THE LAW
of 25 March 2004
amending Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 347 / 1992 Coll., Act No. 289 / 1995 Coll., the Constitutional Court found published under No. 3 / 1997 Coll., Act No. 16 / 1997 Coll., Act No. 123 / 1998 Coll., Act No. 161 / 1999 Coll., Act No. 238 / 1999 Coll., Act No. 132 / 2000 Coll., Act No. 76 / 2002 Coll. and Act No. 320 / 2002 Coll., is amended as follows:
1. Paragraph 6, including the title and footnote 4b, reads:
Registration of significant landscape elements
(1) The decision to register a significant landscape element is issued by the nature protection authority. The party to the proceedings shall be the owner of the land concerned. The marketing authorisation shall also be notified to the lessee of the land concerned, to the competent building office and to the municipality.
(2) The decision referred to in paragraph 1 shall, in addition to the formalities laid down in the general rules on administrative management (4b), always indicate the definition of an important landscape element and the lessons learned about the legal consequences of registration (§ 4 (2)).
(3) The decision referred to in paragraph 1 may be revoked by the authority which has decided to register only in the case of public interest.
4b) Act No. 71 / 1967 Coll., on Administrative Procedure (Administrative Regulations), as amended. '
2. In the first sentence of Article 90 (1), the words "Article 6 'are deleted.
Efficacy
This Act shall take effect on the day of its publication.
