Decree of the Ministry of Agriculture, Forestry and Aquaculture on the preparation, approval and registration of supplements and amendments to the statutes of the JZD

on the preparation, approval and registration of supplements and amendments to the statutes of the JZD
VI. the national meeting of the JZD adopted by resolution of 26 April 1964 a proposal for amendments and amendments to the Model Statutes of the JZD approved by the Government of the CSSR by a resolution of 17 June 1964.
The Ministry of Agriculture, Forestry and Water Management shall, in agreement with the central authorities involved, provide for the organisation of agricultural management in accordance with Section 61 of Act No. 49 / 1959 Coll., on Uniform Agricultural Cooperatives and under Act No. 32 / 1963 Coll., for the development of supplements and amendments of the own statutes of the JZD according to the approved supplements and amendments of the Model Statutes of the JZD:
§ 1
(1) Each single agricultural cooperative (hereinafter referred to as "cooperative") shall discuss the additions and amendments to the Model Statutes of the JZD (hereinafter referred to as "Model Statutes of the JZD") and shall draw up by them additions and amendments to its own Statutes (hereinafter referred to as "Statutes") within 6 months of the publication of the Model Statutes of the JZD with additions and amendments adopted by the VI National Assembly of the JZD. *) The JZD Model Statutes leave a number of questions to the cooperative initiative. Each cooperative shall therefore discuss with a wide participation of cooperative members the JZD Model Statutes and adapt the Statutes in accordance with the following principles:
(a) it shall take over without amendment those provisions of the JZD Vzor Statutes which contain fundamental issues relating to the building, management and development of the cooperative. These are: the introductory provisions, Articles 2, 9 (2), 11, 12 (2), 14 (2) and (3), 16 (1) and (2), 17 (1), 18, 20, 21 (1) of Part A, D, E No 2, F No 1, 23 (1), 24, 25 (A) if cash remuneration is introduced in a cooperative, Part B No 1 if remuneration is introduced in a cooperative by labour units, 26, 29, 30 (2),
(b) take over, complete, accurate and elaborate those provisions of the Model Statutes of the JZD which require such specification. These are for example: Article 25 (B) (3), Article 28 (1), Article 32 (1), Article 39 (2) and (4),
(c) adapt in the Statutes those provisions of the JZD Vzor Statutes which are recommended to the cooperative or whose takeover depends on the will of the cooperative and which are valid in the cooperative only if they are stated in the Statutes. For example, Articles 14 (4), 16 (4), 21 (1) (E) (3), 23 (4), 27 (3), 30 (1).
(2) The cooperative will take over from the Vzor Statutes of the JZD from alternative solutions which correspond to its local and economic conditions; if the Model Statutes of the JZD indicate in this solution developments towards more advanced forms of management and the cooperative does not yet take this form due to its development, it may adjust this alternative in the Statutes by seeking to create production, economic and political conditions for the introduction of a more progressive form (e.g. the issue of remuneration, humming economies).
(3) The Cooperative may supplement the Statutes with provisions resulting from the recommendations of the Party and the Government, the Ministry of Agriculture, Forestry and Water and, where appropriate, the important resolutions of the Member States, which are of a more permanent nature and which regulate issues which have not yet been dealt with centrally.
§ 2
The Board of Cooperatives shall be responsible for the proper and timely preparation of the Statutes. The draft Statutes shall be drawn up by the Board of Directors or, where appropriate, by a commission which shall be set up by experienced cooperative members from different sections of the cooperative's activities. The draft Statutes shall be submitted by the Board of Directors to all the Cooperatives for comments and, after processing them, shall submit a draft Statutes for consideration and adoption of a member meeting.
§ 3
(1) The production farm administration, district and local national committees shall ensure the proper preparation of the statutes by the cooperative, in particular providing the cooperative with continuous and effective assistance from its own staff, Members and activists of the national committee. They shall also ensure that the statutes are drawn up in accordance with this Order, and in particular within the prescribed period.
(2) The Agricultural Production Administration and the Regional National Committee also organise assistance for professional and political workers in the district, in particular voluntary assistance for court workers, prosecutors, law firms, banks, patronage establishments, etc.
§ 4
(1) The Board of Directors of the Cooperative Group shall submit the Statutes adopted by the membership meeting to the local national committee for comments and, together with that statement, in three copies to the agricultural production administration.
(2) The production farm administration will, in cooperation with the District National Committee, arrange for the review of the Statutes with the participation of workers with knowledge of the agricultural cooperative economy and law, in particular whether they correspond to the Model Statutes of the JZD, this Decree and Act No 49 / 1959 Coll. or other legislation, and whether they comply with the Party's political and government guidelines on the development of agricultural cooperatives and with the political and economic needs and opportunities of the cooperative. If the statutes do not comply with these conditions, the production farm administration shall return them to the cooperative with comments and advise it to make appropriate adjustments within a reasonable time.
(3) The production farm administration shall, following the procedure provided for in paragraph 2, submit the Statutes to the Regional National Committee for approval.
§ 5
(1) Water and Forestry Department of the District National Committee
(a) keeps a book of the statutes of the JZD;
(b) register approved statutes by entry in the book of the statutes of the JZD;
(c) inform the cooperative in writing of the approval of the Statutes of the District National Committee and send to the Cooperative the approved Statutes; one copy of the notification shall be sent together with a copy of the approved statutes of the District Court at the seat of the Regional Court; a copy of the statutes shall be established.
(2) The approved statutes are binding on the cooperative.
§ 6
Any amendment or amendment to the statutes approved and registered by the District National Committee shall be subject to a new approval and registration pursuant to Sections 4 and 5 of this Decree.
§ 7
The production farm administration, district and local national committee shall supervise compliance with and application of the statutes in the cooperative.
§ 8
Decree No. 50 / 1961 Coll., on the drawing up, approval and registration of own statutes of the JZD is hereby repealed.
§ 9
This decree shall take effect on the day of its publication.
