DECLARATION
of 11 June 2024
amending Decree No. 79 / 2010 Coll., on the control of the electricity system and on the transmission of data for dispatching, as amended
The Ministry of Industry and Trade provides pursuant to § 98a (1) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll. and Act No. 165 / 2012 Coll.:
Čl. I
Decree No. 79 / 2010 Coll., on the control of the electricity system and on the transmission of data for the dispatching procedure, as amended by Decree No. 388 / 2012 Coll. and Decree No. 194 / 2023 Coll., is amended as follows:
1. In Article 8 (7), the words "or a restriction on the use of the reserved power of the electricity plant without compensation (" the negative power ')' shall be inserted after the word "system6 '.
2. In Section 10 (3) (b), at the end of the text of point 5, the words "including a restriction on the supply of power to a power plant connected to a negative power 'are added.
3. In Section 10, the following paragraph 6 is added:
"(6) The transmission system operator shall make use of the power limits supplied to the transmission system from the power generating modules connected with the negative power in cases of activation of the remedial measures and of the system defence plan provided for by the directly applicable European Union regulation laying down a framework instruction for the operation of the electricity transmission system (7). The procedure for the use and the extent of the limitation of power generating facilities connected with the negative power shall be negotiated by the transmission system operator with the electricity producer.
7) Article 23 of Commission Regulation (EU) 2017 / 1485. '
4. In Article 13 (3), the following point 5 is added at the end of point (d):
"5. to limit the delivered power of the power plant connected to the negative power, '.
5. After Paragraph 13, the following Section 13a is inserted:
„§ 13a
Operational management of the operation of power generating facilities connected to the distribution system with a negative performance
(1) The distribution system operator's technical dispatching system shall, as a priority, limit the power output of power generating facilities connected to the parts of the distribution system in which the distribution system control system is ensured to the extent set out in Annex 8 to this Regulation and where the technical equipment is installed and operated in accordance with point 5 of Annex 6 to this Regulation, if the generation of current congestion in the distribution system is prevented or the current congestion has already been eliminated by limiting the performance of these power generation plants.
(2) The distribution system operator's technical dispatching system shall limit the power output of power generating facilities connected with the negative power to a maximum power level supplied from the power plant to the distribution system and, cumulatively, up to the agreed amount and, if not agreed, the maximum available sum values for the restriction of electricity production using the negative power.
(3) The distribution system operator's technical dispatching system shall divide the size of the required power limitation to be supplied to the distribution system between power plants connected with the negative power according to current or anticipated operating conditions and, as appropriate, the power limitation of which power plant connected with the negative power will best contribute to preventing or addressing congestion in the distribution system.
(4) The power producer shall limit the power of the power plant connected to the negative power according to the operational instructions of the distribution system operator to a maximum of:
(a) the determined value of the power of the power plant connected with the negative power in the smooth way of regulating the power of the power plant connected with the negative power; or
(b) a specified or nearest lower value from the specified power value in the step-by-step way of regulating the power of the power plant connected to the negative power.
(5) The operational instruction to limit the performance of the power plant connected with the negative power supplied to the distribution system shall be issued by the technical dispatching of the distribution system operator for the period foreseen to prevent or manage congestion in the distribution system.
(6) If the power-generating facility manufacturer fails to comply with an operational instruction to limit the power of the power-generating facility connected to the negative power within 1 minute for non-synchronous power-generating modules or within 5 minutes for synchronous power-generating modules, the technical dispatching of the distribution system operator shall invite the power-generating facility manufacturer to immediately reduce the power-generating facility connected to the negative power within the scope of the operational instruction issued. If the power producer does not limit the power of the power plant connected with the negative power, within 5 minutes of the receipt of the call for immediate restriction of the power plant connected with the negative power referred to in paragraph 1, and if there is still a need to resolve the congestion in the distribution system, the distribution system operator shall change or interrupt the supply of electricity from the power plant connected with the negative power pursuant to Article 25 (3) (d) of the Energy Act.
(7) The regional distribution system operator's technical dispatching system shall inform the TSO of the restriction on the power output of power generating facilities connected with the negative power of the transmission system operator's technical dispatching system if the power limitation exceeds 50 MW beyond its managed distribution system.
(8) The TSO's technical dispatching system shall inform the connected local distribution system operator of the restriction on the power output of power generating facilities connected with the negative power of the regional distribution system operator if the power limitation exceeds 10% of the reserved power at the local distribution system connection point. ';
6. In Paragraph 14, the following paragraphs 3 to 6 are inserted after paragraph 2:
"(3) For each power-generating facility connected with a negative power, the distribution system operator's technical dispatching shall determine the estimated annual electricity generation in accordance with the procedure set out in Annex 9 to this Regulation. In the absence of a contract for the connection of a power plant to a distribution system, the value of the production restriction for the use of the negative power in the calendar year shall be 5% of the estimated annual electricity generation in the power plant connected to the negative power.
(4) The distribution system operator's technical dispatching system for any restriction on the supply of power from a power plant connected with the negative power shall determine the amount of electricity not delivered to the distribution system as a product
(a) the difference in power supplied to the distribution system at the time of the required start of the restriction on the performance of the power generating facility connected with the negative power and the required value, to which the power generating facility connected with the negative power should have been limited in accordance with the operational instruction; and
(b) the duration of the restriction on the performance of a power-generating facility connected to a negative power-generating facility, as determined by the technical dispatcher of the distribution system operator, but not more than the period for which the power-generating facility connected to the negative power-generating facility has restricted the power-generating facility's performance under the operational instruction.
(5) Where the distribution system operator's technical dispatching system has access to the instantaneous data from the distribution system operator of the specified systems installed on power generating plants connected with a negative power using solar energy or wind energy to determine the amount of non-delivered electricity on the basis of measurements of oscillation, wind speed or temperature in accordance with point 5 (b). (b) Annex 6 to this Decree or, if it is possible to determine the intended performance of these power plants from another similar system, the amount of electricity not delivered to the distribution system shall be determined as the sum of the products
(a) a positive difference between the expected instantaneous power output of electricity generation connected with a negative power using solar energy or wind energy in each assessment period and the required value to which the power generation plant connected with the negative power should have been restricted in accordance with the operational instruction; and
(b) the duration of the restriction on the performance of the power plant connected to the negative power in the evaluated time period determined by the technical dispatching of the distribution system operator, but not more than the period during which the electricity producer has restricted the power plant connected to the negative power according to the operational instruction.
(6) The annual value of the restriction on the generation of electricity using the negative power in a calendar year shall not include the quantity of electricity not delivered to the distribution system for a reason other than the restriction on the generation of electricity using the negative power or the interruption or restriction on the supply of electricity to the distribution system from the power plant connected with the negative power for which the distribution system operator is authorised under an energy law or other legislation. ';
Paragraphs 3 and 4 shall be renumbered paragraphs 7 and 8.
7. In Annex 6, point 5 is added, including footnote 8:
"5. Power plants connected to a distribution system with a negative power shall be equipped for the duration of the obligation under the connection contract with a negative power
(a) functional remote control of active power and data transmission as required by the distribution system operator; the remote control of active power is not a two-state system,
(b) a system enabling the estimated generation of electricity to be determined for the planning of operation and for the determination of the non-delivered electricity on the basis of the measurement of oscillation, wind speed and temperature, as required by the distribution system operator, including real-time data transmission;
(c) a control system enabling the active power to be limited to zero for non-synchronous power modules within 1 minute and for synchronous power modules within 5 minutes of the issue of the operational instruction by the technical dispatching of the distribution system operator and providing a permissible deviation of actual limited power not exceeding 5% of the required power limitation value;
(d) recording equipment8) also triggered in response to the issue of an operational instruction to the distribution system operator's technical dispatching system to limit the power output of the power plant connected to the negative power; and
(e) measurement and remote transmission of the instantaneous active power supplied to the distribution system at the connection point.
(8) Article 15 (6) (b) (i) and (ii) of Commission Regulation (EU) 2016 / 631 of 14 April 2016 establishing a network code for requirements for the connection of production facilities to the electricity system. ';
8. The following Annexes 8 and 9 are added, including the headings:

"Annex No 8
The scope of the distribution system control for the use of power constraints for power generation connected with the negative power
The scope of the distribution system control for the use of power-generating capacity limits connected with the negative power shall be defined in the real-time, measurement and transmission of data to the dispatching control system at least to the following extent:
(a) measuring the value and direction of the power flow in the outlet to which the power plant is connected with the negative power; or
(b) measurement of the value and direction of the flow of power in all transformations to a higher voltage level than the voltage level of the connection point of the power plant connected with the negative power.

The period of use of the maximum reserved output Tr [hr] for determining the estimated production in the calendar year shall be determined according to the relationship

In calculating the use time of the maximum reserved power In the case of a power plant in which a power storage facility is installed, the installed power of the power storage facility shall not be included in the value of the electricity generation plant installed.

Estimated electricity production in calendar year
The estimated electricity production in the calendar year and annual [kWh] shall be determined according to the relationship

PRV reserved power of the power plant [kW].
Where more than one source of electricity is installed in one power plant, the total estimated generation of electricity in the calendar year of that power plant shall be determined as the sum of the estimated generation of electricity in the calendar year of each source of electricity. The expected generation of electricity in a calendar year for each individual type of electricity source of that electricity plant shall be determined as the product of its installed power and its use of the maximum installed power.
Period of use of the maximum installed power (TPi) of power generation according to the table in part This Annex shall apply mutatis mutandis to the determination of the annual use of the maximum for electricity generation sources. ';

This Decree shall take effect on 1 July 2024.
