adjusting certain allowances for loss of earnings after cessation of incapacity for work or incapacity
The Government of the Czechoslovak Socialist Republic hereby orders pursuant to § 447 (3) of the Civil Code:
(1) The compensation for the loss of earnings after the cessation of incapacity for work or invalidity under civil law is adjusted by increasing the average profit for the calculation of such compensation by 2% for each calendar year following entitlement to such compensation until 31 December 1980.
(2) Compensation for loss of earnings adjusted in accordance with paragraph 1 shall also apply where the injured party has not been granted until 31 December 1980 because the legislation on the amounts limiting the calculation and granting of such refunds did not allow this.
(1) The compensation for the loss of earnings after the cessation of incapacity for work or invalidity shall also be paid after the adjustment made under § 1 of § 447 (2) of the Civil Code.
(2) In order to increase the invalidity or partial invalidity pension, as the case may be, in accordance with the statutory measure of Bureau of the Federal Assembly No 7 / 1982 Coll., to increase pensions and to amend the Social Security Act, or, where applicable, to a similar increase made in accordance with the former provisions, (1), the calculation of compensation for loss of earnings after the cessation of work or invalidity effected pursuant to § 1 shall not be taken into account.
Compensation for loss of earnings adjusted under Paragraph 1 shall be due from the date of application of this Regulation.
This Regulation shall enter into force on 1 April 1983.
