determining the scope of the documentation relating to the works contract and the inventory of works, supplies and services with a statement of expenditure
For the implementation of § 92 paragraph 1 of Act No. 134 / 2016 Coll., on public procurement:
§ 1
Subject matter
This decree sets out the scope of the documentation for the award of a public works contract and the inventory of works, supplies and services, with a statement of premises.
§ 2
Scope of documentation for the award of a public works contract
(1) The documentation referred to in Section 92 (1) (a) of the Public Procurement Act is a dossier which corresponds to the scope of:
(a) project documentation for the implementation of the construction according to the construction documentation decree;
(b) project documentation for the implementation of construction according to the Decree on the scope and content of the project documentation of transport structures; or
(c) documentation of the cutting works according to the construction documentation decree.
(2) The documentation referred to in paragraph 1 (hereinafter referred to as "the documentation for the award of works') shall determine the construction in technical, economic and architectural details which clearly define the subject matter of the contract, its material, construction, technological, technological, disposition and operational characteristics, appearance and quality, and shall enable the inventory of works, supplies and services (hereinafter referred to as" the list of works') to be drawn up, including the statement of estimates.
§ 3
List of works
The list of works shall, directly following the documentation for the award of works, provide a detailed description of all envisaged works, supplies or services covered by the public works contract.
§ 4
Structure of the work roster
(1) The list of works is drawn up on the basis of the documentation for the award of the works and is divided into building buildings, engineering buildings, operating files or other ancillary costs.
(2) Each building and engineering object is classified into the type and field of construction according to the classification of construction works and production, which is published on the Public Procurement Portal administered by the Ministry of Local Development.
(3) Each building object, engineering object or operating file, as defined by the documentation for the assignment of construction works, has its own list of works or several partial works.
(4) The list of works contains the items of all expected works, supplies or services necessary for the construction of a building building, an engineering building or an operating file.
(5) The list of works may be divided into construction or functional parts or other similar parts, depending on the type and nature of the works, supplies and services within each building, engineering or operating set.
(6) If the construction is described in more than one set of works, the specification shall also include a list of all subsets of works.
§ 5
Work roster items
(1) The list of works shall be understood as a description of each individual works, supplies or services which contains their technical and qualitative conditions in accordance with the documentation for the award of works.
(2) The items of the list of works are described in details clearly defining the content of the required works, supplies or services and allowing a comparable valuation of that content.
(3) The items on the list of works specifying the supply of the material or product, the assembly of which is given by a separate item of work, shall contain a clear description of the material or product, indicating the technical parameters or characteristics of the material or product required. In the heading of the list of works, reference to the relevant part of the documentation for the award of works may be used for this specification.
(4) The items of the list of works describing ancillary and other costs shall contain a clear description of the content of the item; a reference to other parts of the procurement documents specifying the item may be used for this description.
(5) A reference to the price system referred to in Section 11, which contains all the information necessary for the inventory of works, may be used for the compilation of the list of works in the details defined by this decree.
(6) The items listed in one subset of works may refer to only one price system under Section 11.
(7) The rules laid down in this Decree shall not apply to the items of the list of works for which the contracting authority is applying Article 92 (2) of the Public Procurement Act.
§ 6
Content of the list of works item
The item of the list of works is included in the building object, engineering object or operating file or other and ancillary costs and contains:
(a) the serial number of the item,
(b) the designation of the price system in accordance with Article 11, if applicable;
(c) the price system item code in accordance with Section 11, where the price system in accordance with Section 11 has been used;
(d) a description of the item clearly defining the type and quality of works, supplies or services, with any reference to the parts of the documentation for the award of works and other documents and technical and price conditions;
(e) unit of measurement;
(f) quantity,
(g) a statement of the quantities concerned, except where the calculation is not necessary to determine the quantity of the item on the list of works.
§ 7
Area statement
(1) In the statement of the notices, the contracting authority shall indicate the calculation used to determine the estimated quantity of the item of the list of works and the reference to the relevant graphic or text part of the documentation for the award of works in order to allow for the control of the total area, or refer to the calculation of the quantity of item of the list of works in the documentation for the award of works.
(2) The statement of expenditure relating to more than one item in the list of works may be given once and, for other items, only by reference.
§ 8
Definition of ancillary and other costs
(1) The ancillary and other costs are those which are not included in the list of works of building objects, engineering objects and operating files but are related to construction.
(2) The details of the description of the item of the inventory of ancillary and other costs must enable the price of the work or activity to be determined.
(3) The ancillary and other costs may be included in a common list of works.
§ 9
By-costs
In particular, secondary costs may be the subject of requirements relating to the construction, operation and disposal of construction site facilities, difficult conditions relating to the location of the building or restrictions in the suspended territory, where required by the contracting authority, or where they arise from documentation for the award of works.
§ 10
Other costs
Other costs may include, in particular, the cost of drawing up documentation on the actual implementation of the construction, the cost of geodetic orientation of the completed construction or the cost of publicity related to the implementation of the construction financed by the European Union funds.
§ 11
Price system
(1) A price system means an organised set of information on construction and assembly works, materials and products containing the classification of items, a detailed description and unit of measurement, the method of measurement and other technical and price conditions for the possibility of calculating the necessary costs and establishing the unit price.
(2) In the case of a reference to a price system, the contracting authority shall make a reference to the price system used in the procurement documents and shall provide suppliers with a part of the price system defining the description and conditions for the use of the relevant items of the list of works by ensuring unrestricted remote access to that part or by including it in the procurement documents.
§ 12
Electronic form of the work roster
(1) In the case of the use of the list of works in electronic form, the list of works shall be in such an open format as to enable data to be transferred and processed by various software products for the compilation of the list of works, for the production of the offer price and, at the same time, it shall be freely available.
(2) The electronic form of the inventory of works must be uniform for the contract in question.
(3) The electronic form of the list of works must enable the tender to be processed by supplementing the information required by the specifications.
(4) Where an electronic inventory of works is used, the contracting authority shall indicate in the procurement documents instructions concerning the structure of the data, their format or methods of detection; This does not apply if the format of the electronic work inventory is the format the documentation of which is available at the Public Procurement Portal administered by the Ministry of Local Development.
§ 13
Efficacy
This Decision shall enter into force on 1 October 2016.
