DECLARATION
of 17 January 2008
amending Decree No 84 / 2005 Coll., on the costs and reimbursement of racing meals in contribution organisations set up by local authorities, as amended by Decree No 94 / 2006 Coll.
The Ministry of Finance provides pursuant to § 33b of Act No. 250 / 2000 Coll., on the budgetary rules of territorial budgets, as amended by Act No. 557 / 2004 Coll.:
Čl. I
Decree No. 84 / 2005 Coll., on the costs of racing meals and their reimbursement in contribution organisations set up by local authorities, as amended by Decree No. 94 / 2006 Coll., is amended as follows:
1. In Article 3 (3), the words "(5) 'are deleted.
2. In Paragraph 3 (3), the sentences of the second and third "to secondary school pupils and students under the first sentence may be provided for reduced remuneration only if they are intended to use the funds of the cultural and social needs fund. Where the use of the funds of the cultural and social needs fund is not intended for them, the main food may be provided to them in return for the purchase price of raw materials. ';
3. Paragraph 3 (4) and (5), including footnotes 3a and 3b, read:
"(4) The organisation shall provide the boarders referred to in paragraph 3 with a reduced remuneration of only one main meal on a calendar day if the boarder carries out work for the organisation for at least 3 hours on a given calendar day at the place of work agreed in the working smopova3a).
(5) The organisation may provide the boarders referred to in paragraph 3 with additional main meals for reduced remuneration on a calendar day if the boarder carries out work for the organisation for more than 11 hours in total with a compulsory break in the work which the employer is obliged to provide to the worker under the Labour Code (3b), on a given calendar day at the place of work agreed in the employment contract (3a).
(3a) Paragraph 34 (1) (b) of the Labour Code.
(3b) Sections 88 and 89 of the Labour Code. ';
4. Paragraph 3 (7) reads as follows:
"(7) The organisation may provide one main meal per calendar day at the cost of the purchase price of the raw materials, provided that their presence at work lasts at least 3 hours in that calendar day, to staff working for it under non-employment agreements, where this is permitted in a collective agreement or provided for in an internal regulation. ';
5. Paragraph 3 (8) reads as follows:
"(8) The staff of an organisation which carries out work at its own catering establishment and is directly involved in the preparation or delivery of meals shall be provided with the main meal under the conditions set out in paragraphs 4 and 5. ';
(6) footnote 4 shall read:
"(4) Paragraph 176 (1) (a) of the Labour Code. ';
7. Paragraph 5 (2) reads as follows:
"(2) The organisation shall provide the boarders referred to in Article 3 (3) for reduced remuneration with only one main meal on a calendar day if the boarder carries out work for the organisation for at least 3 hours in a given calendar day at the place of work agreed in the employment contract (3a). The organisation may provide to the boarders referred to in Article 3 (3), in return for payment in accordance with the sentence of the first main meal on a given calendar day if the boarder carries out work for the organisation for more than 11 hours in total, with a break in the work which the employer is obliged to provide to the worker under the Labour Code (3b), at the place of work agreed in the employment contract (3a). '
8. In Section 6 (2), footnote 5 is replaced by footnote 4.
9. footnote 5 is deleted.
10. in Article 6a (2) (b):
"(b) where the main dish or other main food is taken at a time when the main food is not working; or"
11. In Article 6a, the following paragraph 4 is added:
"(4) If the catering is provided and paid in accordance with § 4 and § 5, it may be provided and paid under a contract with several organisational elements of the State, legal or natural persons. '

This Decree takes effect on 1 February 2008.
