Regulation of the Minister for Agriculture
of 27 February 1951
on surveillance and other measures to ensure the protection of plant production.
In agreement with the relevant ministers, the Minister of Agriculture hereby orders the improvement of plant production pursuant to § 30 (2) of Act No. 188 / 1950 Coll.:
Authorisations and responsibilities of supervisory authorities.
(1) The Ministry of Agriculture shall exercise general supervision of the conservation of plant production and shall in particular ensure that they carry out their tasks by national committees.
(2) The authorities of the Central Audit and Examination Institute of the Agricultural Institute, following the case of the Research Institute for Forestry, and their branches (hereinafter referred to as the control institutes), if they are entrusted with the supervision of the Ministry of Agriculture in specific cases, have the same powers and responsibilities in carrying out the task entrusted to them as the authorities of the Ministry of Agriculture.
(3) The national committees shall, within their respective areas of competence, exercise general supervision of the conservation of plant production and perform the other tasks assigned to them in the field of plant production.
The supervisory authorities referred to in Article 1 (hereinafter referred to as the "supervisory authorities') shall be entitled to conduct inspections of land, agricultural and forestry plants and parts thereof, products of plant origin and all objects in contact with them, as well as plant protection products and plant products (hereinafter referred to as" the means'), in warehouses, transport facilities and such.
(1) The supervisory authorities shall invite users of the land, farm building, warehouse or establishment or its representative, after a representative of the transport undertaking, to visit.
(2) The inspection shall be limited by the supervisory authorities to the necessary actions and shall ensure that the economic operation of the undertaking, in particular in transport, is minimised.
(3) Users of land, farm buildings, warehouses or premises, in the case of their representatives, are obliged to allow the supervisory authorities to exercise supervision and provide them with the necessary data and the necessary aids.
The supervisory authorities shall also check that only products officially authorised for pest control are put into circulation and comply with the conditions under which they were authorised, in particular as regards efficiency and safety.
The supervisory authorities shall be entitled to take samples of agricultural and forestry plants and parts thereof, of products of plant origin and of means, as appropriate, and to send them to the inspection institutes, following the case of the State Health Institute.
The supervisory authorities shall ensure that all measures necessary for the successful eradication or prevention of the occurrence, spread or introduction of plant pests are taken; in particular, ensure that rules on pest control are maintained.
Reporting obligation of manufacturers.
(1) Manufacturers of devices are required to test the characteristics of each series of devices produced, in particular as regards their effectiveness against plant pests.
(2) The producers of funds are required to report in writing each series produced to the Ministry of Agriculture and to notify the inspection institute which the Ministry of Agriculture will indicate to them. The report shall be sent by the manufacturer at least 14 days before the series is put into circulation.
The supervisory authorities shall exclude a series of manufactured devices from circulation if they find that the conditions of the authorisation granted are not fulfilled. The manufacturer shall inform and report to the Ministry of Agriculture of the deficiencies identified.

A. When transport by rail:
all railway border crossing points in which customs is located. Derogations may be provided for by the Ministry of Agriculture in agreement with the Ministry of Transport.

General and final provisions.
The supervisory authorities shall, in the performance of their duties, maintain the rules on the protection of personal and household freedoms and the rules on entry into undertakings, as well as the confidentiality of the facts established during the trials, and conserve the production secrets of which they have been informed in the course of official activities.
This Regulation shall enter into force on the day of its publication.
