DECLARATION
of 21 June 2007
amending Decree No. 381 / 2001 of the Ministry of the Environment Coll., laying down the Waste Catalogue, List of Hazardous Waste and List of Waste and States for the purpose of exporting, importing and transporting waste and the procedure for granting consent to the export, import and transit of waste (Waste Catalogue), as amended by Decree No. 503 / 2004 Coll.
The Ministry of the Environment provides pursuant to § 5 (3) and § 55 (6) of Act No. 185 / 2001 Coll., on waste and on the amendment of certain other laws, as amended by Act No. 320 / 2002 Coll., Act No. 188 / 2004 Coll. and Act No. 314 / 2006 Coll.:
Decree No. 381 / 2001 Coll., establishing the Waste Catalogue, List of Hazardous Waste and List of Waste and States for the purpose of export, import and transit of waste and the procedure for granting consent to export, import and transit of waste (Waste Catalogue), as amended by Decree No. 503 / 2004 Coll., is amended as follows:
1. in Article 2 (1), the following point (f) is inserted after point (e):
"(f) the waste from car racing is classified under the catalogue numbers in subgroup 16 01. Where a catalogue number is not indicated in sub-group 16 01 for auto-train waste, it shall be followed in the manner set out in points (a), (b) and (d), '.
Points (f) and (g) shall be renumbered as points (g) and (h).
2. In Article 2 (3), "5 'is replaced by" 6'.
3. In Article 2, the following paragraph 5 is added:
"(5) The operator of the auto-train collection facility shall classify the accepted auto-train under catalogue number 16 01 04 *. The auto-processing plant, classified under catalogue number 16 01 04 *, can be transferred by the car manufacturer after the removal of all dangerous substances and the exclusion of dangerous properties to another car-processing plant under catalogue number 16 01 06. '
4. Point II (1) of Annex 3 reads as follows:
"1. When transporting waste from the Czech Republic
(a) when submitting the notification, the notifier shall complete:
1. on the notification form of boxes 1 to 23, including the signature in box 23,
2. in the movement / monitoring form, boxes 1, 2, 8, 9, 13 to 16, 19, 20; the notifier's declaration referred to in box 22 shall not be signed.
(b) Where the notifier receives all the necessary consent from the competent authorities concerned, he shall take as many copies of the movement / monitoring form as the planned number of shipments indicated in box 4 of the notification form and shall add the serial numbers of the planned shipments to box 4 of those copies of the movement / monitoring forms.
(c) Before transporting the consignment, the notifier shall complete boxes 5, 6, 7, 17, 18 and 21 in the copy of the movement / monitoring form for the consignment concerned and sign the declaration in box 22. If more than 3 carriers are involved in the shipment, an annex shall be attached to the movement / monitoring form, which shall include the information required in boxes 5 and 10. A copy of this copy shall be sent to all the competent authorities concerned no later than 3 working days before the shipment of the consignment. The completion of the movement / monitoring form with the signatures made out in the original shall accompany the consignment to the disposal or recovery facility. ';
5. In Annex 3, point II, point 2 (b), the last sentence is deleted.
Efficacy
This Decree shall take effect on the 15th day following its publication.
