on the technical and safety oversight of certain water-related works and the technical supervision of national committees
The Ministry of Forestry and Water Management of the Slovak Socialist Republic provides, pursuant to § 41 (1) (c) of Act No. 138 / 1973 Coll., on Water (Water Act), and § 10 (5) of the Slovak National Council Act No. 135 / 1974 Coll., on State Administration in Water Management:
§ 1
This decree provides for technical supervision which is required at dams, lakes and dams, as well as parts of structures intended for the treatment of watercourses, for flood, navigation, water collection, waste water discharges and other use of water, as well as for the production of tanks (hereinafter referred to as "works'), to provide administrators (owners, users and, where appropriate, investors) of such works (hereinafter referred to as" administrators'), and for technical safety oversight carried out by national committees on works.

ČÁST PRVNÍ

Díl I

Technical and security oversight
§ 2
(1) Technical technical safety oversight (hereinafter referred to as supervision) is a professional activity to establish the technical state of the work in terms of its safety and stability and possible causes of disturbances and to propose measures to remedy it.
(2) Supervision shall be ensured during the preparation of the work and shall be carried out during construction or reconstruction during the entire period of operation of the work until it is put into harmless condition.
(3) During the period of preparation and construction of the work, the investor fulfils the obligations imposed on the administrator by this decree.

Díl II

Categories of works
§ 3
(1) For supervisory purposes, works are to be classified in categories I to IV. The category of the work is determined by the Ministry of Forestry and Water Management of the SSR ("the Ministry ') after consultation with the relevant Regional National Committee.
(2) For works, with the exception of works which were under construction or operation on 1 January 1974, their administrator is obliged to submit a proposal to the Ministry to determine the category of work at the latest before the completion of the project task of construction or reconstruction, or 6 months after the date of application of the decree. The proposal shall be supported by an expert opinion from the organisation responsible for the supervision of the Ministry (hereinafter referred to as "the entrusted organisation '), including the design of the category of work and the criteria used for the design of the category; for works which were under construction or operation on 1 January 1974, the Ministry shall determine the category of work of the administrator's own motion.
(3) When reconstructing or changing the use of the work and in the case of Category III and Category IV works, even where the installation in the territory is changed by a work at risk, the administrator is obliged to propose to the Ministry the examination of the specified category of work.

Principles of supervision
§ 4
In the supervisory framework, the following phenomena and facts shall in particular be monitored by type and type of work, proportionate to the category and technical condition:
(a) the static and dynamic stability of the work or parts thereof,
(b) spatial changes of the work as a whole towards its surroundings;
(c) deformation of the work, mutual displacement of individual parts of structures, cracks in the construction material;
(d) deformation of the subsoil;
(e) the physical mechanical properties of construction and support materials,
(f) groundwater and leakage water regime, i.e. water pressure, leakage continuity, direction and speed of water flow, partial and total leakage rate, water vents in the space of the work;
(g) the function of the protective, sealing, filtration and drainage elements of the work and its substrates;
(h) hydraulic gradient in structural and ground materials and their filtration stability;
(ch) the effects of the environment on the technical condition of the work and its technological equipment, i.e. weather effects (in particular frost and rippling), landslides of the tank banks and landslides in the vicinity of the work, aggressive effects of air and water in the tank, groundwater and sewerage, effects of construction and blast works around the work, earthquakes, undermines, effects of operational and transport shocks, effects of vegetation and animals and unauthorised interventions by third parties;
(i) the effect of the operation on the technical condition of the work and its technological equipment, i.e. the effects of water handling in the tank, the mechanical and other effects of the discharged water and drifting materials, the wear and possible consequences of the failure of the closures and the paying structures of the discharges, overflows and sampling facilities;
(j) flow ratios compared to the original assumptions of the design of discharge and tidal devices, e.g. influencing the flow on the upper flow of new parts by failure or cancellation of existing works, change in drains in the river basin, ice jams, vegetation,
(k) other phenomena and facts which, according to local circumstances, may affect the safety of the work.
§ 5
(1) Supervision shall be carried out in particular by observing the work, measuring its deformations, leakage and processing, analysing and evaluating the results of all observations and measurements in relation to predetermined limit values (1) or critical values (2) of the project's assumptions, knowledge of the construction and existing operation of the work.
(2) The basis for the supervisory exercise shall be the effectively distributed monitoring of the facts, including routine measurements of variables and phenomena that are relevant for the safety of the work, as well as rounds, reports and inspections.
(3) The selection of possible causes of defects and other phenomena and the facts that the supervision monitors, the choice of means and methods of observation and measurement, the number of devices installed, the scope and frequency of the work shall be proportionate to the category of work, condition and operation of the work, and, where appropriate, to local circumstances, and shall comply with the applicable technical standards and the current state of engineering knowledge and the possibility of implementation.
§ 6
(1) For Category I and Category II works, the AIFM shall ensure that supervision is carried out through an authorised organisation, which shall, however, be obliged to submit the supporting documents referred to in Section 5 (2) to the extent specified by the supervisory programme.
(2) For Category III and Category IV works, the AIFM shall supervise itself.
(3) Supervision shall be carried out in proportion to the category of work, at least to the extent laid down in this Decree. In the case of Category I and Category II works, the administrator and the entrusted organisation may agree on a temporary or permanent adjustment of the scope supervision provided for in this Decree.
§ 7
Surveillance reports shall be drawn up during the period of construction or reconstruction of the partial and summary work, during the period of verification of the partial and total work and during the period of continuous operation of the phase and summary phase report work.
§ 8
All supervisory reports shall be submitted by the AIFM to the water authority in whose jurisdiction the work is authorised (hereinafter referred to as the "competent water authority '); for Category I and Category II works, it shall be obliged to arrange for submission through an authorised organisation.
§ 9
If, during the construction or reconstruction of the work, the supplier uses the construction or reconstruction technology to temporarily establish a construction which retains or may detain water, the supplier shall, in relation to this part of the construction or reconstruction, have an obligation to ensure supervision imposed by this decree on the AIFM.

Díl IV

Scope of supervision for individual categories of works
§ 10
(1) For Category I works, all phenomena and factors whose amendment may objectively signal or cause project assumptions to be exceeded to such an extent that the degree of stability of the work or a significant part of it would fall below the permissible limit set by technical standards. The weather and operational conditions shall be determined to the extent necessary for the assessment of all the phenomena and facts observed.
(2) Measurements should be carried out not only in places characterised by average ratios, but also in places where, above all, discontinuous development of phenomena could occur, such as failures in the foundations, changes in the layout and connection of gaskets and drainage elements.
(3) In doubt about the reliability of the method of monitoring the most important phenomena and facts, the responsible organisation shall determine the use of several measurement methods.
§ 11
For Category II works, the scope of supervision is the same as for Category I works, with no need to monitor phenomena and facts, the existence of which, or any undue change, may be derived in due time from another phenomenon or aggregate expression, such as total leakage, total deformations or shifts. Measurements are usually concentrated in characteristic profiles. Only weather and operational conditions are detected which immediately clarify the phenomena and facts observed.
§ 12
For Category III works, supervision shall be carried out by expert evaluation of phenomena and facts and their development, as a general rule only at rounds. Only the measurement of leakage, or water pressures and measurement of total deformations on the surface of the work is introduced from normal measurements. Only precipitation and air temperatures and water levels in the tank are detected from weather and operating conditions.
§ 13
For Category IV works, supervision shall be carried out by assessing the phenomena and facts found during the rounds. Measurements are introduced only temporarily to clarify unusual phenomena and facts.

Díl V

Preparation of supervision before construction or reconstruction of the work
§ 14
(1) The administrator is obliged to attach an opinion on the scope of supervision from the designated organisation to the project task of the construction or reconstruction of the category I to III work; for Category IV works, the scope of supervision is not processed.
(2) The opinion on the scope of supervision shall include in particular:
(a) a detailed description and analysis of the risks associated with the future existence of the work in the environment and the forecast of the future operating regime;
(b) requirements for research and project work beyond the applicable Czechoslovak state and industry standards;
(c) requirements for future means of supervision, instruments and equipment for observation and measurement;
(d) requirements for means of communication, warning and signalling equipment for supervisory purposes, as well as emergency measures for construction and operation;
(e) an indicative estimate of the costs of the means of supervision and their performance in the construction or reconstruction and in the operation of the work.
§ 15
(1) For Category I and Category II works, the administrator shall ensure, at the same time as the project documentation, the processing of the measurement project at the level in which the project documentation is processed. For Category III works, the administrator shall provide the measurement project only where the designated organisation proposes this in an opinion on the scope of supervision; the measurement project is not provided for Category IV works.
(2) The measurement project must be based on an opinion on the scope of supervision, on the requirements of the relevant technical standards and on the supervisory principles (Sections 4 and 5).
(3) The measurement project shall include in particular:
(a) an overview of the important assumptions of the safety and stability of the long-term operation of the work and an estimate of their security;
(b) the design and justification of the type, scale and accuracy of the measurement methods and instruments and equipment used to carry out surveillance;
(c) an overview of the limit values of the observed phenomena and facts affecting the safety of the work and its endangered territory;
(d) the design of safe access to measuring equipment and measures to ensure the safe performance of measurement and maintenance of measuring equipment, including their protection against damage;
(e) a timetable for installation and first measurements according to the construction process.
(4) If some of the requirements set out in the opinion on the scope of supervision are not addressed in the measurement project, they shall be reflected in another part of the project documentation.

Díl VI

Supervision of the construction or reconstruction of the work
§ 16
(1) Supervision during construction or reconstruction shall be carried out for Category I to Category III works according to an indication of the scope of supervision (Section 14). For the works of all categories, the schedule of observations and measurements shall be determined in agreement with the author's supervision.
(2) The administrator is required to ensure that, when the work is constructed or reconstructed, the work of the supplier is carried out in such a way that the instruments and devices for observation and measurement can be incorporated, tested and protected in a timely and professional manner against damage and that the continuity of observations and measurements and reliability of results are not compromised. For Category I and Category II works, the administrator shall provide a technical assessment of the installation of instruments and equipment, including verification of the technical documentation, through the designated organisation.
(3) Supervision during the period of construction or reconstruction of the work shall be in accordance with the procedure of construction or reconstruction of the work.
§ 17
(1) The results of the observations and measurements for category I and II works shall be processed during construction, in at least one partial report; the summary report on the supervision of construction must be prepared before the start of the verification operation.
(2) For Category III works, or during the reconstruction of Category I and Category II works, only the summary report on supervision during construction or reconstruction is processed before the start of operation.
(3) For Category IV works, neither the partial nor the summary report on supervision in the construction or reconstruction of the work is processed.
§ 18
The summary report on supervision in the construction or reconstruction of the work shall include:
(a) a description of the surveillance;
(b) documentation of the location and description of all the measurement instruments and equipment installed in the installation for supervision;
(c) a summary of the results of all observations and measurements made so far;
(d) an evaluation of all the phenomena observed and of the facts established compared to the project assumptions and their impact on the safety and stability of the work and its background;
(e) the surveillance programme in the verification operation.

Díl VII

Supervision in the verification operation of the work
§ 19
(1) The verification operation of the work is the period of the first load of the work as a whole with air water and involves testing such operational situations and in such a number that the fulfilment of the project assumptions can be assessed in a responsible manner and reliable function and safety of the work can be assessed.
(2) Supervision of category I to III shall be carried out according to the surveillance programme in the verification operation; for Category IV works, the surveillance programme shall not be compiled.
(3) The programme of supervision in the verification operation of the work contains:
(a) an indication of who and what observations and measurements are carried out;
(b) detailed instructions (terms, working procedures, registration of results) for measurements carried out by the service of the work;
(c) instructions for rounds carried out by the service of the work;
(d) the limit or, where appropriate, the critical values of the observed phenomena and facts;
(e) the instructions to which the results are measured! and the rounds and to whom the operator of the work immediately reports which means of communication, what emergency and warning measures are available for availability for emergencies;
(f) the reporting form, the instructions for completion, the dates of dispatch and the addresses of the main supervisors;
(g) details of who processes and evaluates the results in the sub-reports and on what dates.
(4) The programme of supervision in the verification operation of the work shall be stored in at least one copy
(a) with the administrator;
(b) for the entrusted organisation for works of categories I and II;
(c) for the service of the work.
(5) The administrator is required to designate a supervisor. The appointment shall be required to notify the competent water authority. The manager of a category I or II work shall at the same time notify the name of the principal supervisor of the entrusted organisation.
§ 20
(1) Observations and measurements for Category I to Category III works are carried out in the scope and dates of the surveillance programme. For Category IV works, observations and measurements shall be made to the extent provided for in Section 13 of this Decree.
(2) The results of the measurements are recorded in the report. Determination of limit or critical values shall be reported without delay to the main supervisory staff.
(3) The results shall be compared immediately with pre-established limit values or critical values, if any, or with pre-established limit developments of the observed phenomena.
§ 21
(1) The work and its nearby surroundings are monitored, flow rates, the regularity of the operation of all mechanisms, the occurrence of cracks and visible deformations, shifts and slides, the occurrence of leaks, vents and contaminated areas, the effects of operation and the environment on the technical state of the objects and technological equipment, in particular the construction of discharge, tidal and sampling devices.
(2) The rounds are made at least once a day on Category I, three times a week on Category II, once a week on Category III and once a month on Category IV.
(3) The shops are carried out by the workshop.
(4) The results of the rounds are entered in the report. Detection of marginal or other unusual facts that could affect the safety and stability of the work shall be reported without delay to the main supervisory staff.
§ 22
(1) The report of the results of the measurements and the rounds shall be made for Category I to Category III works on a form according to the surveillance programme, for Category IV works by written record. The report shall indicate who and when the measurements or rounds were made.
(2) The report shall be drawn up in two or, where appropriate, in three copies. The original is stored at the workshop. Further copies shall be sent to the main supervisory staff.
(3) Reports shall be sent immediately after the periods laid down in the surveillance programme, but at least twice a month for Category I works, for Category II works, for Category II works, for Category III works, once every two months, for Category IV works, once every six months.
§ 23
(1) The administrator or, for category I works, the designated organisation shall assess the reporting data by the end of the reporting period at the latest. The limit values and facts or other exceptional data reported by the operator of the work immediately after being found shall be assessed immediately.
(2) If the administrator or, in the case of category I and category II works, the organisation responsible for carrying out the assessment or processing of the results of the observations and measurements finds that the development of the observed phenomena or facts does not correspond to the assumptions, he shall examine the on-the-spot data, introduce extraordinary measurements, exploratory surveys and, where appropriate, other measures, pending an explanation of the exceptional developments and correction.
(3) If the observed phenomenon or event reaches a critical value, the AIFM shall immediately take emergency measures.
§ 24
(1) The results of the supervision during the verification operation of the work are to be drawn up for Category I to Category III works within the deadlines set by the surveillance programme. At the end of the verification operation, the overall surveillance report shall be prepared during the verification operation. For Category IV works, neither partial nor overall supervisory reports shall be processed during verification operations.
(2) The overall surveillance report during the verification operation shall include:
(a) a description of the surveillance;
(b) the overall processing of the results of the observations and measurements;
(c) an assessment of the phenomena observed and of the facts found;
(d) whether the work, after examination of all major loading conditions and operational situations and, where appropriate, after the implementation of corrective measures, does not have supervisory deficiencies which would impede its continued operation (use);
(e) the surveillance programme for the permanent operation of the work.
§ 25
If the verification operation of the work is carried out before the work is handed over and taken over by the administrator, the investor is required to supervise it.

Díl VIII

Monitoring in the permanent operation of the work
§ 26
(1) Supervision of category I to III works is carried out according to the surveillance programme for the continuous operation of the work. For category I to III works which are in permanent operation at the date of application of this decree, a surveillance programme shall be drawn up for the permanent operation of the work as a separate document and the administrator shall submit it to the competent water authority.
(2) The monitoring programme for the permanent operation of the work contains:
(a) documentation of the location and description of all measurement instruments and equipment incorporated or a reference to this documentation in previous surveillance reports during construction or reconstruction and during the verification operation of the work;
(b) the information provided for in Article 19 (3) of this Decree.
(3) Otherwise, the provisions of Sections 19 (4) and (5) and 20 to 23 of this Decree apply mutatis mutandis to permanent supervision.
§ 27
(1) Stage reports shall be drawn up on the results of continuous surveillance, at least once a year for Category I works, once every two years for Category II works and once every four years for Category III works.
(2) The monitoring report shall include:
(a) a description of the surveillance over the past period of permanent operation;
(b) a brief overview of the results of the observations and measurements;
(c) an assessment of all the phenomena and facts observed in relation to the limit values;
(d) a proposal for corrective measures.
(3) At least each fifth phase report shall be processed as a summary phase report.
(4) The Synthesis Phase Report contains:
(a) a description of the surveillance over the period since the last comprehensive phase report;
(b) documentation of any changes in the fitting of the work with measuring instruments and devices;
(c) a summary of the results of the observations and measurements;
(d) an assessment of all the phenomena and facts observed;
(e) the results of the stability check of the main structures of the work and detected; the degree of safety on the basis of newly acquired knowledge in accordance with the technical standards currently in force;
(f) environmental and operational impact assessment on ageing, functional reliability and overall safety of the work;
(g) draft corrective measures;
(h) a review of the surveillance programme, including, where appropriate, the marginal and critical values of the phenomena and facts monitored.
(5) Stage reports and summary phase reports shall be kept in at least one copy for the operation of the work.
(6) For Category IV works, neither phase reports nor summary phase reports are processed.

Díl IX

Work tours
§ 28
(1) The administrator is obliged to carry out inspections of the work at least once a year for Category I works, once every two years for Category II works and once every four years for Category III works. For category IV works, the frequency of inspections is not prescribed.
(2) Date of the works inspection The AIFM shall notify the competent water authority at least three weeks in advance.
(3) A tour of the work shall be managed by the principal supervisory officer of the administrator; the AIFM shall also ensure the participation of:
(a) the worker responsible for the operation of the work;
(b) the service of the work;
(c) for works I and II of the category of senior supervisory officer from the designated organisation,
(d) experts from engineering, electrical engineering and, where appropriate, other fields according to the type and type of work required by the nature of the main questions under consideration.
(4) The administrator shall invite the users of the works to inspect the work who may influence its safe operation by their activities.
(5) The object of the tour is in particular:
(a) examination of the operational capacity and functional reliability of the work;
(b) operational and maintenance checks;
(c) supervision and results;
(d) discussion of any ideas for improving the technical condition, use, operation and maintenance and for improving the safety of the work;
(e) repair and repair plans.
(6) During the inspection, the principal of the supervisor of the work shall draw up the minutes and send them to the competent water authority. At least one copy of the inspection must be kept at the service of the work.

Díl I

Technical safety oversight
§ 29
(1) Technical safety oversight as part of water management consists in checking the performance of the obligations imposed on water law administrators) and this decree.
(2) Technicosecurity supervision is carried out by the national committees responsible for water management, 4) from the authorisation of the work until it is put into harmless condition.
§ 30
