GOVERNMENT REGULATION
of 9 December 2002
laying down technical requirements for low voltage electrical equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., ("the Act ') to implement Sections 12 (1) and (3) and 13 (2) of the Act:
§ 1
Basic provisions
(1) This Regulation lays down technical requirements for low voltage electrical equipment in accordance with European Community law (1).
(2) For the purposes of this Regulation, low voltage electrical equipment (hereinafter referred to as "electrical equipment ') shall be considered any equipment intended for use in the range of rated voltages from 50 V to 1000 V for AC and rated voltages from 75 V to 1500 V for DC, with the exception of equipment and phenomena listed in Annex 1 to this Regulation.
(3) The specified products under this Regulation are electrical equipment within the meaning of Article 12 (1) (a) of the Act.
§ 2
Conditions for placing on the market of electrical equipment
(1) Electrical equipment may only be placed on the market if it complies with the technical requirements set out in Annex 2 to this Regulation (hereinafter referred to as "essential requirements") when it has been manufactured in accordance with good technical practice in terms of safety principles in force in the European Communities and does not jeopardise the safety of persons, domestic and livestock or property when properly installed and maintained and used for the purpose for which it was manufactured.
(2) The conditions referred to in paragraph 1 shall be deemed to be met if the electrical equipment complies with the safety requirements:
(a) harmonised Czech technical standards or, where applicable, foreign technical standards transposing harmonised European standards in the Member States of the European Union (Section 4a of the Act); or
(b) specified standards covering the safety provisions of the International Organisation for Electrotechnical Standardisation (IEC) or of the International Commission for Regulations on the Approval of Electrical Products (CEE) (Section 4a of the Act) where the standards referred to in (a) have not yet been established and published and where those safety provisions have been published by the Commission of the European Communities (hereinafter referred to as the Commission); or
(c) Czech technical standards (Section 4 of the Act), where there are no technical standards under (a) or (b).
§ 3
Conformity assessment procedure
(1) Electrical equipment may be placed on the market only after its conformity with the requirements referred to in Article 2 (1) has been assessed in accordance with the internal production control procedure set out in Annex 3 to this Regulation and the manufacturer or authorised representative bears the CE marking and issues an EC declaration of conformity.
(2) The EC declaration of conformity shall contain:
(a) identification details of the manufacturer or authorised representative (for a natural person, name and surname and permanent residence or place of business, for a legal person, name or business name and registered office);
(b) identification of the signatory authorised to act on behalf of the manufacturer or authorised representative;
(c) a description of the electrical equipment;
(d) a reference to harmonised standards;
(e) references to the specifications with which conformity is declared, if used;
(f) the last two digits of the year in which the electrical equipment was bearing the CE marking.
§ 4
CE marking and other marking
(1) The CE marking, the graphic form of which is laid down in a specific legislation, (2) shall be placed directly on the electrical equipment or, if this is not possible, on its packaging, instructions for use or a guarantee sheet in such a way that it is visible, easily legible and indelible. The electrical equipment shall not bear a marking which could mislead anyone with regard to the CE marking.
(2) A marking other than the CE marking may be affixed to the electrical equipment, its packaging, the instructions for use or the warranty sheet, but this shall not reduce the visibility and, where appropriate, the legibility of the CE marking.
(3) The CE marking on the electrical equipment shall indicate that the product complies with the technical requirements laid down in all the legislation applicable to it and which provide for or permit such marking and that the procedure laid down in the conformity assessment procedure has been followed. However, if one or more laws allow the manufacturer, for a transitional period, to choose which provisions he will follow, the CE marking shall indicate compliance only with those laws or their provisions used by the manufacturer. In this case, the documentation, warnings or instructions required by the legislation concerned and annexed to the products concerned shall indicate the relevant legislation of the European Communities or their provisions applied by the manufacturer.
§ 5
(1) In the event that a protective measure has been imposed on the electrical equipment under a special legislation, (3) the notification of the decision to impose a protective measure under Article 7 (8) of the Act shall state whether the non-compliance with the provisions of Article 2 (1) was caused by:
(a) shortcomings in the technical standards referred to in Article 2 (2); or
(b) incorrect application of the technical standards referred to in Article 2 (2); or
(c) failure to comply with good technical practice within the meaning of Article 2 (1).
(2) On request, the Commission shall issue a notified person4) The Commission is of the opinion that the extent to which the provisions of Paragraph 2 (1) for electrical equipment specified by the Commission have not been complied with.
(3) The notified person shall issue a report on the conformity of electrical equipment with the provisions of Paragraph 2 (1), if requested by the manufacturer or importer, in the event that a safeguard procedure has been initiated under the special legislature.3)
Transitional and final provisions
§ 6
(1) Valid certificates or other documents issued under Government Decree No. 168 / 1997 Coll., as amended by Government Decree No. 281 / 2000 Coll., may be used for the purposes of conformity assessment under this Regulation unless they are repealed under the conditions laid down by law.
(2) Persons in charge of conformity assessment activities under Government Regulation No. 168 / 1997 Coll., as amended by Government Regulation No. 281 / 2000 Coll., shall be deemed to be persons in charge of activities under this Regulation.
§ 7
The following shall be deleted:
1. Government Decree No. 168 / 1997 Coll., laying down technical requirements for low voltage electrical equipment.
2. Government Decree No. 281 / 2000 Coll., amending Government Decree No. 168 / 1997 Coll., laying down technical requirements for low voltage electrical equipment.
§ 8
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

Annex No. 1 to Government Decree No. 17 / 2003 Coll.
ESTABLISHMENTS AND NOVES TO WHICH THIS REGULATION IS NOT INCLUDED
This Regulation shall not apply to:
1. electrical equipment intended for use in potentially explosive atmospheres;
2. electrical equipment intended for radiology and medical purposes;
3. electrical components for freight and passenger lifts,
4. electrometers;
5. forks and sockets for home use,
6. equipment for power supply of electrical bays,
7. radio and electromagnetic interference,
8. specialised electrical equipment for use on board vessels, aircraft and railways which comply with the security provisions laid down by international organisations in which the Czech Republic is a full member.

ESSENTIAL SAFETY REQUIREMENTS FOR ELECTRIC DEVICES
1. General requirements
(a) The basic technical characteristics, the compliance of which ensures that the electrical equipment is used safely and in the conditions for which it was manufactured, shall be indicated on the electrical equipment or, if this is not possible, shall be indicated in the accompanying documentation.
(b) the name and surname of the natural person or business name of the legal person who is the manufacturer, the mark or trade mark, if any, shall be clearly indicated on the product and, if not possible, on its packaging.
(c) the electrical equipment and its components shall be so manufactured as to ensure safe and correct installation and connection.
(d) Electrical equipment shall be so designed and constructed that, provided it is used for the purposes for which it is intended and properly maintained, protection against the hazards referred to in points 2 and 3 is ensured.
2. Protection against hazards which may cause electrical equipment
Within the meaning of point 1, the technical design of the electrical equipment shall be such as to ensure that:
(a) persons and domestic and farm animals shall be adequately protected against the risk of injury or other damage which could be caused by electrical current when touching live or inanimate parts;
(b) there shall be no dangerous temperatures, no dangerous arches or no dangerous radiation;
(c) persons, domestic and farm animals and property shall be adequately protected from the dangers of non-electrical nature which, according to experience, may cause electrical equipment;
(d) the insulation shall comply with foreseeable conditions.
3. Protection against hazards that may arise from external effects on electrical equipment
Within the meaning of point 1, the technical design of the electrical equipment shall be such that:
(a) resist the anticipated mechanical stress in such a way that persons, domestic and farm animals and property are not threatened;
(b) resist, under the foreseeable conditions of the environment, the effects of non-mechanical influences so that persons, domestic and farm animals and property are not threatened;
(c) in the event of foreseeable overloads, it has not in any way threatened persons, domestic and farm animals or property.

INTERNAL CONTROL OF PRODUCTION
1. Internal control of production is a procedure whereby the manufacturer or his authorised representative who fulfils the obligations referred to in point 2 ensures and declares that the electrical equipment complies with the requirements of this Regulation which apply to it. The manufacturer or his authorised representative shall affix the CE marking to each product and draw up a written declaration of conformity.
2. The manufacturer shall draw up the technical documentation described in point 3 and either he or his authorised representative shall keep it in the territory of the European Community in such a way that it is available to the supervisory authority for at least 10 years after the end of the manufacture of the electrical equipment.
Where the manufacturer is not established in a Member State of the European Union or there is no authorised representative, that obligation shall be for the person who places the electrical equipment on the market.
3. The technical documentation shall make it possible to assess the conformity of electrical equipment with the requirements of this Regulation. It shall include, to the extent necessary for this assessment, data on the design, manufacture and functioning of the electrical equipment. It shall include:
(a) a general description of the electrical equipment;
(b) conceptual design and manufacturing drawings and diagrams of components, sub-assemblies, circuits and the like;
(c) descriptions and comments necessary for the clarity of the drawings and diagrams referred to in (b) and the functioning of the electrical equipment;
(d) the list of technical documents referred to in Article 2 (2) which have been used in whole or in part and, where such documents have not been used, the descriptions of the solutions adopted to meet the essential requirements shall be given;
(e) the results of the design calculations carried out, the tests carried out and the like;
(f) test reports.
4. The manufacturer or his authorised representative shall keep with the technical documentation a copy of the certificate of conformity.
5. The manufacturer shall take all necessary measures to ensure that the production process ensures compliance of the electrical equipment produced with the technical documentation referred to in point 2 and with the requirements of this Regulation applicable to it.
1) Council Directive 73 / 23 / EEC of 19 February 1973 on the harmonisation of the laws of the Member States relating to electrical equipment intended for use within certain voltage limits, as amended by Council Directive 93 / 68 / EEC.
2) Government Decree No. 291 / 2000 Coll., laying down the graphic form of the CE marking.
3) For example § 7a paragraph 1 (a) and (b) of Act No. 64 / 1986 Coll., on the Czech Trade Inspection, as amended by Act No. 22 / 1997 Coll. and Act No. 205 / 2002 Coll.
