DECLARATION
Ministry of Forestry and Water Management of the Czech Socialist Republic
of 27 December 1973
on the purchase of wood from the forest
The Ministry of Forestry and Water Management of the Czech Socialist Republic, in agreement with the participating central authorities of the state administration, provides, pursuant to § 55 paragraph 1 of Act No. 166 / 1960 Coll., on Forests and Forestry (Forest Act):
§ 1
Wood purchase
(1) In order to make efficient use of timber for the needs of the national economy, forest users under professional management (hereinafter referred to as "forest users') (1) shall be required, unless otherwise specified, to offer within 14 days in writing to the organisation carrying out the professional management of forests for purchase:
- industrial coniferous cuts,
- coniferous columns and columns,
- coniferous mining wood,
- coniferous fibre wood,
- straight coniferous wood,
- industrial cut-out,
- leafy fibre wood,
- flat industrial wood,
- Christmas trees.
(2) Within 14 days of the receipt of the offer, the forest management organisation shall be obliged to purchase all coniferous wood from the wood offered (paragraph 1).
(3) If there is no agreement on the place of redemption, it is the place of extraction (at the stump).
(4) With the timber offered, which is not purchased by the forest management organisation within 14 days of the delivery of the offer, and with the types of timber not referred to in paragraph 1, the forest user may, subject to the provisions on wood removal (Section 5), freely dispose of the wood.
§ 2
Direct supplies and production consumption of timber
(1) The obligation to offer timber to be bought out under the provisions of § 1 does not apply to socialist organisations for which they have been given written consent by the organisation responsible for the management of forests
(a) for its direct sale to woodworking organisations, for Christmas trees also to commercial organisations;
(b) for its production consumption (e.g. in associated wood production of JZD).
(2) The consent referred to in paragraph 1 shall be given by the organisation carrying out the professional management of forests only if the tasks of the State Plan for the Development of the National Economy in the supply of timber are ensured.
(3) The organisations referred to in the preceding paragraphs are required to ensure that timber species which can be used more economically in other sectors of the national economy are not used for production purposes (e.g. industrial coniferous and leafy grades I and II, columns and coniferous sections).
§ 3
Own consumption of wood
(1) Furthermore, the obligation to offer timber for buyout pursuant to § 1 does not apply to cuts of industrial coniferous and deciduous forest users certified by forest management organisations, that they have already performed the entire mining task for the current year and that they have properly and normally performed other forest production tasks (the performance of the forest economic plan tasks is also assessed during the period of the previous years), to the following extent:
(a) socialist organisations for the necessary repair and maintenance of their buildings and equipment up to the quantity corresponding to 15% of the total timber production referred to in Article 1 (1), and also for their own investment construction in the amount approved for each investment operation by the district national committee;
(b) single agricultural cooperatives which manage forests, including for the repair or, where appropriate, restoration of the housing of their members (workers) in quantities to be approved by the district national committee for the application of the cooperative;
(c) private users of forests for the necessary repairs or, where appropriate, the renewal of their own residential buildings, in quantities to be approved by the district national committee; private forest users shall accompany the application with a statement from the organisation carrying out forest management.
(2) The approval of the District National Committee referred to in the previous paragraph does not replace the authorisations required for repairs or investment construction under the rules on construction.
(3) Paragraph 2 (3) shall apply mutatis mutandis to the use of wood for own consumption.
(4) The obligations laid down in Paragraph 1 (1) shall not apply to Christmas trees which the forest user retains for the needs of his household (socialist organisation for the needs of the household of his workers or members).
§ 4
Binding of the forest economic plan's mining regulation
Forest users, government authorities, as well as forest management organisations are obliged to ensure that the annual mining rules resulting from approved forest plans are not exceeded when buying up, direct supplies, production consumption, own consumption and other management of harvested timber.
§ 5
Wood transport
All harvested timber (including Christmas trees) may be removed from the forest only after the control mark and the issue of the relevant document (delivery note, code list or other document) by organisations carrying out the professional management of forests. The date of departure shall be indicated on the document.
§ 6
Specific provisions for organisations which exceptionally manage forest national property
State organisations which exceptionally manage forest national property pursuant to § 18 of the Forest Act are subject only to the provisions of § 4 and § 5, with the fact that the control mark and issue of the document (code list) is carried out by their own professional forestry economy.3)
§ 7
Authorisation of exemptions
(1) The County National Committees may exceptionally waive the obligation to offer private forest users the obligation to purchase timber required for the execution of repairs other than those referred to in § 3 (1) (c).
(2) Exceptions to the provisions of Sections 1 (1), 2 (1) and 3 (1) (a) may be authorised by the Ministry of Forestry and Water of the Czech Socialist Republic.
§ 8
Repeal
The Order of the Ministry of Forestry and Water Management of the Czech Socialist Republic No. 142 / 1969 Coll., on the purchase of timber from the forest is hereby repealed.
§ 9
Final provision
This Decree shall take effect on 1 January 1974; its provisions shall apply until 31 December 1977, where they govern relations between socialist organisations.
