DECLARATION
of 12 June 2024
amending Decree No 344 / 2012 Coll., on the state of emergency in the gas industry and on how to ensure the safety standard of gas supply, as amended
The Ministry of Industry and Trade provides pursuant to § 98a paragraph 1 (e) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll. and Act No. 176 / 2022 Coll.:
Decree No 344 / 2012 Coll., on the state of emergency in the gas industry and on the way to ensure the safety standard of gas supply, as amended by Decree No 215 / 2015 Coll., Decree No 224 / 2022 Coll. and Decree No 37 / 2023 Coll., is amended as follows:
1. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) This decree does not apply to distribution systems that are not connected to the gas system of the Czech Republic and to gas plants that are connected to these distribution systems."
2. in Paragraph 2 (1), point (b) shall be deleted;
Points (c) to (i) shall be renumbered (b) to (h).
3. In Article 2 (1) (b), the text "B2 'is replaced by the text" B1' and the words "up to 52 500 MWh 'are deleted.
4. In Article 2 (1) (c), the text "B3 'is replaced by" B2' and the text "B1 'is inserted after the words" Group A'.
5. In Article 2 (1) (f), the words "specified in Annex 11 to this Decree 'shall be inserted after the word" feed'.
6. in Paragraph 2 (1) (h), the words "social services facilities" shall be replaced by the words "and social services facilities with an expected annual take-up of over 630 MWh in that year."
7. In Article 2, the following paragraph 4 is inserted after paragraph 3, including footnote 14:
"(4) In a state of threat to the state or to the state of war, the relevant operator shall, at the request of the Ministry of Defence, include in Group F the collection sites of customers with predominant technological withdrawals who are economic mobilization entities and are listed in the crisis plan of the economic mobilization system at a time of crisis conditions (14).

Paragraphs 4 to 8 shall be renumbered paragraphs 5 to 9.
8. in Articles 2 (8), 5 (1) (d), 7b (1) and 8 (1), the text "B3," shall be deleted;
9. Paragraph 2 (9) is deleted.
10. In Paragraph 3 (2), at the end of the introductory part of the provision, the words "the procedures referred to in paragraph 1 and beyond shall apply 'shall be added.
11. in Articles 4 (7) and 8 (4), the text "(i)" is replaced by "(h)."
12. in Article 5 (1) (b) (2), the words "which do not fall within the household category" shall be inserted after the words "customer sampling points."
13. in Article 5 (1) (b) (3) to (6), the word "all" shall be inserted after the word "sampling points."
14. in Articles 5 (1) (b) (4) to (6), 5 (1) (c) (1), 5 (2) and 7 (1), (4) and (8), the words "B2 and B3" are replaced by "and B2."
15. in Article 5 (1) (c) (2), "B2" is deleted;
16. in Articles 5 (1) (c) (2) to (4) and 7a (4), "B3" is replaced by "B2."
17. in Article 5 (1) (c) (3), 'B2' is replaced by 'a';
18. in Article 5 (1) (c) (4), the text "B2," shall be deleted;
19. in Article 5 (1), the following point 5 shall be added at the end of point (c):
"5. sample level 11, which means the interruption of the transport, distribution and supply of gas to the customers of the C1, B2 and D groups, as well as to customers of categories A, B1, C2 and E and F outside the health and social services facilities, with an expected annual consumption in the given year above 630 MWh and a household which further reduces the consumption of gas collected for heating, so as to achieve the average indoor air temperature in the heating season in the heating rooms or areas set out in Annex 10 to this Regulation, '.
20. In Paragraph 7, at the end of paragraph 3, the words "except for the period 20 December to 5 January 'shall be added.
21. in Article 7a (1), "B1 and B2" is replaced by "B1";
22. in § 8 (2) of the introductory part of the provision and in § 8 (3), the words "with the expected annual collection in the year above 630 MWh" shall be inserted after the words "social services."
23. in Paragraph 8 (2) (a), the words "customers proposed for classification in Group D" are replaced by the words "the above-mentioned customers."
24. in Article 8 (2) (b), the words "customers to Group D" are replaced by the words "the above-mentioned customers."
25. In Article 8 (5), the word "all" shall be inserted after the words "classification" and the sentence "In cases referred to in Article 2 (4), the relevant operator shall transmit the information on the inclusion of customers in Group F to the market operator electronically without undue delay."
26. In Paragraph 8a (1), the words "at 6: 00 'are replaced by the words" before 6: 00' and at the end of the paragraph the sentence "The market operator shall inform the Ministry and the transmission system operator of the aggregated quantity of gas supply requirements referred to in the first sentence by 6: 30. ';
27. in Article 8a (1) and (2), "10" is replaced by "11."
28. in Article 8a (1), (2) and (5) and in Article 8b (3), "gas day" is replaced by "gas days."
29. In Paragraph 8a (2), the following sentence is inserted after the first sentence: "If the transmission system operator finds that the aggregate requirement for the supply of gas referred to in paragraph 1 does not reach the size of the expected gas consumption of protected customers for the following gas day, it shall call for the provision of missing gas. '
30. in Paragraph 8a (4):
"(4) The market operator shall provide the Ministry and the transmission system operator with information on the amount of gas required to receive international assistance in gas crisis situations. ';
31. in Article 8a (6), the word "next" shall be replaced by the word "competent."
32. in Article 8b (6) (a) and (b), "9" is replaced by "10."
33. In Paragraph 8b (6) (b), the words "the Ministry shall send these tenders to the requesting Member State of the European Union on the relevant gas day and inform the market operator and transmission system operator about this step."
34. in Paragraph 8b (8), the words "by sending confirmation of receipt of the offer to the Ministry and by accepting one of the offers" shall be inserted after the words "by accepting one of the tenders";
35. in Article 11 (1), the words "and conditions of use" shall be inserted after the word "Scope" and the words "fixed" shall be replaced by "fixed."
36. In Article 11, the following paragraph 12 is added:
"(12) The change in the determination of the single largest gas infrastructure referred to in paragraph 8 shall be effective from 1 October following the publication of the transmission system operator in the 10-year transmission system development plan. ';
37. The heading of Annex 3 reads as follows: "Determination of the gas supply safety standard and its conditions of use."
38. In Annex 3 (1) (a), the following sentence is inserted after the third sentence: "The gas dealer shall be able to take measures concerning the safety standard to ensure the supply of gas to his protected customers on the current gas day, provided that the actual temperature for the previous day is reached for the whole of the Czech Republic equal to or below the selected day, and the weather forecast of the Czech Hydrometeorological Institute for the current day and the following 2 days indicates the same or lower values. The total duration of all measures shall not exceed 7 days in the period 1 October to 31 March and the total daily gas volume shall be limited to 1 / 30 of the range of the gas supply safety standard set out in the following procedure. '
39. in Annex 3 (1) (a), in the table "0,7" is replaced by "0,6," "0,9" is replaced by "0,8" and "1,0" is replaced by "0,9."
40. In Annex 3 (1) (b), at the end of the text of the first sentence, the words "and of these days, the day with the lowest temperature shall be selected 'and the sentences of the second and third sentences shall be replaced by the words" The market operator shall fix 30 days above, specifying the year for which the trader determines the scope of his safety standard as period I. It shall also specify the period J, which shall be the same period of the preceding calendar year. The gas dealer has the possibility to take action on the security standard of supply to ensure the supply of gas to his protected customers on the current gas day if the actual temperature for the previous day is reached for the whole Czech Republic equal to or lower than the selected day and the weather forecast of the Czech hydrometeorological institute for the current day and the following 2 days indicates the same or lower values. The total duration of all measures relating to the application of the safety standard of supply shall not exceed 30 days in the period from 1 October to 31 March and the total daily gas volume shall be limited to 1 / 30 of the range of the safety standard of supply of gas set out below.';
41. In Annex 3 (1) (c), the following sentence is inserted after the third sentence: "The gas dealer shall be able to take action on the day of the disruption of the largest gas infrastructure on the security standard for ensuring the supply of gas to his protected customers on the current gas day, provided that, on the basis of the data published by the transmission system operator, it is clear that the single largest gas infrastructure is being disrupted. The total duration of all measures relating to the application of the safety standard of supply shall not exceed 30 days in the period from 1 October to 31 March and the total daily gas volume shall be limited to 1 / 30 of the range of the safety standard of supply of gas set out below. ';
42. In Annex 3 (2), the words "and the temperature achieved on the day of the lowest temperature during the seven coldest consecutive days in the Czech Republic in the last 20 years and the temperature achieved on the day of the lowest temperature during the 30 coldest consecutive days in the last 20 years' shall be inserted after the words" periods I, J, T and U '.
43. At the end of Annex 3, the following paragraphs 7 and 8 are added:
"(7) In the case of use only part of the safety standard of supply, the gas dealer shall provide only a proportion to the overall safety standard of gas supply by 31 March, but of which at least 30% by storage of gas in gas storage.
(8) The market operator and the transmission system operator shall publish the abovementioned dates and dates for which the gas dealer has the possibility to take up up up-to-date measures regarding the security standard of supply in a way that allows remote access. "
44. In Annex 4, at the end of point (a), the dot is added and the sentence "The temperature reached on the lowest temperature during the seven coldest consecutive days in the Czech Republic in the last 20 years is TT, T ° C."
45. In Annex 4, at the end of point (b), the sentence "The temperature achieved on the lowest day during the 30 coldest consecutive days in the last 20 years shall be TT, T ° C. ';
46. the following Annex 11 is added:

Group D belongs to gas customers whose main economic activity, or secondary economic activity, according to the "Classification of Economic Activities" (CZ- NACE) conducted by the Czech Statistical Office is the production of one of the following types:

The operator shall identify the main economic activity from the customer. ';
Transitional provisions
1. The inclusion of customer demand points in groups, the determination of the value of the permitted daily consumption, the determination of the safety technological minima and the inclusion of customer demand points in the sample stages shall be carried out for the period from 1 October 2024 to 30 September 2025 in accordance with Decree No 344 / 2012 Coll., on the emergency state in gas and on the method of ensuring the safety standard of gas supply, as effective before the date of entry into force of this decree.
2. The stages of the sampling provided for in Section 5 of Decree No 344 / 2012 Coll., on the state of emergency in the gas industry and on the way to ensure the safety standard of gas supply, as effective before the date of entry into force of the Decree, shall remain in force until 30 September 2025.
Efficacy
This Decree shall enter into force on 1 July 2024, with the exception of the provisions of Article 5 (1) (a) and (b) of Regulation (EU) No 1308 / 2013. I points 22 to 25, which take effect on 1 January 2025.
