THE LAW
of 18 April 2002
amending Act No. 247 / 1995 Coll., on Elections to Parliament of the Czech Republic and amending and supplementing certain other laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 247 / 1995 Coll., on elections to Parliament of the Czech Republic and amending and supplementing certain other laws, as amended by Act No. 212 / 1996 Coll., the Constitutional Court found published under No. 243 / 1999 Coll., Act No. 204 / 2000 Coll., the Constitutional Court found under No. 64 / 2001 Coll. and Act No. 37 / 2002 Coll., is amended as follows:
1. In Article 1 (4), the words "on the territory of the Czech Republic 'are inserted after the words" the Czech Republic' and the last sentence is deleted.
2. In Article 1, the following paragraphs 5 and 6 are inserted after paragraph 4:
"(5) Elections to the Chamber of Deputies of the Parliament of the Czech Republic are held abroad in 2 days,
(a) Thursday and Friday, when the vote starts at 14.00 hours and ends at 21.00 hours local time, if the vote is on the spot (§ 3 (2)), in which the time of the hour is correctly marked later by more than 4 hours compared to the hour time in the Czech Republic,
(b) Friday, when the vote starts at 12.00 and ends at 22.00 local time, and Saturday, when the vote starts at 8.00 and ends at 12.00 local time, if the vote is on the spot (§ 3 (2)), in which the time of the clock is correctly marked later by a maximum of 2 hours compared to the hourly time in the Czech Republic,
(c) Friday, when the vote starts at 14.00 hours and ends at 22.00 hours of local time, and Saturday, when the vote starts at 8.00 hours and ends at 14.00 hours of local time when the vote is taken at other places (§ 3 (2)).
(6) The date of the elections is the first day of the elections in the Czech Republic, unless the law provides otherwise. The time limits and the definition of electoral days under this law shall not be affected by the voting time abroad. ';
Paragraph 5 shall become paragraph 7.
3. Paragraph 16 (6) reads as follows:
"(6) In the building in which the election room is located and in its immediate vicinity, electoral agitation for political parties, political movements, coalition and candidates are prohibited on the days in which the vote takes place."
4. In Paragraph 22, the present text becomes paragraph 1 and the following paragraph 2 is added:
"(2) As soon as the President of the Special District Electoral Commission in the Special Electoral District where the vote is held pursuant to Paragraph 1 (5), the Special District Electoral Commission shall declare the vote closed, in accordance with the first sentence of Paragraph 21 (1) and shall suspend its session until the vote is counted (Paragraph 40). '
5. In the first sentence of Paragraph 38 (5), "24 'is replaced by" 48'.
6. In Paragraph 40, the following paragraph 1 is added:
"(1) The Special District Electoral Commission will start counting the votes as soon as the deadline set for the end of the vote in the Czech Republic has expired. '
Paragraphs 1 to 4 shall be renumbered paragraphs 2 to 5.
7. In Paragraph 40 (2), the words "the end of the vote 'are replaced by the words" the expiry of the period laid down for the end of the vote in the Czech Republic'.
8. In Paragraph 43 (6), the words "the termination of the vote (Paragraph 22) 'are replaced by the words" the opening of the census pursuant to Paragraph 40'.
9. Paragraph 97a (5) is deleted.
10. In Annex 3, "List of constituencies for elections to the Senate, indicating their seat ', the constituencies No 25 and 27 read:
"Election Circuit No. 25 Seat: Prague 6
Includes the territory of the city district of Prague 6, with the exception of the town district of Střešovice, the part of the town of Prague. It also includes the territory of Prague 17, Prague-Front Kopanina, Prague Nebušice, Prague-Suchdol, Prague-Lysolaje
Election Circuit No 27 Location: Prague 1
It includes the territory of the city district of Prague 1, the territory of the city district of Prague 7, the part of the town. It also includes part of the territory of the city of Prague 6, consisting of the k. Ústřešovice, part of the k. ú. Hradčany and part of the k.
1. For the publication of the day of the elections abroad pursuant to § 1 paragraph 5 (a) of Act No. 247 / 1995 Coll., on the elections to the Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by this Act, do not apply in respect of elections to the Chamber of Deputies of the Parliament of the Czech Republic held in 2002, the deadline laid down in § 1 paragraph 3 of Act No. 247 / 1995 Coll., on the elections to the Parliament of the Czech Republic and on the amendment and additions of certain other laws, as amended by Act No. 204 / 2000 Coll. The addition of the day of the elections to the Chamber of Deputies of the Parliament of the Czech Republic in 2002 resulting from this Act shall be announced by the President of the Republic no later than 10 days after the date of entry into force of this Act.
2. The time limits laid down in Act No. 247 / 1995 Coll., on the elections to the Parliament of the Czech Republic and amending and supplementing certain other laws, as amended by Act No. 212 / 1996 Coll., the Constitutional Court's finding published under Act No. 243 / 1999 Coll., Act No. 204 / 2000 Coll., the Constitutional Court's finding published under No. 64 / 2001 Coll. and Act No. 37 / 2002 Coll., the running of which began before the date of entry into force of the Act, and the acts relating thereto remain unaffected.
Efficacy
This Act shall take effect on the day of its publication.
