GOVERNMENT REGULATION
of 31 May 2000
o Central address
The Government orders the implementation of Act No. 199 / 1994 Coll., on Public Procurement, as amended by Act No. 148 / 1996 Coll., Act No. 93 / 1998 Coll. and Act No. 28 / 2000 Coll., and the Implementation of Act No. 26 / 2000 Coll., on Public Auctions:
§ 1
The publication of information pursuant to Act No. 199 / 1994 Coll., on public procurement, as amended, and Act No. 26 / 2000 Coll., on public auctions, and other information provided by natural and legal persons (hereinafter referred to as "information ') in a publicly accessible information system (Internet) shall be provided by the administrator of a central address which complies with the conditions of this Regulation.
§ 2
Central Address Manager
(1) The administrator of the central address (hereinafter referred to as the administrator) is a legal person with its registered office or a natural person with a permanent residence in the Czech Republic who has technical and organisational conditions for the operation of the central address information system and whose operating rules established under this Regulation are approved by the Office for the State Information System (hereinafter referred to as the Office). There is no legal claim for approval of the operating rules.
(2) The Office shall publish the trade name and address of the administrator in the Trade Bulletin.
(3) The approval of the operating rules by the Office does not replace the authorisation of activities issued by another administrative authority under specific legislation. 1)
§ 3
Operating rules
(1) The operating rules are a summary of the rules followed by the administrator in the provision of the disclosure pursuant to § 1.
(2) In particular, the operating rules shall lay down the dates for the publication of the information provided, the time and manner in which it is kept, the method for determining the price for the disclosure of the information, the manner in which the public is regularly informed of the current postal and Internet address of the administrator and the manner in which the public is informed of the prices for the disclosure of the information.
(3) The price of disclosure may be the highest price normally, including economically reasonable costs and reasonable profit.
(4) The operational rules shall be approved by the Office for a fixed period of time upon written request.
§ 4
(1) The natural and legal persons shall send the information to the AIFM in writing.
(2) Information may be sent by electronic means to AIFMs provided that the integrity of the information is ensured and that the applicant for disclosure can be reliably identified. Where Internet e-mail is used, the information shall be electronically secured.
§ 5
This Regulation shall enter into force on the day of its publication.
