amending Act No. 65 / 1965 Coll., Labour Code, as amended, Act No. 88 / 1968 Coll., on the extension of maternity leave, on maternity benefits and on allowances for children from sickness insurance, as amended, and Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended
Parliament has decided on this law of the Czech Republic:
Amendment to the Act on the extension of maternity leave, maternity benefits and allowances for children from sickness insurance
Act No. 88 / 1968 Coll., on the extension of maternity leave, on maternity benefits and on the allowance for children from sickness insurance, as amended by Act No. 99 / 1972 Coll., Act No. 73 / 1982 Coll., Act No. 57 / 1984 Coll., Act No. 109 / 1984 Coll., Act No. 51 / 1987 Coll., Act No. 103 / 1988 Coll., Act No. 180 / 1990 Coll., Act No. 258 / 1991 Coll., Act No. 242 / 1994 Coll., Act No. 118 / 1995 Coll., Act No. 113 / 1997 Coll., Act No. 61 / 1999 Coll., Act No. 238 / 1993 Coll., Act No. 182 / 1994 Coll., Act No. 241.

(1) Financial assistance shall be granted to staff members or staff members who have taken custody of a child entrusted to them by a decision of the competent authority or a child whose mother has died.
(2) In the case referred to in paragraph 1, financial assistance shall be granted for a period of 22 weeks from the date on which the child was taken over, if it was taken over within 7 years of the child's age. For the duration of the maternity allowance provided for in Section 11, no monetary assistance shall be granted.
(3) The other provisions of this Law shall apply mutatis mutandis to the grant, amount and provision of monetary assistance.
(4) The conditions for entitlement to financial assistance and the method for determining such assistance shall be assessed on the basis of the condition at the date on which the child is taken over. ';
2. In Article 33 (2), the words "and 13 'shall be inserted after the words" Article 12a'.
Amendment of the Act on the service relationship of members of the Security Corps
In Article 83 (3) of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, the following sentences are added after the first sentence: "If a child has been taken over after the age of 3 but no longer than 7 years of age, parental leave shall be valid for 22 weeks. When taking over a child before the age of 3 years, such that 22 weeks would have elapsed after the age of 3, parental leave shall be granted within 22 weeks of the date of taking over the child. ';
Transitional provision
If a child has been taken over before the date on which the provisions of Article IV of this Law become effective, parental leave rights shall be assessed in accordance with existing legislation.
EFFECTIVE
This Act shall take effect on the first day of the calendar month following the date of its publication, except for Part Three, which shall take effect on the date on which Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended.
