GOVERNMENT REGULATION
of 25 June 1997
laying down technical requirements for low voltage electrical equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts (hereinafter referred to as "the Act") to implement Sections 12 (1) and (4) and 13 (2) and (4) of the Act:
§ 1
(1) This Regulation lays down technical requirements for low-voltage electrical equipment, in accordance with the law of the European Communities (1) and the international contract (2).
(2) For the purposes of this Regulation, any device intended for use in the range of rated voltages from 50 V to 1000 V AC and rated voltages from 75 V to 1500 V DC, with the exception of the equipment and phenomena listed in Annex 1 to this Regulation, shall be regarded as an electrical device.
(3) The specified products under Section 12 (1) of the Act are electrical equipment.
§ 2
(1) The technical requirements for electrical equipment are set out in Annex 2 (hereinafter referred to as "essential requirements").
(2) Where essential requirements are specified
(a) harmonised Czech technical standards;
(b) specified standards;
(c) technical standards transposing harmonised European standards, foreign technical standards or documents in European Union States;
(d) the safety provisions of the technical standards of the International Organisation for Electrotechnical Standardisation (IEC) or of the International Commission for Regulations for the Approval of Electrical Products (CEE) where the standards referred to in (a), (b) or (c) do not exist or specify all the essential requirements; or
(e) Czech technical standards where there are no technical standards referred to in (d)
and the characteristics of the electrical equipment are consistent with them, it is considered that the essential requirements are met.
§ 3
(1) Before placing electrical equipment on the market, the manufacturer or importer shall carry out or ensure an assessment of the conformity of electrical equipment with all essential requirements ("conformity assessment ') in accordance with the procedure set out in Annex 4 to this Regulation and shall proceed in accordance with Section 5a.
(2) In the event that a safeguard procedure has been initiated under the Special Act, 2a) and if the manufacturer or importer so requests, the authorised person (Paragraph 11 (1) of the Act) shall report to him whether the electrical equipment complies with the essential requirements.
(4) At the request of the competent authority of the European Community, the authorised person shall give an opinion indicating in which of the electrical equipment specified in the application does not meet the essential requirements.
§ 4
The evidence of conformity assessment carried out (Section 13 (8) of the Act) acquired by the manufacturer or importer shall include the technical documentation, the content of which is set out in point 5 of Annex 4 to this Regulation. In cases resulting from Paragraph 13 (8) of the Act, the importer shall submit to the supervisory authority documentation in the language of one of the Member States of the European Union or in a language agreed with the supervisory authority.
§ 5a
(1) In the case of electrical equipment meeting the requirements of this Regulation, the manufacturer shall place the CE3 marking on the electrical equipment and draw up the EC declaration of conformity in accordance with Annex 3 to this Regulation. The CE marking shall be placed on each electrical device or, if this is not possible, on the packaging, the instructions for use or the warranty sheet in such a way that it is visible, easily legible and indelible.
(2) An electrical device, its packaging, instructions for use or a warranty sheet may be affixed to a marking other than the CE marking only if the visibility and legibility of the CE marking are not thereby reduced.
(3) If electrical equipment is also subject to other government regulations which relate to other requirements and also provide for the location of the CE marking, the CE marking shall also indicate compliance with the provisions of those other government regulations.
(4) However, if one or more of these government regulations allow the manufacturer, for a transitional period, to choose which provisions it will comply with, the CE marking shall only be in conformity with those provisions of the government regulation used by the manufacturer. In this case, the accompanying documentation, warnings or instructions required by the relevant government regulations and attached to electrical equipment shall include a list of the government regulations used.
§ 6
For electrical equipment which will be placed on the market during the period from the date of entry into force of this Regulation until 31 December 1997, their manufacturer or importer may obtain the technical documentation referred to in points (d) and (e) of Article 4 and no later than 31 December 1997.
§ 7
This Regulation shall enter into force on 1 September 1997.

Annex No 2 to Decree No. 168 / 1997 Coll.
ESSENTIAL REQUIREMENTS FOR ELECTRIC DEVICES
1. General requirements
(a) The essential technical characteristics, the observance of which ensures that the electrical equipment is used completely safely and in the conditions for which it was manufactured, shall be indicated on the device or, if this is not possible, in the accompanying documentation.
(b) The name and surname of the natural person or trade name of the legal person who is the manufacturer shall be clearly indicated on the product and, if not possible, on the packaging.
(c) the electrical equipment and its components shall be so manufactured as to ensure safe and easy installation and connection.
(d) Electrical equipment shall be so designed and constructed that, provided it is used for the purposes for which it is intended and properly maintained, protection against the hazards referred to in points 2 and 3 is ensured.
2. Protection against hazards which may cause electrical equipment
Within the meaning of point 1, the technical design of the electrical equipment shall be such as to ensure that:
(a) persons and domestic and farm animals are adequately protected from the risk of injury or other damage which could be caused by an electrical current when touching live or inanimate parts;
(b) there shall be no dangerous temperatures, no dangerous arches or no dangerous radiation;
(c) persons, domestic and farm animals and property shall be adequately protected from the dangers of non-electrical nature which, according to experience, may cause electrical equipment;
(d) the insulation shall comply with foreseeable conditions.
3. Protection against hazards that may arise from external effects on electrical equipment
Within the meaning of point 1, the technical design of the electrical equipment shall be such that:
(a) resist the anticipated mechanical stress in such a way that persons, domestic and farm animals and property are not threatened;
(b) resist, under the foreseeable conditions of the environment, the effects of non-mechanical influences to the extent that persons, domestic and farm animals and property are not threatened;
(c) in the event of foreseeable overloads, there is no risk to persons, domestic and farm animals or property.

EC CONFORMITY DECLARATION
The EC declaration of conformity shall include:
(a) identification of the electrical equipment manufacturer;
(b) identification details of the authorised representative, if any;
(c) a description of the electrical equipment;
(d) a reference to harmonised standards;
(e) where applicable, references to technical specifications [Paragraph 2 (f) (1) of the Act] with which conformity is declared;
(f) identification details of the signatory who is authorised to accept commitments on behalf of the manufacturer or authorised representative;
(g) the last two digits of the year in which the CE marking was affixed to the product.

INTERNAL CONTROL OF PRODUCTION
1. Internal control of production is a conformity assessment procedure whereby a manufacturer who fulfils the obligations referred to in points 2 and 3 ensures and declares that the electrical equipment complies with the requirements of this Regulation which apply to it.
2. The manufacturer shall draw up the technical documentation described in point 5.
3. The manufacturer shall keep the technical documentation available to the supervisory authority for surveillance purposes for at least 10 years after the end of the production of the electrical equipment.
5. The technical documentation shall make it possible to assess the conformity of electrical equipment with the requirements of this Regulation. It shall include, to the extent necessary for this assessment, data on the design, manufacture and functioning of the electrical equipment. It shall contain:
(a) a general description of the electrical equipment;
(b) design and production drawings and diagrams of components, sub-assemblies, circuits, etc.,
(c) descriptions and comments necessary for the clarity of drawings and diagrams and functions of electrical equipment;
(d) the list of documents referred to in Article 2 (2) which have been used in whole or in part and, where such documents have not been used, the descriptions of the solutions adopted to meet the essential requirements shall be given;
(e) the results of the design calculations carried out, tests carried out, etc.,
(f) test reports.
6. The manufacturer shall keep with the technical documentation a copy of the EC declaration of conformity.
7. The manufacturer shall take all necessary measures to ensure that the production process ensures compliance of the electrical equipment produced with the technical documentation referred to in point 2 and with the requirements of this Regulation applicable to it.
1) Council Directive 73 / 23 / EEC of 19 February 1973 on the harmonisation of the laws of the Member States relating to electrical equipment intended for use within certain voltage limits, as amended by Council Directive 93 / 68 / EEC.
2) For example, the Protocol to the Europe Agreement establishing an Association between the Czech Republic, of the one part, and the European Communities and their Member States, of the other part, on Conformity Assessment and Acceptance of Industrial Products (PECA), published under No 56 / 2001 Coll.
2a) For example § 7a (1) (a) and (b) of Act No. 64 / 1986 Coll., on Czech Trade Inspection, as amended by Act No. 22 / 1997 Coll. and Act No. 205 / 2002 Coll.
3) Government Decree No. 291 / 2000 Coll., laying down the graphic form of the CE marking.
