specifying the responsibilities and tasks of district and regional agricultural administrations and their relationship with national committees
The Government of the Slovak Socialist Republic orders pursuant to § 16 paragraph 1 of Act No. 37 / 1972 Coll., on District and Regional Agricultural Administrations:
Scope and tasks of district agricultural administrations
The Regional Agricultural Administration shall manage and ensure the development of agricultural production and agricultural services for the organisations referred to in Article 2 of the Act (hereinafter referred to as "managed organisations') in accordance with the needs and interests of the company expressed in the national economic plans with a particular focus on deepening the concentration and specialisation of agricultural production.
The district agricultural administration shall, within the scope of Article 1, carry out the following tasks in its territory:
(a) in the area of national economic planning
1. develop long-term concepts, proposals for medium-term and implementing plans for the development of agricultural production and agricultural services, including analyses and justifications, submit them to the Regional Agricultural Administration, and to other bodies according to specific regulations,
2. carry out a systematic analysis of the state and development of the agricultural sector of the managed organisation; ensure that internal resources and reserves are detected and used effectively;
3. Describes the tasks of the plan assigned to it by the Regional Agricultural Administration to managed organisations;
4. organise and methodically manage the development of medium-term and implementing economic plans in managed organisations.
5. Verifies that economic plans managed by organisations ensure the objectives and tasks of the State plans and their breakdown;
6. Directs management of economic processes in managed organisations to ensure, in particular, the tasks arising from state plans
7. Organises the implementation of agricultural production plans and agricultural services and checks how these plans are implemented in managed organisations:
(b) on the economic
1. Provides using- economic instruments for the development of agricultural production and agricultural services (including financial reserves), in particular providing special-purpose subsidies and State budget subsidies to managed organisations, controls their use and evaluates their effectiveness; carry out the financial settlement of the funds provided for the previous year and submit a report to the Regional Agricultural Administration on the whole of its activities on this section,
2. Expresses itself on the proposals for the inclusion of the cadastral territories of municipalities in natural habitats and on the proposals for the inclusion of state goods in production groups;
3. be responsible for the proper distribution of economic results in managed organisations;
4. Helps economically lagging management organisations to ensure their economic stability;
5. Organises and facilitates the implementation and deepening of internal planning and the identification of own costs so that managed organisations use own-cost analyses to fund agricultural production and reduce their own production costs;
6. Expresses its views on proposals managed by organisations for changes in the organisation of the agricultural land fund and on transfers of agricultural land between organisations,
7. Working on rationalising the development of agricultural production and agricultural services and ensuring the efficient use of investment and other resources;
8. Organises and directs cooperation and integration in its district in order to develop agricultural production; ensuring that the conclusion of cooperative agreements (1) is preceded by a reasoned economic analysis and that contracts are socially beneficial and economically beneficial to cooperative organisations;
9. organise and carry out quarterly and annual comprehensive analyses of the management of managed organisations;
(c) on the price section
1. examine the proposals (calculations, etc.) of managed organisations for establishing product, work and service prices and submit them with its opinion to the Regional Agricultural Administration;
2. keep an overview of prices registered with the relevant price authorities as well as of price decisions issued by those authorities;
(d) on the labour economy
1. ensure the regulation of the development of labour pay and monitor compliance with the principles of labour pay in managed organisations;
2. ensure the application of sectoral labour consumption standards and standards in managed organisations;
3. Develop and ensure the implementation of the concept of material interest on the specific conditions of managed organisations;
(e) in the field of a single system of socio-economic information,
1. directly acts and oversees the status of the information system of the managed organisations, compliance with the uniform methodology and the correct and timely performance of their reporting obligations;
2. ensure the implementation of the single information system methodology in accordance with the specific conditions of the managed organisations and ensure that it is consistently respected;
3. centrates, processes and evaluates the socio-economic information (including national and sectoral one-off, exceptional and seasonal investigations) collected through it;
4. carry out periodic operational and comprehensive analyses for agricultural production, purchase and services from a production and economic point of view; organise the division activity of managed organisations;
5. collaborates with national statistics, financial authorities, national committees and other bodies on inventories and other statistical surveys;
6. Provides for managed organisations the removal of deficiencies identified by them or brought to the attention of the Regional Agricultural Administration, as well as statistical, financial and other control bodies;
7. Maintains records, registers and pasports of basic production and economic indicators over longer periods of time;
(f) on the agricultural production development section
1. organise a continuous increase in agricultural production on the basis of economic plans, in particular by applying concentration and specialisation;
2. Provides for increasing the production of grain and fodder, including the creation of the necessary reserves, in particular by leading the managed organisation to use the executive varieties, the means of nutrition and plant protection and other intensification deposits; propose and organise effective measures in the field of agrotechnology, plant protection and nutrition, including the development of services and activities on this section. In doing so, it shall cooperate with the Central Audit and Examination Institute of the Agricultural,
3. Provides qualitative analyses of plant products, soil and material needs and ensures that the results of such analyses are used in managed organisations to increase production and its efficiency;
4. Care for improving the performance of livestock, in particular by leading the managed organisation to the efficient use of feed and by organising appropriate zootechnical measures and animal health care;
5. coordinate zootechnical, veterinary and breeding care;
(g) on the section of technical development and investment
1. ensure the application of state technical and investment policy in managed organisations and ensure the use of the latest knowledge of science and technology, in particular of large production technologies; while ensuring the implementation of more perfect forms of organisation of work and management of agricultural production and ensuring the advisory activities for managed organisations on this section,
2. Provides for the performance of the tasks arising from the rules on industrial rights in managed organisations, 2.
3. discuss and assess the preparatory and project documentation of the buildings, assess the Czechoslovak selection of buildings in cooperation with the State Bank, give consent to the launch of the buildings according to the special regulations (3); verify and approve the lists of buildings subsidised by the State budget and participate in the technical economic evaluation of the buildings,
4. Approves project documentation of buildings to the extent defined by the relevant regulations, 4)
5. Checks compliance during the special-purpose and residential investment construction, in particular the rules on building regulations, documentation of buildings and property records;
6. Expresses itself on the requirements of managed organisations for the allocation of balance sheet machinery and technological equipment in terms of the objectives of the development of agricultural production and agricultural services;
(h) on the materially technical supply section
1. draw up documentation to ensure the needs of centrally managed machinery and materials;
2. divide the management organisations according to the instructions of the Ministry of Agriculture and Nutrition of the Slovak Socialist Republic (hereinafter referred to as "the Ministry") and the regional agricultural administration of centrally managed machinery and materials, including the central feed fund, and seed and seed from balance sheet reserves;
(ch) in the supply-customer relationship section, coordinate supply-customer relationships of managed organisations with particular regard to the needs of food industry organisations and provide the management organisations with the necessary assistance in such relations;
(i) on the section on fertilisation and use of agricultural land
1. organise and ensure the design and implementation of land modifications according to the Ministry's instructions;
2. Organises the reclamation of agricultural land, ensures the use of land reserves, is responsible for the cost-effective use of the funds provided for this purpose by the State Fund for the Narrowing of Soil and participates in the technical economic evaluation of mellioration actions;
3. examine the applications, discuss and propose the conditions for granting subsidies and loans from the State Fund for Land Narrowing, provide the necessary supporting documents (including evaluation of proposals and selection procedures) for actions taken from the Fund's resources;
j) on the section of cadre and personnel work, education and care for workers
1. apply the principles of cadre and personnel work in managed organisations and ensure, in accordance with them, the selection, education, evaluation and effective deployment of personnel, including the cadre reserves;
2. keeps records of workers, ensures the reporting of mandatory indicators of uniform records of workers;
3. Care for reproduction of labour, plans the need for skilled workers, takes care of youth acquisition, organises training and further training of workers,
4. ensure that managed organisations allow practical training of pupils and apprentices;
5. Ensuring the development and participation of workers in management, in particular through socialist competition,
6. Care for the development of the Improving Movement and the use of its results in practice and provides the necessary assistance to the controlled organisations on this section;
7. Manages and coordinates the care of workers, including safety and health at work;
8. Care for the creation of an appropriate working and environmental environment in managed organisations;
9. ensure that controlled organisations in places with concentrated agricultural production participate in the investment construction of nurseries, nursery schools, or other health and cultural facilities;
(k) in the area of legal aid, provide legal assistance to managed organisations, in particular for the protection of property in socialist property, in supply-customer relations, in the field of agricultural cooperatives, the protection of the agricultural land fund, legal relations with land and other real estate, as well as in the field of employment and safety and health at work;
(l) on the control section
1. carry out control activities in managed organisations in order to respect socialist lawfulness and state discipline, in particular in planning, wage, price, financial and contract areas, as well as in the area of management and protection of property held in socialist property; if it finds that the legislation has been infringed, it shall give the competent authority an incentive to exercise material, disciplinary or criminal liability or, where appropriate, to take other measures to remedy it by virtue of legislation,
2. checks how the managed organisation performs the tasks arising from the rules on safety and health at work;
3. carry out operational and thematic examinations in managed organisations for the performance of its tasks and, where appropriate, for requests by authorised state authorities, 5)
4. Handles complaints, notifications and initiatives of workers under the Specific Regulations (6) and oversees the timely and proper handling of complaints in managed organisations;
5. carry out, in accordance with the Specific Regulations (7), periodic reviews of the management of managed state economic organisations;
6. Checks whether the review committee of managed cooperative organisations carries out its tasks and whether the accounts are properly kept in those organisations;
7. carry out, on the basis of its own knowledge and, where appropriate, that of the regional financial administrations, a review of the management of the funds provided to managed cooperative organisations for the development of agricultural production and agricultural services from the state budget or from the state funds;
8. Methodically manages and directs the activities of the review committees managed by cooperative organisations and control bodies managed by state organisations, carries out advisory activities for them and makes use of their knowledge;
(m) in the field of State defence, the protection of state, economic and professional secrets and fire protection, it shall ensure that the tasks arising from the State's defence legislation, the protection of state, economic and professional secrets and the protection of fire protection are carried out and that the managed organisations carry out the tasks arising from those rules.
The Regional Agricultural Administration shall also carry out activities arising from the Specific Regulations (8) for the production of agricultural administrations and district agricultural associations.
Relationship of the district agricultural administration to managed cooperative organisations
(1) In the exercise of its management powers, the Regional Agricultural Administration exercises consistency between the principles of State economic governance and the principle of cooperative democracy. Therefore, it is discussing measures relating to managed cooperative organisations with the authorities of those organisations, relying on those bodies in its activities and ensuring consistency between the interests of cooperative organisations and social interests with the broadest participation of cooperatives.
(2) In the exercise of its management powers, the Regional Agricultural Administration is responsible for developing cooperative democracy and for increasing the participation of cooperatives in the management of cooperative organisations, for increasing material interest in the results of production and for promoting better forms of remuneration.
Relationship of district agricultural administration to communities of individual farmers
The Regional Agricultural Administration shall assist the community of individual farm farmers, in which the conditions for a gradual transition to socialist forms of farming, in ensuring their agricultural production and in coordinating the development of cooperative relations between the communities of individual farmers and managed organisations are formed.
Responsibility for the activities of the district agricultural administration
The Director of the Regional Agricultural Administration shall be responsible for the performance of the tasks and for the proper performance of the activities of the Regional Agricultural Administration of the Regional Agricultural Administration.
Scope and tasks of regional agricultural administrations
The Regional Agricultural Administration shall manage and ensure the development of agricultural production and agricultural services in the region in accordance with the needs and interests of society expressed in the national economic plans.
The Regional Agricultural Administration shall carry out the following tasks within the scope of Article 7:
(a) in the area of national economic planning
1. develop long-term concepts, proposals for medium-term and implementing plans for the development of agricultural production and agricultural services in the region, including analyses and justifications, and submit them to the Ministry and to other bodies according to specific regulations;
2. carry out a systematic analysis of the state and development of agriculture in the region; ensure that internal resources and reserves are detected and used effectively;
3. organise and methodically manage the development of medium-term and implementation plans for the development of agricultural production and agricultural services by district agricultural administrations;
4. Describes the tasks of the plan and the indicative indicators set by the Ministry for each district agricultural administration and directly managed organisations, 9)
5. checks the implementation of the plans for the development of agricultural production and agricultural services of district agricultural administrations;
(b) on the economic
1. ensure the use of economic instruments within the region and monitor how these economic instruments contribute to the development of agricultural production and agricultural services; it also controls the provision of special-purpose subsidies and subsidies by district agricultural administrations,
2. to rationalise the development of agricultural production and agricultural services and to ensure that investment and other funds within the region are efficiently used;
3. facilitate the development of cooperation and integration relations in the region in order to ensure the concentration and specialisation of agricultural production and the social division of labour between agricultural and food industry organisations; submits an opinion to the Ministry on the contracts for the establishment of a common agricultural (agro-chemical) undertaking in which the approval of that Ministry is required in order to conclude in force, 10)
4. examine the proposals for the determination of the prices of products, works and services [Paragraph 2 (c) (1)] and submit them with its observations to the relevant price authority;
5. evaluate the application of the principles of remuneration for work in the county and analyse their effectiveness;
(c) in the area of a single system of socio-economic information
1. operate and supervise the activities of district agricultural administrations in increasing the level of socio-economic information managed by their organisations;
2. Organises the activities of district agricultural administrations in implementing the single information system methodology;
3. centrates, processes and evaluates the socio-economic information identified through it;
4. Focusing on supporting documents and processing periodic operational and comprehensive analyses for agricultural production, purchase and services from a production and economic point of view; regularly evaluate the breakdown activity and control of the implementation of the agricultural production plan and agricultural services;
5. Provides, through district agricultural administrations, the removal of deficiencies which it itself has identified in organisations managed by it or which have been brought to the attention of statistical, financial and other control authorities;
6. cooperate with national statistics, financial authorities and other authorities in extraordinary statistical and other investigations;
(d) in the agricultural production development sector, it helps regional agricultural administrations in the development of agricultural production, in particular in increasing the production of cereals and feedingstuffs, including the creation of the necessary reserves, in increasing the performance of livestock and in organising and coordinating the zootechnical, veterinary and breeding services;
(e) technical development and investment construction
1. Helps regional agricultural administrations to implement national technical and investment policies and the latest knowledge of science and technology in organisations managed by them and checks how district agricultural administrations perform these tasks,
2. ensure the implementation of investment policy within the region according to the relevant legislation;
3. checks compliance with the requirements during the special-purpose and residential investment construction, in particular the rules on building regulations, documentation of buildings and property records;
4. Expresses itself on the requirements of district agricultural administrations for the allocation of balance sheet machinery and technological equipment in terms of the objectives of the development of agricultural production and agricultural services;
(f) on the material technical supply and customer relations section
1. produce documentation to ensure the needs of centrally managed machinery and materials in the region;
2. Distributes to regional agricultural administrations, as instructed by the Ministry, centrally managed machinery and materials, including the central fund of feedingstuffs, seed and seed from balance sheet reserves,
3. coordinate supply-customer relations within the region;
g) on the section of cadre and personnel work, education and care for workers
1. ensure the application of the principles of cadre and personnel work and, in accordance with them, directs and controls the selection, education, evaluation and effective deployment of workers, including the cadre reserves;
2. Coordinates and methodically manages the application of the principles of cadre registration and single records of workers;
3. ensure reproduction of the workforce, prepare plans for the needs of skilled workers, methodically guide youth acquisition, training and further training of workers;
4. Directs the development of workers' initiative and activity and their participation in management; facilitate the development of the improvement movement and the use of its results in practice;
5. manage and coordinate the care of workers, including safety and health at work;
(h) in the legal assistance section, provide legal assistance to district agricultural administrations, coordinate and methodically manage their activities on that section;
(ch) on the control section
1. Checks the activities of district agricultural administrations, in particular how they comply with the regulations on national economic planning, wage, price and financial regulations, and with the rules on the management of national assets, on safety and health at work and other regulations; if it finds that the legislation has been infringed, it shall give the competent authority an incentive to exercise material, disciplinary or criminal liability or, where appropriate, to take other measures to remedy it by virtue of legislation,
2. carry out periodic farm reviews for district agricultural administrations;
(i) State defence, state, economic and professional secrecy and fire protection
ensure the tasks arising from the state defence legislation, the protection of state, economic and professional secrecy and fire protection, and monitor how the district agricultural administrations perform the tasks set out in those regulations.
(11) The Regional Agricultural Administration shall exercise the same competence as the Regional Agricultural Administration towards its managed organisations in respect of the Socialist Agricultural Organisations whose management has been entrusted to it by the Minister of Agriculture and Nutrition;
Responsibility for the activities of the Regional Agricultural Administration
The Director of the Regional Agricultural Administration shall be responsible for carrying out the tasks and proper performance of the Regional Agricultural Administration of the Minister for Agriculture and Nutrition.
Relationship of regional and regional agricultural administrations to national committees
(1) Regional and regional agricultural administrations (hereinafter referred to as "agricultural administrations") discuss their long-term concepts and proposals for medium-term and implementation plans, including the requirements to ensure the needs and services of agriculture, which the national committees provide directly. These concepts and plans serve as a basis for the National Committees to organise the planned development of economic, cultural, health and social construction within their territories.
(2) Agricultural administrations are based on binding opinions from regional national committees in planning work.
(1) Agricultural administrations cooperate with national committees in the exercise of their responsibilities. In the framework of this cooperation, the agricultural administration shall in particular:
(a) in the field of protection of the agricultural land fund, give opinions on applications for approval of proposals for territorial plans and applications for the withdrawal of agricultural land from agricultural production;
(b) in the field of plant protection, cooperate in the inspection, as users of land or, where appropriate, in the storage of plant products or products of plant origin, carry out protection and measures against pests, plant diseases and weeds and give an opinion on applications for consent to the felling of healthy grown fruit trees in integrated plantings and to grubbing up of healthy vineyards;
(c) in the field of veterinary care, cooperate in the provision of tasks and supervision of the performance of those tasks, the organisation of measures to combat diseases and other animal diseases and the implementation of measures to ensure the health of food and raw materials of animal origin;
(d) in the field of agricultural cooperatives, they shall cooperate with the supervisory authorities (12) on the activities of uniform agricultural cooperatives and the persuasion of the cooperative authorities (13) to correct their defective resolutions and measures;
(e) in the field of hunting, they shall comment on applications for the authorisation of the reduction of game stocks where such reduction is in the interest of agricultural production;
(f) in the field of fishing, they shall give an opinion on the proposals for the investor's obligation to build a replacement pond and on the allocation of ponds that are not sufficiently used by ponds - not for national property - in the free use of the socialist organisation.
(2) Agricultural administrations provide the national committees with the necessary documentation for regional plans.
(3) Regional agricultural administrations work closely with the national committees to ensure agricultural production by individual farmers and to draw up relevant documents for the national committees.
(1) Agricultural administrations cooperate with national committees to ensure the development of agricultural production and agricultural services in managed organisations. The aim of this cooperation is also to ensure consistency of agricultural growth with the overall development of the territorial districts of the national committees.
(2) Agricultural administrations take advantage of the initiatives of the national committees, examine their findings of deficiencies in managed organisations, remedy and report to the national committees.
(3) The District National Committee has expressed its views on the proposal to appoint the Director of the Regional Agricultural Administration and the Regional National Committee to appoint the Director of the Regional Agricultural Administration.
Final provisions
This Regulation shall enter into force on 1 January 1974.
