Ordinance on the determination of conditions at which solid fuel from waste ceases to be waste

DECLARATION
of 8 June 2023
laying down conditions for the cessation of solid waste fuel
The Ministry of the Environment and the Ministry of Industry and Trade provide, pursuant to § 9 (7), § 15 (5) (a) and § 94 (2) of Act No. 541 / 2020 Coll., on Waste, hereinafter referred to as "the Act":
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for:
(a) solid fuel from waste which ceases to be waste;
(b) the moment when solid fuel from waste ceases to be waste;
(c) the specific purpose for which solid fuel from waste may be used;
(d) requirements for waste entering the recovery process which produces solid fuel from waste;
(e) the waste treatment process in the recovery process during which solid fuel is generated from waste;
(f) qualitative criteria to be met by solid fuel from waste in order to stop being waste;
(g) sampling and testing requirements;
(h) particulars of accompanying documentation;
(i) certain information requirements on waste which is transferred to a waste recovery facility in which solid fuel is produced from waste and the producer of such waste; and
(j) certain requirements for keeping a continuous waste management record at a recovery facility where solid fuel is produced from waste.
§ 2
Solid fuel from waste
(K § 9 (7) of the Act)
(1) Solid fuel from waste ceases to be waste if:
(a) is manufactured only from other waste which cannot be disposed of in a more appropriate manner in accordance with the waste management hierarchy and which at the same time satisfy the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council of 20 June 2019 on persistent organic pollutants;
(b) meets the requirements for solid alternative fuel for one of the classes specified in technical standard CSN EN ISO 21640 Solid alternative fuels - Specifications and classes;
(c) it is produced in a stationary waste recovery facility operated on the basis of a permit for the operation of an installation pursuant to Article 21 (2) of the Act and in accordance with standard ČSN EN 15358 Solid Alternative fuels - Quality Management Systems - Specific requirements for their use in the production of solid alternative fuels;
(d) the waste recovery facility referred to in (c) shall be transferred to a combustion stationary source with a total rated thermal input of more than 20 MW, to a waste incineration plant or to a rotary furnace for the production of cement clinker or rotary, shaft or other lime kilns in which energy recovery is made and which meet the following conditions:
1. are operated on the territory of the Czech Republic,
2. are specifically defined in the accompanying documentation of solid fuel from waste;
3. they are operated in accordance with an operating permit issued for the heat treatment of waste in a stationary source listed in Annex 2 to the Act on the Protection of Asphyxias (2) or an integrated authorisation issued under the Integrated Prevention Act (3) replacing it; and
4. are part of a project subject to a permit under the Building Act (4),
(e) for energy use in stationary sources as referred to in point (d), the same requirements as those laid down in the Act on the Protection of Aids (5) and the Integrated Prevention Act (3), including requirements on best available techniques (6), as if heat treatment of waste were taking place; and
(f) is specifically defined as input material in the authorisation of the operation of a stationary source referred to in point (d) in which it will be used.
(2) Solid fuel from waste ceases to be waste at the time of the physical removal to the establishment of a stationary source referred to in paragraph 1 (d).
§ 3
Waste biomass fuel
(K § 9 (7) of the Act)
(1) The conditions on the basis of which solid waste fuel ceases to be waste pursuant to Article 2 shall not apply to solid waste fuel produced from waste biomass ("waste biomass fuel").
(2) Waste biomass fuel ceases to be waste if:
(a) is produced only from other wastes as defined in Table 1.1 of Annex 1 to this Decree which cannot be handled in a more appropriate manner in accordance with the waste hierarchy;
(b) meets the definition of biomass for combustion in stationary sources and the requirements for burning it pursuant to Decree No. 415 / 2012 Coll., on the permissible level of pollution and its detection and on the implementation of certain other provisions of the Air Protection Act, as amended;
(c) meet the maximum permitted level of pollutants set out in Table 1.2 of Annex 1 to this Regulation, while respecting the range of determined polycyclic aromatic hydrocarbons set out in Table 1.3 of Annex 1 to this Regulation; these values must not be achieved by dilution,
(d) it is manufactured in a stationary waste recovery facility operated on the basis of an installation permit pursuant to Article 21 (2) of the Act and in accordance with the standard EN 15358 Solid alternative fuels - Quality Management Systems - Specific requirements for their use in the production of solid alternative fuels; and
(e) the waste recovery facility referred to in point (d) shall be transferred to a combustion stationary source with a total rated thermal input of more than 5 MW in which energy recovery is made and which fulfils the following conditions:
1. is operated on the territory of the Czech Republic,
2. is specifically defined in the accompanying documentation of waste biomass fuel;
3. it is operated in accordance with an operating permit issued for a stationary source listed in Annex 2 to the Act on the Protection of Asphyxias 2) or an integrated permit issued under the Integrated Prevention Act 3) which replaces it; and
4. is part of a project subject to a permit under the Building Act (4).
(3) Where waste biomass fuel is produced only from waste as defined in Table 1.4 of Annex 1 to this Decree, which are non-polluted plant material, compliance with the criterion in paragraph 2 (b). (c) not required.
(4) Waste biomass fuel ceases to be waste at the time of the physical take-over to the establishment of a stationary source referred to in paragraph 2 (e).
§ 4
Supporting documentation
(K § 9 (7) of the Act)
The contents of the solid fuel accompanying documentation from waste which must be provided by each individual delivery at the latest at the time of exit from the installation in which it is produced are set out in Tables 2.1 and 2.2 of Annex 2 to this Decree. The accompanying documentation shall also include data for the specification of solid alternative fuels as set out in Annex A to technical standard ČSN EN ISO 21640 Solid alternative fuels - Specifications and classes.
§ 5
Waste data
[Paragraph 15 (5) (a) of the Law]
(1) The data on waste which is transferred to a waste recovery facility for the production of solid fuel from waste pursuant to Article 2 must include data on the producer of waste and on the origin of the waste, on the grounds that the waste is deemed to meet the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council. Where it is not possible to demonstrate on the basis of data on the origin of waste that the waste will meet the conditions for placing on the market under Regulation (EU) 2019 / 1021 of the European Parliament and of the Council, data on the content of persistent organic pollutants, the content of which cannot be excluded, including sampling and testing protocols or copies thereof, shall be included.
(2) Part of the waste data transmitted to the waste recovery facility for the production of solid fuel from waste pursuant to § 2 or 3 is a justification why waste cannot be disposed of in another way in accordance with the waste hierarchy.
§ 6
Interim registration
(Paragraph 94 (2) of the Law)
The continuous record of waste of the waste operator of the recovery facility from which solid fuels are removed from the waste pursuant to § 2 or 3 shall, for each recorded data on the production of solid fuel from the waste, include a unique delivery identification number and a copy of the relevant accompanying documentation. Each record of the production of solid fuel from waste referred to in § 2 or 3 shall be accompanied by a document issued by the operator of the stationary source confirming receipt of the supply and containing a clear identification of the stationary source in which the solid fuel from the waste is recovered, a unique delivery identification number and the fuel mass delivered in the supply.
§ 7
Sampling and testing requirements
(K § 9 (7) of the Act)
The sampling and testing requirements for verifying compliance with the requirements for solid alternative fuel of one of the classes according to technical standard ČSN EN ISO 21640 Solid alternative fuels - Specifications and classes and for verifying compliance with the criteria referred to in § 3 (2) (c) are set out in Annex 3 to this Decree.
§ 8
Notification of technical regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 9
Transitional provisions
(1) By 31 December 2023, the requirements of this Decree shall not apply to solid fuel from waste, including waste biomass, which is produced exclusively from other waste and has ceased to be waste in accordance with § 154 (5) or 156 (5) of the Act.
(2) Until 31 December 2024, the requirements of this Decree shall not apply to waste biomass fuel produced exclusively from other waste for which an authorisation has been granted pursuant to Article 10 (1) of the Act before the date of entry into force of this Decree.
§ 10
Efficacy
This Decree shall take effect on the day following that of its publication.

Sampling and testing requirements
1. In the case of solid fuel from waste referred to in Section 2, sampling shall be carried out according to the requirements of technical standard CSN EN ISO 21645 Solid alternative fuels - sampling methods and, in the case of waste biomass fuel, according to the requirements of technical standard CSN EN ISO 18135 Solid biofuels - Sampling.
2. The operator of a recovery facility in which solid fuel is produced from waste pursuant to § 2 or 3 shall keep all laboratory samples for 36 months. The samples must be marked in such a way as to indicate the period from which the dose to which the sample belongs comes. The samples may be dried at a temperature not exceeding 40 ° C.
3. Methods for measuring calorific value, chlorine content and other substances monitored according to technical standard ČSN EN ISO 21640 Solid alternative fuels - Specifications and classes or according to Table 1.2 of Annex 1 to this Decree are given in Table 3.1.
