Decree of the Federal Ministry of Labour and Social Affairs on the payment of insurance premiums under insurance contracts concluded by socialist organisations

on the payment of insurance premiums on insurance contracts concluded by socialist organisations
The Federal Ministry of Labour and Social Affairs, in agreement with the Federal Ministry of Finance, the Central Council of Trade Unions and after consulting the Federal Ministry of Foreign Affairs pursuant to § 43 (1) (b) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries, provides:
§ 1
Scope
This decree provides for the payment of insurance premiums on insurance contracts concluded by socialist organisations. 1) It does not apply to contracts for liability for damage, 2) to accident insurance for persons in the interest of interest, to accident insurance contracts for pupils negotiated by the mass ministries of education and to accident insurance for children in pioneer camps.
§ 2
Insurance during work
(1) Socialistic organisations (hereinafter referred to as "organisations") may negotiate for their workers with the Czech State Insurance Company or Slovak State Insurance Company (hereinafter referred to as "insurance undertakings") insurance contracts for persons and cover insurance contracts for them (3) in the course of work, where workers are still at risk of being hurt with the most severe consequences of damage to health or death due to effects which cannot be objectively predicted and avoided; those activities are listed in Annex 1.
(2) In carrying out the work referred to in paragraph 1, premiums may be paid for both workers and technical economic and other workers. For technical economic workers, the insurance contract may also be negotiated and the insurance premium paid if the work referred to in Annex 1 is directly managed at about the same level of risk of accident after at least 75% of its working time.
(3) If there is doubt as to whether a work activity carried out in an organisation corresponds to a list of work activities for which organisations may conclude insurance contracts for accident insurance at work both at home and abroad, the organisation shall request a decision from the competent central authority, which shall take a decision after consulting the Federal Ministry of Labour and Social Affairs.
§ 3
Insurance on secondment abroad
Workers seconded from the Czechoslovak Socialist Republic to the countries listed in Annex 2 may also insure and pay insurance premiums in the course of work activities other than those listed in Annex 1; they may also insure and pay premiums for their family members (wives, children), provided that they have assigned workers, in accordance with their social interests, to accompany them to the country concerned. Such insurance contracts may also provide for the payment of the insurance amount if the insured person dies within one year of his return to the Czechoslovak Socialist Republic on the consequences of an accident or illness, if an accident or illness occurs while abroad.
Scope of insurance
§ 4
For the workers referred to in Section 2, insurance may be contracted only in the event of death as a result of an accident at work and in the event of an accident at work with permanent consequences of an accident ("accident at work '); In addition, for the workers referred to in Article 3, insurance may also be contracted in the event of an accident at work and in the event of death for any reason.
§ 5
Insurance premiums may not exceed:
(a) for the insurance of a worker in the event of an accident at work referred to in Group A in the annexed list (Annex 1), 40 000 CZK in the event of death following an accident at work and 80 000 CZK in the event of permanent consequences of an accident at work;
(b) in all other cases, 20 000 CZK for the insurance of a worker in the event of death as a result of an accident and 40 000 CZK for the event of permanent injury.
§ 6
Repeal of existing contracts
(1) The organisations shall, within one month of the date of application of this decree, request the competent insurance undertaking to cancel all existing insurance policies for persons who have entered into insurance policies for their workers. Insurance undertakings shall comply with applications within one month of their receipt. The cancellation of existing insurance contracts shall be fixed on the date on which the insurance period expires but no later than 31 December 1978. This does not apply to the nominal insurance of workers posted abroad, agreed before the validity of this decree. This insurance remains valid until a worker returns to the Czechoslovak Socialist Republic.
(2) New insurance contracts corresponding to the provisions of Sections 2 to 5 may be negotiated only after the conclusion of an agreement to terminate existing insurance contracts. Organisations and insurance undertakings shall ensure that the same insurance event does not coincide with the old and new contracts.
§ 7
Efficiency of the Order
This Decree shall take effect on 1 March 1978.

work activities for which organisations can conclude insurance contracts for accident insurance at work both at home and abroad
Group A
1. Working in Danger Mines
- mountain shocks and cracks in coal and gas,
- unpredictable drafts of water, chicken or liquid sands - with potential risks to the lives of workers - in underground areas which could not be drained in the necessary way.
2. Rescue and emergency work in natural disasters, fires, explosions in the ground or on the ground, but only if
- workers of the mining rescue service, *)
- members of public and racing fire protection, *)
- members of the mountain rescue service.
3. Working with high risk of explosion, fire and acute poisoning in production, processing, mass storage, transport and explosion testing, working with risk of explosion injury and fire in the manufacture and processing of large quantities of hydrocarbon liquefied gases in the immediate vicinity of fire initiation (open furnace fire, etc.) or with a risk of exothermic chemical reaction with a large development of reaction heat at the limits of explosion in nitration, oxycation, etc., but only if
- the working activities summarised in the profession of "explosive" or "explosive worker" by the qualification catalogue of working professions of special production,
- personnel in the operational maintenance of explosive production and pyrotechnic plants,
- workers in delaboration,
- pyrotechnic workers in the disposal of explosions and ammunition, including war workers,
- workers in the transport of explosions,
- oxygen workers in the air production of ethylene oxide.
4. Work with a particularly serious risk of injury and life risk due to accidents, but only when it comes to aircraft crews when flying.
Group B
5. Work linked to the serious risk of injury to life risks caused by accidents and accidents, but only if
- crew of aircraft of all kinds (except for the crews of aircraft referred to in Group A (4)),
- postal air transport workers,
- personnel carrying out driving tests on rolling, road (one-stop and two-stop) vehicles and special vehicles at higher speeds or in the field under conditions exceeding those applicable to their driving or operation (e.g. CSD regulations, Ministry of Interior),
- rail shift workers - including train counters of handling trains, manual handling of exchanges and cleaning of switches - on selected main lines and in selected railway nodes.
6. Work associated with the risk of falling from heights, carried out in forced positions without working platforms, rope ladders, suspension seats, suspension on the safety belt and in a limited working space on the work bench, generally at heights above 10 m, but only if
- personnel on construction and general repairs of tall buildings, industrial and special buildings, blast furnaces, coke batteries, mast radio and television transmitters, cable cars, factory chimneys and cooling towers including their accessories (light and colour signaling, lightning rods, etc.),
- workers in the installation of radio and television equipment and other telecommunications work on masts,
- workers in installation work on mast very high voltage and high voltage,
- workers who tear cones in the crowns of tall coniferous trees,
- workers in the remediation of stale rock formations and damaged buildings,
- repair and maintenance personnel for seagoing ships.
7. Working with a high risk of acute poisoning due to the inshortness of the environment due to the extremely dangerous concentration of harmful and toxic substances, where the filter mask is not reliably protected and it is necessary to use also special breathing apparatus with air compressed in the bottle, long-distance breathing apparatus hose and protective clothing as appropriate, but only if
- workers in the blinding and unblinding of gas pipelines with generator gas, gas, etc.,
- workers cleaning tanks, tanks etc., from chemical lanterns of particularly dangerous poisons.
8. Work with high risk of burns due to high temperature working environment with high concentration of harmful or toxic gaseous substances, where special body protection (e.g. metal suit with non-flammable thermal insulation suit, asbestos protective suit, etc.) should be used in order to protect health, but only if it is possible for
- workers during emergency internal repairs of refractory linings by furnaces of different structures,
- workers in emergency internal repairs of chemical reactors for synthesis, fission, etc.
9. Working under water at an increased pressure of air, where it is necessary to use diving devices with a supply of pressurised air by a hose, breathing apparatus with air compressed in a bottle, oxygen apparatus with regeneration of air or other equipment for underwater use, but only if
- rescue workers,
- maintenance workers for dam and other water works and equipment,
- workers in casons in the construction of water works,
- speleology.
10. Work with a high risk of serious radiation accident or accident, acute injury due to ionising gamma or corpuscular alpha and beta radiation, but only if
- workers in the installation and maintenance of large gamma-radiation devices (several hundred curia and above),
- workers in the primary nuclear reactor circuit (behind the health loop in the so-called active zone),
- workers in the transport of burnt-out activities - residues of nuclear fuel,
- workers in deep-sea extraction of sedimentation deposits of radioactive raw materials at risk of radon and water production under conditions of use of whole body protection and isolation apparatus.

countries with particularly difficult conditions to which posted workers may be insured by organisations
Countries with extremely difficult conditions are:
(a) Africa, with the exception of the Republic of Algeria, South Africa, Tunisia and Morocco;
(b) Central America, including the Caribbean, with the exception of Mexico and Cuba,
(c) South America up to 30 ° south latitude, except the cities of Sao Paolo and Rio de Janeiro;
(d) Asia, with the exception of Japan, Israel, the People's Republic of China, the Democratic People's Republic of Korea and the Asian part of the Union of Soviet Socialist Republics, and with the exception of Ankara,
(e) Arctic and Antarctica;
(f) Oceania (the whole territory).

2) Decree of the Ministry of Finance No. 50 / 1964 Coll., on insurance conditions for liability insurance.
3) Insurance premiums shall be paid to the insurance undertaking for economic organisations for costs, for budgetary and contribution organisations as budgetary expenditure.
