GOVERNMENT REGULATION

amending Government Regulation No 64 / 2023 Coll., laying down the conditions for the implementation of measures to increase defence in pig farming by vaccination, as amended by Government Regulation No 45 / 2024 Coll., and Government Regulation No 70 / 2023 Coll., laying down conditions for the implementation of animal welfare measures, as amended by Government Regulation No 45 / 2024 Coll.
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the conditions for implementing measures to improve the defence of pigs by vaccination
Government Decree No. 64 / 2023 Coll., laying down the conditions for the implementation of measures to improve the defence of pigs by vaccination, as amended by Government Decree No. 45 / 2024 Coll., is hereby amended as follows:
1. In Article 5 (1) (c), "a 'is deleted.
2. In Article 5, at the end of paragraph 1, the dot is replaced by "and 'and the following point (e) is added:
"(e) in the register referred to in (b), it shall clearly indicate the vaccines applied against the pathogens mentioned in the application and, where appropriate, shall keep the records of those vaccines separately."
3. In Paragraph 6 (2), the words "animals with complete vaccination for a given pathogen only once 'are replaced by the words" the number of animals in order to correspond to the number of vaccinations carried out before each end of pregnancy for each vaccinated sows during the retention period'.
4. in Article 7 (1) (d):
"(d) in the case of vaccination of the category of pigs referred to in Article 2 (1) (d) against infectious swine diseases caused by pathogens
1. Clostridium perfringens EUR 7 per livestock unit of sows,
2. pig circovirus type 2 3 EUR per livestock unit of sows,
3. Glaesserella (Haemophilus) parasuis 2 EUR per livestock unit of sows,
4. Mycoplasma 2 EUR / 1 livestock unit of sows,
5. rotavirus EUR 1 per livestock unit of sows,
6. leptospira 2 EUR / 1 livestock unit of sows,
7. influenza virus type A 4 EUR per livestock unit of sows; or
8. other agents of infectious diseases in breeding, which can be solved by one or more registered vaccines or autogenic vaccines EUR 3 per livestock unit of sows. ';
5. in Paragraph 8 (1), the words "(a) or (b) 'are replaced by the words" (b)';
6. In Article 8, the following paragraph 9 is added:
"(9) If the Fund finds that the applicant for the selected pathogen, which is the content of the application, has not declared any eligible animal in that category of pigs in the final report, it shall not grant a vaccination grant for the selected pathogen within that category of pigs on the holding. ';
Transitional provision
The procedure for an application initiated pursuant to Government Regulation No. 64 / 2023 Coll., as effective before the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 64 / 2023 Coll., as effective before the date of entry into force of this Regulation, with the exception of Article 8 (9) of Government Regulation No. 64 / 2023 Coll., which shall apply as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down conditions for the implementation of animal welfare measures
Government Decree No. 70 / 2023 Coll., laying down the conditions for the implementation of animal welfare measures, as amended by Government Decree No. 45 / 2024 Coll., is hereby amended as follows:
1. In Article 6 (1) (c), the words "pursuant to Article 10 (2)" shall be inserted after the words "of the range type."
2. In Article 6 (2), the word "of type 'shall be inserted after the word" dimensions'.
3. in Article 6 (3) (b), the word "of type" shall be inserted after the word "dimensions."
4. In Article 6 (4), the word "of type 'shall be inserted after the words" or changes in dimensions'.
5. In Article 7 (3), "10 'is replaced by" 20'.
6. in Article 13 (2) (f), the word "cotton" shall be inserted after the word "linen."
7. In Paragraph 15 (6) of the Introductory Part of the provision, the number "10 'is replaced by" 20' and, in the case of a report for the last month, by 20 days at the latest after the end of the period of fulfilment, 'is deleted.
Transitional provision
The procedure for an application initiated pursuant to Government Regulation No. 70 / 2023 Coll., as effective before the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 70 / 2023 Coll., as effective before the date of entry into force of this Regulation, with the exception of the provisions of Sections 7 (3) and 15 (6) of the Government Regulation No. 70 / 2023 Coll., which shall apply as from the date of entry into force of this Regulation.
EFFECTIVE
This Regulation shall take effect on 1 March 2025.
