DECLARATION
State Commission on Scientific Aspects
of 15 August 1964
establishing the rules of organisation and procedure of the State Commission for Scientific Aspects
According to Section 13 (3) of Act No. 53 / 1964 Coll., on the award of scientific degrees and on the State Commission on Scientific Aspects, the following Regulations of the State Commission on Scientific Aspects, approved by the Government Resolution of 24 June 1964 No 348:
State Commission on Scientific Aspects
(1) The State Commission for Scientific Positions ("the State Commission") shall be composed of the President, Vice-Presidents, Scientific Secretary and other members. The Vice-President and the Scientific Secretary shall be appointed by the President from among the members of the State Commission.
(2) The members of the State Commission are appointed from highly qualified researchers, members of the Czechoslovak Academy of Sciences, the Slovak Academy of Sciences (hereinafter referred to as the Academy of Sciences), teachers of higher education and staff from other scientific research institutes.
(3) The members of the State Commission are actively monitoring the level of candidate examinations, the course, the level and the method of award of scientific degrees and ensure consistency of the assessment of the scientific level of candidates for scientific degrees. The workplaces involved in the procedure for the award of scientific degrees shall be required to enable each member of the State Commission, who shall be proved by the appropriate documentary evidence, to provide all the necessary information and supporting documents, to participate in meetings of the defence committees, test committees, examinations, etc. The knowledge obtained shall be used by members when negotiating in the bodies of the State Commission and shall propose the necessary measures to those authorities. They participate in meetings of the plenary of the State Commission as well as in other deliberations and works to which they are invited by the President of the State Commission, by plenary (§ 5) or by presidium (§ 6). They shall be required to remain silent on matters which they have become aware of in the performance of their duties, to the same extent as workers of public authorities.
Synergies of the State Commission with the Czechoslovak Academy of Sciences, the Ministry of Education and Culture and the State Commission for the Development and Coordination of Science and Technology
Collective bodies and officials In carrying out their tasks, the State Commission shall cooperate with the Czechoslovak Academy of Sciences, the Ministry of Education and Culture and the State Commission for the Development and Coordination of Science and Technology; reports submitted by the President of the State Commission to the Government shall also be discussed with those authorities.
Functionaries
(1) The President shall represent the State Commission externally and shall be responsible for its activities. He manages and presidium the work of the State Commission. It shall deal with the Heads of Central Authorities on matters falling within the competence of the State Commission.
(2) The Vice-Presidents shall participate in the proceedings of the State Commission, as instructed by the President.
(3) The Scientific Secretary prepares, as instructed by the President, material for plenary and presidium meetings, organises a check of compliance with the regulations of the State Commission and proposes the plenary and presidium the necessary measures. He shall manage and be responsible for the work of the Secretariat.
Collective authorities
(1) The collective bodies in which the State Commission acts and decides are its plenary and presidium.
(2) Plenum is composed of the President, Vice-Presidents, Scientific Secretary and all other members.
(3) The Presidium shall be composed of the President, Vice-Presidents, Scientific Secretary and other members appointed by the Chair of the most important groups of sciences.
(4) Plenum and presidium are eligible for a quorum if at least two-thirds of their members are present. The resolution shall take place by an absolute majority of the members present. In the event of a tie, the chairman shall vote. The vote is public.
(5) The plenary and presidium meetings are not public. However, representatives of central bodies, social organisations, academies of science, universities and experts may be invited; the invited shall not have the right to vote.
Plenum
(1) Plenum acts and decides on fundamental and general matters falling within the competence of the State Commission, as well as on the rules issued by the State Commission.
(2) Plenum also acts and decides on those matters falling within the scope of the presidium which it has reserved itself or which the President or the Presidium has reserved for plenary.
(3) In particular:
(a) establish groups of sciences, sciences and disciplines in which defence may be held and award the scientific rank of candidate and doctor of science;
(b) establish the principles under which the Defence Commission is formed and designate the authorities competent to establish such commissions for each group of sciences, sciences and disciplines;
(c) determine the bodies of academia and universities which are entitled to decide on the award of scientific degrees of candidate and doctor of science in each group of sciences, science or disciplines;
(d) evaluate the inspection activities of its members.
(4) The crop shall meet at least three times a year.
Presidium
(1) Presidium in particular
(a) preparing materials for plenary meetings;
(b) coordinate and ensure contact between the State Commission and the Academia of Sciences, the State Committee for Higher Education, the State Commission for the Development and Coordination of Science and Technology and the Central Authorities;
(c) manage the inspection activities of the members of the State Commission (Section 1 (3)) and check compliance with the rules issued by the State Commission;
(d) prepare the work plan of the State Commission and continuously monitor and evaluate its implementation;
(e) allow exemptions from the conditions for the award of scientific degrees in individual cases;
(f) confer the right to set up a dissertation defence committee on candidates or doctoral or, where appropriate, the right to decide whether to award rank to an authority which otherwise does not have that right;
(g) giving consent to the award of the honorary scientific rank of Doctor of Sciences;
(h) approve the notation of scientific degrees obtained abroad;
(i) decide on complaints against the procedure of the pre-candidate, defence or award bodies;
(j) decide on appeals against decisions granting or withdrawing scientific rank;
(k) may, where justified, examine decisions granting a scientific grade on its own initiative;
(l) report regularly on its activities to the plenary.
(2) The Presidium also deals with and decides on the matters which it has been ordered to do.
(3) At a time when the plenary does not sit, the Presidium may act and decide on matters falling within the competence of the plenary if the President commands such a case to the presidium. Every decision on such a case shall be reported to the nearest plenary. However, Presidium cannot decide on the general rules issued by the State Commission.
(4) The presidium usually sits once a month.
Negotiations on appeals and objections
(1) At the hearing of the State Commission on appeals or objections, or at the hearing of the initiative of the State Commission on the annulment of the decision of the body implementing the provisions on the award of scientific degrees, the Presidium, the Chairman or the Scientific Secretary may entrust a member of the State Commission to prepare a report on the case on a reasoned proposal. Where a case is pending by the Presidium, a member of the State Commission responsible for preparing the report shall be invited to his meeting.
(2) Before the decision is taken, the State Commission (orally or in writing) shall hear the authority which decided and, in the case of objections to the award of a dissertant's grade. It may also require an opinion from the Ministry of Education and Culture, in particular if it is for university or the presidium of the Czechoslovak Academy of Sciences, in particular if it is for a scientific research institute, or if it carries out other investigations.
(3) The appeal or objections shall, as a general rule, be decided by the State Commission within four months of the date of notification of the State Commission; If the State Commission for the Specific Complicity of the case or for other important reasons is unable to decide within that period, it shall inform the participants thereof, stating the reasons, and shall at the same time notify the time within which it decides.
Working groups
Collective authorities State Commission or Presidium members may, if necessary, set up permanent or temporary working groups from members of the State Commission or from other experts as advisory bodies of the State Commission. The Head of the Working Group shall be a member of the State Commission, which shall direct its work and deliberations and report on the results of the meetings to the Presidium or plenary; If a unanimous opinion has not been reached in the working group, the manager shall also inform the members of the working group of the divergences.
Secretariat
(1) The Secretariat of the State Commission is set up by the Ministry of Education and Culture. ensure the activities of the State Commission.
(2) The Secretariat participates in the preparation of materials for the meetings of the various bodies of the State Commission, records both the scientific degrees awarded and notarized, the composition of the defence committees and the statement of defence. It shall issue forms binding on the places to which it relates for such registration. If the audit finds deficiencies in the records, it shall take measures to ensure that the rules are not infringed and submit the case to the presidium. The Secretariat shall notify the site which has granted the scientific rank and, where appropriate, the candidate of appeals against the award of the scientific rank. It shall carry out any further agenda of the State Commission as instructed by the Scientific Secretary.
(3) The costs associated with the activities of the State Commission are covered by the plan and budget of the Ministry of Education and Culture.
Publication of communications and decisions of the State Commission
The communications and decisions of the State Commission to be published shall be published in the Bulletin of the Ministry of Education and Culture.
Reimbursement of expenditure
Reimbursement of travel and other expenses incurred by members of the State Commission and members of working groups in the performance of their duties shall be granted in accordance with the rules in force in this respect for staff of the State authorities.
Final provisions
Decree No. 11 / 1960 Coll., establishing the Organisational and Rules of Procedure of the State Commission on Scientific Positions, is hereby repealed.
These Regulations shall enter into force on the day of their publication.
