THE LAW
of 3 May 1990
amending and supplementing Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (Education Act)
The Federal Assembly of the Czech and Slovak Federal Republic decided on this law:
The introductory part (preamble) is deleted in its entirety.
Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (School Act) is amended as follows:
1.
(1) Primary schools, schools and secondary schools are part of the Czechoslovak education system; they shall act on their behalf in legal relations and shall be responsible for such relations, unless otherwise specified.
(2) In matters of education and education, they are directly managed by the Ministry of Education, Youth and Sports of the Czech Republic in the Czech Republic and by the Ministry of Education, Youth and Physical Education of the Slovak Republic in the Slovak Republic (hereinafter referred to as the "Ministry of Education ')."

(1) The system of primary and secondary schools consists of primary school, primary school of art, teaching centre, secondary vocational school, high school, secondary vocational school and special schools.
(2) The Ministry of Education shall determine by decree the types and names of the different types of schools referred to in paragraph 1. "
3. In Paragraph 3, the current text becomes paragraph 1 and paragraph 2 is added as follows:
"(2) The deaf and blind are entitled to education in their language using sign language or Braille."
4. In Paragraph 4, the following sentence is added to paragraph 1: "In private schools and in church schools, the right to education may be provided for remuneration."

(1) The primary school provides basic education; ensure rational education in the sense of scientific knowledge and in accordance with the principles of patriotism, humanity and democracy and provide moral, aesthetic, occupational, health, physical and environmental education of pupils; it also allows religious education.
(2) The primary school prepares pupils for further study and practice. "
6.
(1) The primary school has nine years. Since the fifth year it is generally differentiated according to the interests and abilities of pupils.
(2) A primary school may be set up where there are no conditions for the establishment of all nine years of primary school, which does not have all years. Pupils who finish their senior year of such a school shall continue to complete compulsory schooling in primary school with all grades. '
7. the following Part A is inserted after Part Two:
Basic Art School
(1) The basic art school provides basic education in individual fields of art and prepares for the study of teaching and study fields in secondary schools of artistic focus and in the conservatory, also prepares for the professional study of universities with artistic focus.
(2) Musical, dance, art and literature departments may be established in primary art schools or some of them.
(3) The primary arts school organises studies intended primarily for primary school pupils; may also organise adult studies.
(4) The Ministry of Education sets out by decree details of the organisation of studies in primary arts schools. "
8. in Article 7 (1):
"(1) Secondary schools provide pupils with secondary vocational education, full secondary education, full secondary vocational education and higher vocational education and prepare them for the pursuit of their profession and activities in the national economy, administration, culture, art and other areas of life; prepare pupils for higher education. ';
paragraph 2 shall read as follows:
"(2) High schools apply the unity of education and education, the connection of the school to life, and strive for a versatile harmonious development of a young person's personality; raise it in the sense of scientific knowledge and in accordance with the principles of patriotism, humanity and democracy, shape its intellectual and moral development, prepare it for creative work and professional activity in the profession and provide it with aesthetic, health, physical and environmental education; allow also religious education. ';
9.
(1) Medium vocational education includes general education and training; end with successful completion of the final examination in the fields of study or teaching.
(2) Full secondary education and full secondary vocational education include wider and deeper general education and training differentiated by type of secondary school; full secondary education is completed by successful completion of the high school graduation, full secondary vocational education is completed by successful completion of the high school or secondary vocational training.
(3) Higher vocational education includes general education, special training and artistic and educational training; higher vocational education shall be completed by successful discharge. ';
10.
Education and training in secondary vocational training
(1) The secondary vocational training centre prepares for the pursuit of the professional professions and professional activities corresponding to the relevant field of study. This study is completed by the final examination.
(2) The secondary vocational training centre prepares in the fields of study for the pursuit of certain demanding working occupations and certain technical and economic activities of an operational nature. This study is completed by a graduate examination.
(3) The secondary vocational training centre provides theoretical teaching, practical teaching and non-teaching for pupils; may also provide only theoretical teaching and education outside teaching or practical teaching and education outside teaching.
(4) The Ministry of Education, in agreement with the Ministry of Health and Social Affairs, provides for a decree on teaching and study courses suitable for pupils with altered working capacity. "
11. the following Section 9a is inserted after Section 9:
Training centre
(1) The Centre for Practical Teaching ensures practical teaching and non-teaching for pupils whose secondary vocational training is provided only by theoretical teaching.
(2) The Centre for Practical Teaching is responsible for teaching according to the prescribed curriculum and curriculum, while cooperating with the secondary vocational school which provides theoretical teaching for pupils. "
12.
Establishment and abolition of secondary vocational training centres and practical training centres
(1) The Centre for Vocational Training or the Centre for Practical Teaching establishes or repeals:
(a) the central administration or national committee; for the purposes of this Act, the status of central authorities shall also include associations of cooperatives;
(b) a State enterprise or a State organisation on the initiative of a central authority or a national committee or, where appropriate, a single agricultural cooperative or other cooperative (hereinafter referred to as "cooperative") on the initiative of an economic management authority or a public limited company.
(2) Cases where a central authority or a national committee is required to establish a secondary vocational training centre or a centre of practical training and cases where a secondary vocational training centre or a centre of practical training is established by a state enterprise or a state organisation or cooperative, the Government of the Czech Republic and the Slovak Republic, on a proposal from the ministries of education in the Czech Republic and the Government of the Slovak Republic, hereinafter referred to as the "Government of the Republics," are laid down by regulation.
(3) In order to establish a secondary vocational training centre or a centre of practical instruction by a State enterprise or a state organisation, the founder of a state enterprise or a state organisation shall define or supplement the subject of the activity of the founder of a secondary vocational training centre or a centre of practical instruction in the company's instruments of incorporation.
(4) The secondary vocational training centre shall be set up or cancelled according to a defined network of schools; The Centre for Practical Teaching shall be established or repealed in accordance with the list of Practical Teaching Centres. In order to establish, abolish or restrict the activities of a secondary vocational training centre or a practical training centre, the approval of the ministries of education shall be required.
(5) The secondary vocational training centre or centre of practical training set up under paragraph 1 (a) and the cooperative is a legal person. The secondary vocational training centre or the centre of practical training set up by a State enterprise or a state organisation shall be an internal organisational unit registered in the company register and acting in legal acts concerning the secondary vocational training centre or the centre of practical training on behalf of the enterprise.
(6) The National Committee may set up a centre of practical teaching for the preparation of pupils who are not preparing for an organisation. ';
13. The following Section 10a is inserted after Section 10:
Practical training centre
(1) The place of practical teaching provides practical teaching for pupils, to whom the secondary vocational training centre provides theoretical teaching and education outside teaching. The practical teaching workplaces are set up, with the agreement of the Ministry of Education, by the citizen for whom pupils are preparing.
(2) A citizen who has set up a practical teaching workplace is responsible for teaching according to the prescribed curriculum and curriculum, while cooperating with a secondary vocational school which provides theoretical teaching for pupils.
(3) A citizen who has set up a practical teaching workplace pays the costs of its operation and development. Where pupils are also trained for other citizens at the workplace, they shall be required to pay a proportion of the costs incurred in preparing them. '
14. in Article 11, the title reads: "Tasks of the institutions and organisations,"
in paragraph 1, the words "and organisation 'shall be inserted after the words" authorities'; The end-of-sentence period is replaced by a semicolon and the words "are obliged to create favourable conditions for the development and practical application of pupils' competences and initiatives. ',
paragraph 3 shall read as follows:
"(3) The institution or organisations which have decided to cancel, divide, merge, merge or change the economic activity of an organisation which includes a secondary vocational training centre or a centre of practical training or decide to cancel, divide, merge or merge a secondary vocational training centre which is a legal person shall designate an organisation or a secondary vocational training centre which shall assume the rights and obligations of pupils. ';
paragraph 4 shall read as follows:
"(4) The Ministry of Education shall provide by decree for the procedure and detailed definition of the tasks of central authorities, national committees and organisations in the management and planning of youth training for the profession in secondary vocational schools and centres of practical training, the manner and conditions for their establishment and the conditions for the exclusion of areas and facilities intended for the education and training of pupils from a state enterprise or a state organisation for the purpose of establishing a secondary vocational training centre or a centre of practical training. ';
Paragraph 4 shall become paragraph 5.
15.
Financial and material security of secondary vocational schools and training centres
(1) Reimbursement of the operating costs of secondary vocational training centres and centres of practical training, with the exception of those referred to in paragraph 3, shall be made from the costs of the organisations for which the youth are preparing.
(2) The investment development of secondary vocational training and practical training centres, which are a legal person, is ensured through central bodies and national committees. The investment development of secondary vocational schools and practical training centres set up by a state enterprise, a state organisation or a cooperative or a public public limited company shall be provided by a state enterprise or a state organisation or cooperative or a state public limited company from its own resources.
(3) The national committees shall cover:
(a) personnel costs for teachers of theoretical teaching, wage reimbursement and compensation of masters of vocational education, educators and trainers in classrooms with top-level sport training;
(b) the cost of textbooks, teaching texts and school supplies to pupils free of charge and the cost of teaching aids for the need for theoretical teaching;
(c) the costs of preparing pupils who have been admitted to the secondary vocational training centre or, where appropriate, the practical training centre and are not preparing for any organisation.
(4) The Government of the Czech and Slovak Federal Republics sets out the way in which a fund is created for the operation and development of secondary vocational schools and centres of practical teaching and its use.
(5) The costs of the operation and development of secondary vocational schools set up as legal entities and providing only theoretical teaching, teaching (§ 17a), secondary vocational training for young people requiring special care (§ 30) and vocational training (§ 32) may be borne by national committees in whole or in part by their means. "
16. Paragraph 13 is deleted.
17.
The National Committee may, after consulting the institution or organisation which has set up a secondary vocational training centre or a centre of practical training, determine that pupils and other organisations shall be prepared in a secondary vocational training centre or a centre of practical training. ';
18.
Gymnasium
(1) The Gymnasium is a universalised, internally differentiated school which is primarily prepared for university studies. It also prepares for certain activities in governance, culture and other areas. The Gymnasium has at least four and a maximum of eight years.
(2) The first to fourth year of the eight-year high school may also be set up in primary school. "
19. Article 16 reads:
Secondary Vocational School
The secondary vocational school prepares mainly for the pursuit of professional activities, in particular technical, economic, pedagogical, health, social law, administrative, artistic and cultural; it also prepares for university studies. The study usually lasts four years. '
20.
Conservatory
(1) The Conservatory is a specific type of secondary vocational school which prepares for singing, music, dance or dramatic art. He's also preparing for college.
(2) The Conservatory generally has six years, dance eight years and ends with discharge. "
21. After Paragraph 17, the fifth part is inserted:
Teachers
(1) The teaching centre provides vocational training for pupils who have completed compulsory education in primary school in the lower than ninth year or the ninth year have failed. Preparation at the school is completed by successful completion of the final examination.
(2) Teachers shall be set up and cancelled in accordance with Section 10 and shall be subject to Sections 9 (3), 11, 12, 14, 20 (2) and 22 to 25. '
The fifth part shall become the sixth.
22.
The right to study in secondary schools shall be exercised by pupils and other applicants according to the skills, knowledge, interests and medical fitness. ';
23.
(1) Teachers and other candidates who have successfully completed primary school are admitted to secondary school studies.
(2) In general, pupils who have successfully completed the fifth year of primary school are admitted to the first year of the eight-year high school.
(3) Other applicants who have received basic education or basic education according to previous regulations shall also be admitted to secondary school studies.
(4) By decree, the Ministry of Education sets out the scope of the powers and responsibilities of secondary school directors when receiving pupils and other applicants for secondary school studies; for secondary medical schools in agreement with the Ministry of Health and Social Affairs. ';
24.
Social welfare
The social welfare of secondary school pupils is voluntary and can only be held outside the school. '
25. In § 24 the title reads: "Financial and material security of secondary school pupils,"
paragraph 1 shall read as follows:
"(1) Teachers of secondary vocational schools are provided with financial and material security from the funding of organisations or national committees to pursue educational objectives. Pupils who do not prepare for any organisation in the secondary vocational training centre shall be paid from the resources of the national committees. For pupils who are in practical training at the practical training centre, financial and material security shall be provided in agreement with the competent secondary vocational training centre of the organisation which established the practical teaching centre. For pupils who are in practical training at the practical training centre, financial and material security is provided in agreement with the competent secondary vocational training centre by the citizen who has set up the practical teaching centre. Financial security shall be provided in the form of remuneration. Mass security includes catering and accommodation; Other financial and material security may be provided to pupils. Financial and material security may also be provided during school holidays. For pupils of secondary vocational schools for whom this is justified by the complexity of their education, as well as pupils for whom this is justified by their social conditions or health status, accommodation and meals may be provided free of charge. '
In the last sentence of paragraph 2, the word "socialist" shall be deleted,
paragraph 3 shall read as follows:
"(3) Details of the financial and material security of secondary school pupils are provided by the Ministry of Education by decree."
26. in Paragraph 25 (1):
"(1) In a high school, a secondary vocational school in a study of at least four years, a secondary vocational school in the fields of study and a secondary degree is completed. In the fields of secondary vocational education, the duration of which is less than four years, and in the fields of secondary vocational education, the final examination is completed. The day following the day on which the pupil successfully passed the graduation or final examination, he shall cease to be a pupil of the school. ',
in paragraph 3, the words "or in secondary vocational schools in a study of less than four years' shall be inserted after the words" final examination ';
in paragraph 5, the words "after completion of compulsory education 'are deleted.
27. in § 26 of the title is read: "Construction studies and post-graduate studies,"
paragraph 1 shall read as follows:
"(1) The secondary schools organise an extension course for applicants who have received secondary vocational education. In the extension study, students improve their professional skills and specialise in certain technical and economic activities of an operational nature. The extension studies are completed by the graduation examination. '.
Paragraph 1 shall become paragraph 2,
paragraph 3 shall read as follows:
"(3) Construction and graduate studies are generally organised in the form of studies at work."
paragraph 3 is renumbered paragraph 4 and at the end of the sentence, the words "superstructure studies' shall be inserted after the words" disciplines';
28. The title of Part Four is: "Special Schools."
29. in Paragraph 28 (1), the words "Schools for youth requiring special care" shall be replaced by "Special Schools."
In paragraph 2, the words "youth schools requiring special care 'are replaced by the words" special schools'.
Paragraph 3 shall read as follows:
"(3) Save as otherwise provided in this Act, special schools shall be subject to the provisions applicable to primary school or secondary school. ',
paragraph 4 shall read as follows:
"(4) Special schools are also special schools, vocational schools and auxiliary schools."
Paragraph 5 is deleted.
Paragraph 6 shall be renumbered paragraph 5 as follows:
"(5) In agreement with the Ministry of Health and Social Affairs, the Ministry of Education sets out in the decree the method and conditions for the inclusion of pupils in special primary schools for youth requiring special care, special schools, auxiliary schools and the conditions for admission of pupils to vocational schools."
30. In Section 29, the title reads "Special primary schools."
In paragraph 1, the words "primary schools for youth requiring special care 'are replaced by the words" special primary schools'.
Paragraph 2 shall read as follows:
"(2) Special primary schools have nine years. The Ministry of Education shall establish a decree which schools have ten years. '
31. In Section 30, including the title, the term "secondary school for youth requiring special care 'shall be replaced by the new term" special secondary school'.
