1985 Coll.)."
7. in Paragraph 21 (3) of the Reference 7):
"7) Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 425 / 1990 Coll. ČBÚ Decree No. 22 / 1989 Coll., on safety and health at work and safety at operation in mining and mining activities in underground. '
8. In Article 27, the following paragraph 10 is added:
"(10) Simple types of explosives (e.g. mixture of ammonium nitrate and fuel) must be registered from the time of their manufacture. '
9. In Article 36, the words "the local national committee of the municipality 'and" the district administration of the National Security Corps' are replaced by the words "the municipality 'and" the district police department' and the words "a longer period 'are replaced by the words" otherwise provided'.
10. The title of the third section is: "Gunslinger, fireworks launcher, technical leader of missiles and leader of shredding works."
11. in the first sentence of Paragraph 40 (1), the words "have at least secondary education" are replaced by the words "successfully complete primary school."
12. In the first sentence of Paragraph 40 (2), the words "theoretical part of teaching 'are replaced by" teaching in courses' and in the second sentence, the words "National Security Corps and Border Guard 'are replaced by the words" and armed security corps'.
13. After Paragraph 40, the following Section 40a is inserted:
„§ 40a
Fireworks launcher
The candidate for the fireworks launcher approval must successfully complete the primary school and complete the course. '
14. In Paragraph 41 (1), the words "or with full secondary vocational education 'shall be inserted after the words" education'.
15. in Paragraph 42 (1) (9)) shall be deleted;
16. In Paragraph 42, the following paragraph 3 is added:
"(3) The course in which theoretical and practical instruction of applicants for fireworks shall be conducted shall have a range of at least 40 hours in five days; for the course, tenderers may not be entrusted with other tasks. ';
17. in Article 43 (1), the words "fireworks" shall be inserted after the words "gunner."
18. In Paragraph 43 (4), the words "assessment of the national committee on civil integrity 'are deleted.
19. in Paragraph 43 (3) of the Reference 10):
"10) Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll. '.

„§ 44
Registration of licences and authorisations
(1) The record of the shooting cards and the privileges and licences of the fireworks launcher is kept by the district mining office which issued them; The Czech Mining Office shall keep the records of the authorisations of the technical shooting leaders.
(2) The organisation shall keep a record of the licences and permissions of the gunmen and of the technical leaders of the fireworks launchers who are its personnel.
(3) The holders of the licences referred to in paragraph 1 shall report any changes to the particulars contained in those cards within one month of the date on which the change took place to the issuing authority.
(4) If the holder of a fireworks licence has not carried out fireworks for more than 5 years, he shall be tested from both theoretical and practical knowledge prior to the re-performance of the fireworks. 10a) '.
21. in Paragraph 44, a new reference 10a shall be added:
"10a) § 36 (2) of Act No. 61 / 1988 Coll., as amended by Act No. 542 / 1991 Coll. '.
22. Paragraph 56 (1) reads as follows:
"(1) Lightning caps may be cut with a knife on a clean wooden support or other authorised aids in accordance with the instructions for their use. '
23. in Paragraph 57 (2), the words "and are of the same resistance group" shall be deleted.
24. Article 90 (1) reads as follows:
"(1) The charges of the thoroughly safe explosives in the corkscrews shall not come close to any other load or to other unsealed corkscrews at a distance of less than 40 cm in coal and 30 cm in stone. '
25. Paragraph 104 (1) reads as follows:
"(1) The use of strictly safe explosives in non-bulking explosive work shall not be subject to the provisions on marginal charges (§ 88 (2)) and § 115 (3) (a) as regards the inadmissibility of the use of strictly safe Category I gas explosives. '
26. Paragraph 104 (3) shall be deleted.
27. in the second sentence of Paragraph 115 (1), the words "hazardous mines" shall be replaced by the words "mining works classified in a hazard grade 13)."

"(13) CSO Decree No 1820 / 1989 of 15 June 1989 issuing a safety regulation for mines with a risk of rock and gas bursts."
29. in Paragraph 147 (15):
"15) ČSN 73 5530 Storage of explosives and explosive articles. ';

„§ 177
For the purposes of this decree:
(a) fireworks works in which the energy of chemical explosive transformation of explosives and explosive articles is used to produce light or, where appropriate, sound effects;
(b) the place where the pyrotechnic articles are fired. ';
31. in Article 178 (1), the word "fireworks" is replaced by "fireworks" and the words "fireworks" are replaced by "pyrotechnic articles."
32. Paragraph 178 (2) reads as follows:
"(2) The head fireworks launcher shall be responsible for the safety in the preparation and execution of fireworks and shall determine measures to ensure the safety of all fireworks launchers and to protect persons and property in the space which is threatened by the execution of fireworks, the fall of pyrotechnic articles or their residues. '
33. The heading of § 179 reads "Fireworks."
34. In the first sentence of Paragraph 179 (2), the word "fireworks' is replaced by" fireworks'.
35. in Article 179 (4), "fireworks" is replaced by "pyrotechnic articles";
36. In the first sentence of Paragraph 179 (5), the word "fireworks' is replaced by" fireworks' and in the second sentence the words "fireworks or other fireworks' are deleted.
37. In Paragraph 179 (6), the word "fireworks' is replaced by" fireworks' and the words "National Security Corps' are replaced by the words" police department '.
38. In Paragraph 180 (2), the word "fireworks' is replaced by" the firing of pyrotechnic articles'.
39. In Paragraph 180 (4), the word "fireworks' is replaced by" fireworks'.
40. The heading of Part Four shall read "Common, transitional and final provisions."
41. Before Paragraph 181, the following Paragraph 180a is inserted:
„§ 180a
Common provisions
The provisions of this Decree also apply to pyrotechnic articles and articles containing explosives if they are likely to endanger the safety of persons and property [explosive articles 16a)].
Paragraph 181 (3) reads as follows:
"(3) The authorisations of gunmen, fireworks launchers and technical firing leaders issued under the current regulations remain valid."
43. Paragraph 182 (2) reads as follows:
"(2) Except in the cases referred to in paragraph 1, the organisation may derogate from the provisions of this Order with the agreement of the Czech Mining Authority and under the conditions laid down for them on a proposal from the Head of Organisation supported by the necessary replacement measures. The proposal shall be submitted via the Circuit Mining Office, only in exceptional cases and provided that safety of work and operation is ensured. ';
44. Paragraph 182 (3) shall be deleted.
45. in Section 183, the following points 15 to 34 are added:

46. in Annex 2, reference 17) shall be deleted;
47. In Annex 2, point I, at the end of "and the use circuit ', the words" the use range and the method of marking plastic explosives for detection' are replaced by the words "the use range '.

This decree shall take effect on the day of its publication.
