DECLARATION
of 21 May 2010
amending Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended
The Ministry of Agriculture provides, pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll. and Act No. 227 / 2009 Coll., to implement § 27b (7) (d) and § 64 (6) of the Veterinary Act:
Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence for certain professional veterinary activities, as amended by Decree No. 610 / 2004 Coll., Decree No. 330 / 2005 Coll., Decree No. 8 / 2007 Coll., Decree No. 134 / 2007 Coll. and Decree No. 21 / 2009 Coll., are amended as follows:
1. In Article 4 (5), the part of the sentence behind the semicolon, including the semicolon, is deleted.
2. Paragraph 5 (2) and (3) are deleted and paragraph 1 is deleted.
3. Paragraph 18, including the title, reads:
Professional veterinary activities carried out by private veterinary techniques
Private veterinary technician shall be entitled to carry out:
(a) castration of male animals under 7 days of age in pigs and under 8 weeks of age in bovine, ovine, caprine or rabbit not suffering from an anatomical defect in sex organs;
(b) the shortening of tails in piglets under 7 days, lambs and puppies under 8 days,
(c) defrosting or controlling the growth of horns in calves and kids aged up to 4 weeks by chemical cauterization, heat cauterisation by an apparatus which develops the necessary heat for at least 10 seconds;
(d) treatment and treatment of healthy hooves and hoof of animals;
(e) removal of spurs, ridges, last wing cells, shortening of beaks, claws, trimming of interpheres during the first day of life of poultry, removal of claws and shortening of the upper part of the beak in musk ducks up to 21 days of age;
(f) dressing of teeth of suckling piglets;
(g) the cauterisation of the beaks of fowl less than 10 days old intended for the production of table eggs;
(h) simple surgical procedures which do not require the overall numbness of the animal;
(i) the marking of animals;
(j) preparation, management and assistance in the delivery of animals with normal course;
(k) the administration of baths and spraying not subject to veterinary prescription or prescribed by the veterinarian for such treated animals;
(l) the administration of veterinary medicinal products to animals, unless they are bound by or prescribed by the veterinarian for such animals,
(m) the adjustment and operation of veterinary devices;
(n) physiotherapy of animals. ';
4. In Paragraph 29 (1), the words "in agreement with the Chairman of the Central Commission for Animal Protection 'are deleted; after the word" administration', the comma is replaced by the words "and 'and the words' and the Central Commission for Animal Protection. One of the members of the test committee is always a representative of the Central Commission for Animal Protection 'shall be deleted.
5. In Paragraph 29a, the word "applicable 'is replaced by" applicable'.
6. In Article 29a, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) For university graduates who have achieved an education during at least five years of daily theoretical and practical study in a master's study programme in the field of veterinary medicine (12), the organiser organises specialised training aimed at investigating wild game bodies in accordance with the directly applicable European Union Regulation on specific hygiene rules for animal food (13) relating to the investigation of wild game bodies by a trained person within the 5 hours of theoretical teaching.
12) Paragraph 59 (1) and (2) of Act No. 166 / 1999 Coll., on Veterinary Care and on the Amendment of Certain Related Acts (Veterinary Act), as amended.
13) Annex III, Section IV, Chapter I, point 4 (c) and (d) of Regulation (EC) No 853 / 2004 of the European Parliament and of the Council. ';
7. Paragraph 29b (2) reads as follows:
"(2) The test referred to in paragraph 1 shall take the form of a written test. The test is compiled by random selection of individual test questions prepared by the organizer from the field of specialised training according to § 29a. Three possible answers are assigned to each question, more of which may be correct. Each correct answer is evaluated by 1 point. The test result decided by the Test Panel on the basis of the points obtained from the written test shall be assessed at the stage: the test is taken, the test not taken. A minimum of 75% of correct responses are required to evaluate the degree. A report shall be drawn up by the Chairman of the Test Panel on the result of the test. Test from specialized training according to
(a) Paragraph 29a (1) shall contain a total of 60 questions and a period of 60 minutes shall be fixed to carry out the test;
(b) Paragraph 29a (2) shall contain a total of 40 questions and a period of 40 minutes shall be fixed for the examination. "
8. In Article 29c (1), the words "paragraph 1 'shall be inserted after the words" Article 29a'.
9. In Paragraph 29c, the following paragraph 2 is inserted after paragraph 1:
"(2) The organiser to verify the knowledge of a trained person obtained by specialised training under § 29a (2) shall organise further training within 4 hours of theoretical instruction in the field of specific hygiene rules for food of animal origin (13) relating to the investigation of bodies caught by wild game by a trained person, which shall be completed by the trained person within 5 years of the previous examination. The organizer shall determine the date and place of the examination. ';
Paragraphs 2 to 6 shall become paragraphs 3 to 7.
10. in Article 29c (3), the words "and 2" shall be inserted after the words "1."
11. in Article 29c (4):
"(4) The test referred to in paragraph 3 shall take the form of a written test. The test shall be drawn up by random selection of individual test questions prepared by the organiser from the field of specialised training referred to in paragraphs 1 and 2. Three possible answers are assigned to each question, more of which may be correct. Each correct answer is evaluated by 1 point. The test result decided by the Test Panel on the basis of the points obtained from the written test shall be assessed at the stage: the test is taken, the test not taken. A minimum of 75% of correct responses are required to evaluate the degree. A report shall be drawn up by the Chairman of the Test Panel on the result of the test. Test from specialized training according to
(a) paragraph 1 shall contain a total of 45 questions and a period of 45 minutes shall be fixed for the examination;
(b) paragraph 2 shall contain a total of 30 questions and a period of 30 minutes shall be fixed for the completion of the test. "
Efficacy
This Decree shall take effect on the first day of the second month following its publication.
