on the declaration of general binding legislation and other measures of the institutions of the Czech Socialist Republic in the Collection of Laws
The Czech National Council decided on this law:
§ 1
The generally binding legislation of the institutions of the Czech Socialist Republic is published in the Collection of Laws. 1) Announcement of generally binding regulations of national committees is governed by a separate legislation.2)
§ 2
The Collection of Laws is announced by publication of the full text
(a) the constitutional and other laws of the Czech National Council and the legal measures of the Bureau of the Czech National Council,
(b) the Decree of the Government of the Czech Socialist Republic,
(c) generally binding legislation of ministries and other central government bodies of the Czech Socialist Republic with the exceptions set out in Section 3; these generally binding legislation is referred to as the Order.
§ 3
(1) General binding legislation of ministries and other central authorities of the Czech Socialist Republic may be published in the Collection of Laws by the publication of a notice of extradition, if applicable
(a) concerning a small number of organisations;
(b) details of the rights and obligations of a narrow group of persons in employment and social security relations or details of the rights and obligations arising from the employment arrangements of members of the armed corps.
(2) The general binding legislation which is published in the Collection of Laws by the publication of a notice of extradition is marked as a yield. This form of announcement cannot be used if the decree is to be supplemented, amended or repealed by a general law of the Ministry or other central authority of the Czech Socialist Republic.
(3) The notice of issue of the yield must include:
(a) the name and date of issue of the yield;
(b) the authorizing provision of the law on the basis of which the yield is issued;
(c) a brief statement of the content of the yield, including information on the number of addressees to whom it is primarily addressed;
(d) an indication of which generally binding legislation is supplemented, amended or repealed by yield;
(e) the beginning of the effectiveness of the yield;
(f) an indication of when and how the full text of the yield has been published and for which authorities or organisations, as appropriate, must be accessible to each.
§ 4
The declaration of generally binding legislation referred to in Sections 2 and 3 in the Collection of Laws is a condition for their validity.
§ 5
(1) The ministries and other central authorities of the Czech Socialist Republic are required to ensure that the decree issued by them is accessible to everyone from the date of its publication in the Collection of Laws, both for them and for the authorities and organisations mentioned in the notice of issue of the Decree.
(2) The ministries and other central authorities of the Czech Socialist Republic are obliged to send the decree which they issued after the effectiveness of this law to the territory of the Czechoslovak Socialist Republic in return for payment to anyone who so requests.
§ 6
(1) The general binding legislation referred to in Sections 2 and 3 shall take effect on the date of their publication in the Collection of Laws.
(2) If a later effective date is not provided for in a generally binding legislation referred to in § 2 or 3, it shall take effect on the 15th day following its publication. Where an urgent general interest so requires, an earlier start of effectiveness may exceptionally be established, but first on the date of publication.
§ 7
(1) They are published in the Collection of Laws by publication of the full text or by publication of a notice of their publication
(a) measures of the Czech National Council, the Bureau of the Czech National Council or the Government of the Czech Socialist Republic, if the law so provides or if the authorities so decide,
(b) measures taken by ministries and other central authorities of the Czech Socialist Republic, if the law so provides.
(2) The title of the Order or Decree may not be used for the measures referred to in paragraph 1 and for internal directives.
§ 8
General binding legislation and other measures of the institutions of the Czech Socialist Republic are published in the Collection of Laws in the Czech language.
§ 9
Local national committees and district national committees shall ensure that the Collection of Laws is accessible to everyone.
§ 10
(1) The price arrangements of the central authorities of the Czech Socialist Republic and the national committees are binding on all the bodies listed therein; They are not declared in the Collection of Laws.
(2) The measures of the Ministry of Finance, Prices and Wages of the Czech Socialist Republic, which, by virtue of the powers conferred by the Act, grant relief or exemption from domestic tax and from notarial, judicial and administrative charges, are hereby declared a notice of extradition pursuant to Article 7.
§ 11
(1) General binding legislation and other measures, the issue of which was notified in the Collection of Laws by 31 December 1968, if they regulate matters falling within the competence of the Czech Socialist Republic, will cease to apply.
(2) Paragraph 1 shall not apply to generally binding legislation and other measures listed in the Annex to this Law.
§ 12
The Act of the Czech National Council No. 3 / 1969 Coll., on the Announcement of Laws of the Czech National Council and other generally binding legislation of the Czech Socialist Republic, is hereby repealed.
§ 13
This Act shall take effect on 1 January 1990.
