Decree of the Government of the Czechoslovak Socialist Republic on compensation for damage caused by military education

on compensation for damage caused by professional training
The Government of the Czechoslovak Socialist Republic orders, pursuant to § 24 paragraphs 1 and 4 of Act No. 73 / 1973 Coll., on professional education:
§ 1
(1) In the performance of or directly related to the tasks of professional training, participants in professional training who suffer from an accident or an occupational disease which has resulted in them becoming disabled or persons with altered working capacity, in the course of training under particularly dangerous conditions with explosives, chemical, radioactive and other highly dangerous substances, are subject to temporary exceptional compensation in addition to compensation under labour law.
(2) One-off exceptional compensation shall be granted in the amount of between 5000 and 25 000 CZK, taking into account the degree of permanent damage to the health and personal, family and social circumstances of the injured party.
§ 2
(1) If a member of a professional education has died from damage to the health of an accident or occupational disease arising under the conditions laid down in Article 1 (1), his spouse and the children entitled to an orphan's pension shall be increased to twice the amount of compensation due to them under labour law. In justified cases, one-off compensation may also be increased to the parents of the deceased.
(2) Persons who have been fed to a member of a professional education, deceased as a result of an accident or occupational disease arising under the conditions set out in Paragraph 1 (1) may, where justified, receive one-off compensation of up to 3000 CZK.
§ 3
The compensation provided for in paragraphs 1 and 2 shall be provided by the organisation carrying out the branch education in which the damage to health has occurred, to the extent that it is responsible for the damage.
§ 4
The surviving spouse referred to in § 2 may, in cases of special consideration, grant a contribution equal to the one-off compensation of survivors under labour law, even if he is not responsible for the damage.
§ 5
In order to determine the amount of compensation for damage caused to the organisation in the performance of the tasks of professional education or in direct connection with it by a participant in professional education which is not in work or other similar relationship, the average monthly earnings under labour law shall be taken to be CZK 300.
§ 6
This Regulation shall enter into force on 1 February 1974.
