THE LAW
of 7 June 2007
amending Act No. 130 / 2002 Coll., on Public Aid for Research and Development and amending certain related laws (Act on Support for Research and Development), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 130 / 2002 Coll., on the promotion of research and development from public funds and on the amendment of certain related laws (Act on the promotion of research and development), as amended by Act No. 41 / 2004 Coll., Act No. 215 / 2004 Coll., Act No. 342 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 227 / 2006 Coll. and Act No. 81 / 2006 Coll., is amended as follows:
1. Paragraph 4 (5), including footnote 3, reads:
"(5) Institutional support is provided for the part of the Czech Republic's international cooperation in research and development under which, under international agreements, the Ministry or the relevant provider of m3 is covered)
(a) fees for participation of the Czech Republic in international research and development programmes;
(b) fees for membership of international research and development organisations; or
(c) financial holdings from the Czech Republic in support of international cooperation projects in research and development, where this financial share can be paid out from public funds, in the form of grants to legal or natural persons or by increasing the expenditure of organisational bodies to deal with the project.
3) For example, Act No. 2 / 1969 Coll., on the Establishment of Ministries and other Central Authorities of the Government of the Czech Republic, as amended, Act No. 129 / 2000 Coll., on Counties (Regional Establishment), as amended, Act No. 128 / 2000 Coll., on Municipality (Municipal Establishment), as amended. '
2. In Article 4 (7), the words "including the way in which fees for participation of the Czech Republic in international research and development programmes and fees for membership of international organisations' are deleted.
3. In Paragraph 7, the following paragraph 5 is inserted after paragraph 4:
"(5) The institutional support for international cooperation referred to in Article 4 (5) (c) is granted on the basis of an application submitted by the applicant's provider, selected in accordance with the rules of the relevant international research and development cooperation programme. Paragraph 27 (1) shall apply mutatis mutandis to the publication of the particulars of the application. '
Paragraph 5 shall become paragraph 6.
4. In Article 39, "§ 7 (4) and (5) 'is replaced by" § 7 (4) and (6)';
Transitional provision
Act No. 130 / 2002 Coll., on the promotion of research and development from public funds and on the amendment of certain related laws (Act on the promotion of research and development), as amended, as amended, will apply for the first time to institutional support initiated and ongoing from 1 January 2007.
Efficacy
This Act shall take effect on the day of its publication.
