THE LAW
of 4 April 2001
on the highway bypass of Pilsen
Parliament has decided on this law of the Czech Republic:
Motorway bypass Pilsen
(1) All buildings within the framework of the construction of the motorway D5 in the Ejpovice - Sulkov section as defined in Annex 2 to the Government Decree No. 104 / 1994 Coll., declaring a binding part of the urban plan of the large area of the Pilsen regional conurbation (highway bypass of Pilsen) are of public interest.
(2) Administrative procedures carried out by the administrative authorities in respect of the construction of the bypass are public-interest procedures.
(1) In all administrative proceedings relating to the construction of the bypass, the management deadlines laid down by special legislation2) shall be halved. If the period is given by an odd number of days, it shall expire on the day following that on which half the period falls.
(2) In the procedure for the issue of a building permit, the competent building authorities shall not require opinions from those authorities concerned which have submitted their opinions in the territorial proceedings on the construction of the bypass.
(3) The administrative procedure concerning the construction of the bypass cannot be interrupted
(a) for the reasons set out in § 137 (1) and (2) of the Construction Act,
(b) to initiate the preliminary ruling procedure provided for in Article 29 (1) of the Administrative Regulation;
(c) on the basis of the same proposal by the parties pursuant to Article 29 (2) of the Administrative Rules.
(4) Where the administrative procedure should be interrupted by an assessment of a civil and other objection pursuant to a special rule of law (3) or an assessment of a preliminary question under an administrative order which has not been definitively decided by the competent authority, the competent administrative authority shall take its own judgment on it regardless of the possibility of initiating proceedings in court and shall decide on the objection without delay. The appeal lodged against the decision shall not have suspensory effect.
(5) In the expropriation of land, buildings and rights for the construction of the bypass proceedings (4), failure to reach an agreement under the special legislature4 shall be deemed not to have been concluded within 30 days of the date of receipt of the offer of compensation at least at the rate specified by the expert opinion. The public interest in the expropriation of land, buildings and their rights for the construction of the bypass shall be demonstrated in the expropriation procedure by reference to this law.
Transitional and final provisions
(1) Administrative proceedings initiated before the date of entry into force of this Act shall be completed under this Act. Reducing the time limits for proceedings laid down by special legislation2) by half (Paragraph 2 (1)) shall apply to such administrative proceedings only if there is a period of more than 10 days left on the date of entry into force of this Act. Half of this will only be determined from these remaining days.
(2) Unless expressly provided otherwise in this law, the Road Law and the Administrative Code shall apply to proceedings relating to the construction of the bypass, 5).
Efficacy
This Act shall take effect on the day of its publication.
