DECLARATION
of 23 May 2016
amending Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and implementation of certain other provisions of the Air Protection Act, as amended
The Ministry of the Environment provides pursuant to § 4 (9) of Act No. 201 / 2012 Coll., on Air Protection:
Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and on the implementation of certain other provisions of the Air Protection Act, as amended by Decree No. 155 / 2014 Coll. and Decree No. 406 / 2015 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Directive 2010 / 75 / EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control). Council Directive 1999 / 32 / EC of 26 April 1999 on the reduction of the sulphur content of certain liquid fuels and amending Directive 93 / 12 / EEC, as amended by Directive 2005 / 33 / EC of the European Parliament and of the Council of 6 July 2005 amending Directive 1999 / 32 / EC as regards the sulphur content of marine fuels. Directive 94 / 63 / EC of the European Parliament and of the Council of 20 December 1994 on the limitation of emissions of volatile organic compounds (VOC) arising from the storage of petrol and its distribution from terminals to service stations. Council Directive 1999 / 13 / EC of 11 March 1999 on the limitation of emissions of volatile organic substances from the use of organic solvents in certain activities and installations. Directive 2004 / 42 / EC of the European Parliament and of the Council of 21 April 2004 on the limitation of emissions of volatile organic compounds arising from the use of organic solvents in certain paints and varnishes and vehicle paint repair products and amending Directive 1999 / 13 / EC. Directive 2000 / 76 / EC of the European Parliament and of the Council of 4 December 2000 on waste incineration. Directive 2001 / 80 / EC of the European Parliament and of the Council of 23 October 2001 on the limitation of emissions of certain pollutants into the air from large combustion plants. Council Directive 87 / 217 / EEC of 19 March 1987 on the prevention and control of environmental pollution by asbestos. Council Directive 92 / 112 / EEC of 15 December 1992 on procedures for harmonising programmes for the reduction and final elimination of pollution caused by waste from the titanium dioxide industry. Commission Directive 2014 / 99 / EU of 21 October 2014 amending, for the purposes of its adaptation to technical progress, Directive 2009 / 126 / EC on stage II petrol vapour recovery when pumping fuel into motor vehicles at service stations. Directive 2009 / 126 / EC of the European Parliament and of the Council of 21 October 2009 on the stage II recovery of petrol vapour during the pumping of fuel into motor vehicles at service stations. '.
2. In Annex 6, point 6.1, after the first sentence, the sentence "A sign shall be placed on or near all stands serving the discharge of petrol, which informs that a stage II petrol vapour recovery system is installed at the service station. '
3. In the second sentence of point 6.1 of Annex 6, the words "as confirmed by the manufacturer in accordance with the relevant European technical standards or approval procedures, or in the absence of any such standards or procedures, in accordance with any relevant national standard 'are deleted and the sentence" Minimum petrol vapour capture efficiency shall be confirmed by the manufacturer by a method which is conclusive and as precise as possible indicates the effectiveness of the recovery carried out. These requirements shall be deemed to be met if they are followed by a specified technical standard in accordance with the Technical Requirements for Products Act (2).';
4. Point 6.2 of Annex 6 reads as follows:
"6.2. Control of Stage II petrol vapour recovery system
The check of the Stage II petrol vapour recovery system shall be carried out by the person authorised to install and repair the equipment by the manufacturer. The check shall be carried out at least once per calendar year and at each suspected malfunction of the installation. The check of the Stage II petrol vapour recovery system shall be carried out by a test method which is conclusive and indicates the functionality of the recovery system as accurately as possible. These requirements shall be deemed to be met if they are followed by a specified technical standard in accordance with the Technical Requirements for Products Act (2). ';
5. Point 4.2 of Part II of Annex 8 reads as follows:

Explanatory notes:
1) Applies with a mass flow of less than 2,5 kg / h.
2) Applies to mass flow rates higher and equal to 2,5 kg / h.
3) Valid when burning natural gas.
4) Applies to other fuels.
5) Applies to regenerative continuous melting aggregates.
6) Applies to discontinuous melting aggregates.
7) Applies to regenerative continuous melting aggregates.
(8) In the case of nitrite coating, the appropriate mass concentration of nitrogen oxides shall not exceed twice the above values.
9) Applies with a mass flow equal to or greater than 5 kg / h.
10) Applies to lead, antimony, manganese, vanadium, tin, copper (by mass flow of all these substances equal to or greater than 0,05kg / h).
11) Applies to cobalt, nickel, chromium, arsenic, cadmium, selenium (by mass flow of all these substances equal to or greater than 0,01 kg / h) except for the production of coloured selenium glass in the flat glass sector.
12) Applies to HF (with a mass flow equal to or greater than 0,05 kg / h).
13) Applies to HCI (with a mass flow equal to or greater than 0,05 kg / h).
14) Applies to continuous melting aggregates.
15) The conversion to O2R shall not be carried out for discontinuous aggregates at a time when they do not have a combustion process and shall not always be carried out for oxygen melting and for electric heating furnaces. In addition, conversion to O2R shall not be carried out for those pollutants whose concentration is reduced by an installed separator for which flue gas mixing is used for cooling.
16) In waste gases from suction, transport, betting and other equipment that emit TZL.
17) In waste gases from the establishment, curing and drying of fibres with organic binders.
18) Applies to VOC.
19) Applies to smelting from semi-finished or shard in which the heat source is the combustion of fuels. The emission limit for solid pollutants shall apply only if a fuel other than natural gas is fired.
20) Applies to resources which have the dates of general corrections specified in decisions under other legislation3), applies to general corrections.
21) Applies to selenium in the manufacture of coloured selenium glass in the flat glass sector.
22) Applies to furnaces for melting frit. '.
Efficacy
This decree shall take effect on the day of its publication.
