defining in more detail the synergies between the Public Security services and national committees in the protection of public order
The Government of the Slovak Socialist Republic orders pursuant to § 41 of Act No. 40 / 1974 Coll., on the National Security Corps:
§ 1
Preliminary provisions
(1) Public security services perform their tasks in the protection of public order in close cooperation with national committees; the manner in which each task is to be performed shall be decided by the Chief or Commander of the relevant department of the National Security Corps ("the Chief ').
(2) The cooperation between the Public Security Services and the National Committees in the protection of public order
(a) Circumstantial and equal departments of Public Security with local national committees, municipal national committees and the local national committees in Košice (hereinafter referred to as the "Local National Committee");
b) Public Security Municipal Administration in Košice with the Municipal National Committee in Košice,
(c) the District Department of Public Security with the District National Committees; the District Department of Public Security in Bratislava with the District National Committees in Bratislava,
(d) the Regional Administration of the National Security Corps with the Regional National Committees;
e) Public Security Municipal Administration in Bratislava with the National Committee of the Slovak Socialist Republic of Bratislava.
(3) The cooperation between the Public Security Services and the National Committees is ensured in particular by the personal contact of authorised representatives of these bodies; a written form of contact shall be required only in the cases provided for in this Regulation or where this results from the nature of the case.
Protection of public order
§ 2
(1) When adopting measures to ensure the protection of public order in their territorial districts, the National Committees take advantage of the initiatives and proposals of the Public Security Services.
(2) The National Committees shall inform the relevant Public Security Services of the preparation of their generally binding regulations and other public order measures to be implemented by the Public Security Services.
§ 3
(1) The Public Security Services shall report to the National Committees on the state of socialist legality on the state of public order in their territorial districts at least once a year, or at the request of the National Committee, even in shorter periods; They shall submit these reports in writing to the Regional National Committees and the District National Committees.
(2) The Public Order Report provides an overview of the overall situation on this section, the share of the Public Security Service and the Public Security Auxiliary Guard in the provision of public order, including conclusions on their activities and recommendations to the National Committee for appropriate measures. As a rule, the report also contains information on the detection, clarification and prosecution of offences by the Public Security Service. In the cities and municipalities where a public order inspection of the National Committee is established, the report shall also evaluate the cooperation of the Public Security Service with that inspection.
(3) The national committees shall discuss the reports submitted on the state of public policy and shall take the necessary measures.
§ 4
(1) Public security services assist national committees in ensuring the protection of public order and in preventive and educational activities; contribute in particular to the development, implementation and evaluation of joint action plans to prevent antisocial activity and to educate citizens to comply with laws and other legislation.
(2) National Committees and Public Security Services shall immediately inform each other of circumstances which may seriously jeopardise public policy and take measures to protect it.
§ 5
Local Public Order Affairs
(1) The public security services in the security of local public order matters carry out the tasks assigned to them by the national committees, provided that the national committees cannot provide them with their own resources and resources, by:
(a) supervise compliance with generally binding regulations of national committees;
(b) implement specific measures which the national committees normally impose on them in writing.
(2) The Public Security Services shall inform the national committees of the fulfilment of the tasks referred to in paragraph 1.
(3) If the Public Security Service is unable to fulfil the tasks assigned to it by the National Committee, the Head of the Department shall notify the Chairman of the National Committee and the Senior Chief.
(4) If the Public Security Service fails to fulfil the tasks assigned to it by the National Committee, the National Committee shall notify the National Committee of the higher level; the next procedure shall be discussed by the Chairman of the national higher-level committee with the Chief of Public Security Branch. If the tasks assigned to the Public Security Service by the Regional National Committee (National Committee of the Slovak Socialist Republic of Bratislava) are to be discussed by the President of the Regional National Committee (Mayor of the Slovak Socialist Republic of Bratislava) with the Minister of Interior of the Slovak Socialist Republic.
§ 6
Displacement of public security services
(1) The Heads of the National Security Corps who decide on the deployment of the Public Security Services are required to request, before a decision is taken, the opinion of the National Committee responsible for the territorial scope of the proposed deployment.
(2) The Regional National Committees and the Regional National Committees comment on the proposals for the deployment of the Public Security Services following the findings of the respective national lower level committees.
(3) If the Head of the National Security Corps intends to decide on the deployment of the Public Security Service other than recommended by the National Committee in its written observations, it shall first discuss it; if it persists in its intention, it shall notify the national committee in writing of the reasons for its decision.
Establishment of Auxiliary Guard Units and recommendations of citizens for its members
§ 7
(1) The Heads of the National Security Corps who decide to set up the Public Security Auxiliary Guard units are required to request a statement in writing from the National Committee in whose territory the Public Security Service is responsible for establishing such units. where the Public Security Service operates in the territorial districts of several national committees, they shall request the opinion of the national higher-level committee.
(2) The national higher-level committees shall comment on the establishment of the Public Security Auxiliary Guard teams following the findings of the respective national lower-level committees.
(3) If the Head of the National Security Corps decides to establish a Public Security Auxiliary Guard unit other than that recommended by the National Committee in its written observations, he shall notify the National Committee in writing of the reasons for his decision.
§ 8
(1) A citizen may only become a member of the Public Security Auxiliary Guard on written recommendation from the local national committee at his permanent or temporary residence.
(2) The head of the District Department of Public Security is obliged to inform the local national committee of the emergence of a citizen's membership in the Public Security Auxiliary Guard, of its release or withdrawal; the reasons for the withdrawal of membership shall be indicated.
§ 9
Actions to dissolve a public assembly
(1) The administrative procedure for dissolution of public assembly, manifestation or procession is carried out by the District Department of Public Security on written instructions from the District National Committee; where there is a risk of delay, instructions may be given in another credible manner, and its written copy shall be served without delay.
(2) They shall immediately inform the District National Committee in writing of any official action aimed at dissolving the public assembly, manifestation or parade of the District Department of Public Security.
§ 10
Measures involving serious threats to public policy
(1) If there is an imminent danger of serious threats to public policy which cannot be eliminated by the forces and resources of the national committee or other competent authority, the national committee shall request the nearest available Public Security Service to implement the necessary measures; It shall act by analogy in cases where a serious threat to public policy has already occurred.
(2) The Public Security Service shall inform the National Committee without delay of cases of serious threat to public policy or of its creation.
§ 11
Security of enforcement of decisions of the National Committee
The staff responsible for the implementation of the decisions of the National Committee shall request the competent Public Security Service to provide assistance if it is unable to carry out such an exercise for a reasonably expected or already incurred threat to life or health. The Public Security Service shall provide protection to the authorised staff member.
§ 12
Final provision
This Regulation shall enter into force on 1 April 1975.
