about health professions.
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
The exercise of the health profession must aim to ensure that health care is carried out according to the current state of science, planning and economy, in order to ensure effectively the right of the people to health protection and the full use of healthcare workers in the construction of socialism.
§ 2.
(1) In order to achieve the objective set out in Section 1, the State organises, manages and controls the pursuit of health professions. In particular:
(a) determine the place of employment of health workers;
(b) impose on them working obligations in the field of healthcare;
(c) imposes specific tasks on them, where this is required by an important general health interest;
(d) provide for their professional training, in which the pursuit of their profession may be linked to the outcome of such training.
(2) When exercising the powers referred to in paragraph 1, the State shall, in particular, ensure that health care is provided under national insurance, in particular for factory workers.
§ 3.
Anyone who carries out a health profession is obliged to provide conscientiously effective and valuable health care and to ensure that the health standards of the people are raised. In so doing, he shall in particular:
(a) monitor consistently new knowledge in its field;
(b) to pursue his profession at the designated place of employment;
(c) to take over and fulfil properly the work obligations imposed on him in the field of healthcare;
(d) to take over and carry out, as appropriate, the specific tasks assigned to it in the important general health interest;
(e) to participate in the invitation of the competent authority of the State Administration to attend training in its field;
(f) to provide, within the limits of their professional competence, emergency assistance to any person who, without such assistance, would be in danger of his or her life or health and provide him or her with further professional care as necessary;
(g) to notify the competent authorities of serious health defects which they have learned from the exercise of their profession;
(h) maintain confidentiality of the facts which he has learned in the course of his profession; the obligation to notify such information, imposed on the health care professional by the relevant provisions, is without prejudice to this provision.
§ 4.
(1) The Government shall, by regulation, provide for the pursuit of individual health professions, in particular the eligibility and other conditions for the pursuit of those professions; it shall also adjust in the same way the conditions and the extent of the reimbursement of expenses incurred by healthcare professionals in carrying out their duties under Article 3.
(2) Government regulations issued pursuant to paragraph 1 may entrust a closer regulation to the general legislation of the Ministry of Health and, as regards health professionals, the National Security Corps or the Prison Guard Corps, the general legislation of the ministries of national defence, national security, after justice, issued in agreement with the Ministry of Health.
§ 5.
The interest corporations of medical workers with compulsory membership shall be deleted. In agreement with the participating ministries, the Ministry of Health will dispose of these corporations and decide on the use of the liquidation surplus and on the transfer of employees.
§ 6.
The practice of medical professions is not covered by the rules of the Trade Code (Trade Code).
§ 7.
All provisions governing matters covered by this law shall be repealed.
§ 8.
This Law shall take effect on 1 January 1951; It shall be implemented by health, national defence, national security and justice ministers in agreement with the participating members of the Government.
