DECLARATION
of 26 January 2015
amending Decree No. 107 / 2005 Coll., on school meals, as amended
The Ministry of Education, Youth and Sports provides, pursuant to § 35 (2), § 121 (1) and § 123 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 333 / 2012 Coll., and in agreement with the Ministry of Health pursuant to § 121 (2) of the Education Act:
Decree No. 107 / 2005 Coll., on school meals, as amended by Decree No. 107 / 2008 Coll. and Decree No. 463 / 2011 Coll., is amended as follows:
1. In Article 2, the following paragraphs 4 and 5 are inserted after paragraph 3, including footnotes 8 and 9:
"(4) The catering service operator may provide school meals in a diet scheme (hereinafter referred to as" diet meals ") under the conditions laid down in its internal rules and in the case of other persons providing catering services in accordance with the provision of school meals.
(5) The selection of foods, recipes, the establishment of a menu and the method of preparing meals for diet meals is carried out by a nutritional therapist.
8) Act No. 372 / 2011 Coll., on Health Services and Conditions of Provision (Law on Health Services), as amended.
9) Article 15 of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical medical professions and for carrying out activities related to the provision of medical care and amending certain related laws (Law on non-medical medical professions). '
Paragraphs 4 to 8 shall be renumbered paragraphs 6 to 10.
2. In Paragraph 2, at the end of paragraph 8, the sentence "This shall not apply to the provision of dietary meals."
3. In Article 3, at the end of paragraph 3, the sentence "In the context of dietary meals, the school canteen may also issue meals prepared by another food service operator, provided that the food service operator ensures compliance with the conditions laid down in Article 2 (5)."
4. In Article 3 (5), at the end of the second sentence, the words "; diet meals may also be prepared by another food service operator provided that they ensure compliance with the conditions laid down in Article 2 (5) '.
5. In Article 5, the following paragraph 3 is inserted after paragraph 2:
"(3) For diet meals, the financial standard referred to in paragraph 1 shall be determined on the basis of the food prices required by the diet. ';
Paragraph 3 shall become paragraph 4.
Efficacy
This Decree shall take effect on 1 February 2015.
