Decree of the Government of the Czechoslovak Republic on the temporary prohibition of price increases

on the temporary prohibition of price increases
For the implementation of Act No. 83 / 1966 Coll., on the fourth Five-Year Plan for the Development of the National Economy of the Czechoslovak Socialist Republic, the Government of the Czechoslovak Socialist Republic sets out the following principles for the temporary prohibition of increasing the level of prices and prices of individual products:
§ 1
Basic provisions
(1) The effective date of this Regulation may be negotiated and charged only:
(a) wholesale prices valid on 1 January 1969;
(b) retail prices in force on 30 June 1969;
(c) buying-in prices valid in 1969, including the allowances fixed for 1970;
as maximum admissible prices;
(d) price increases for deviations from the delivery conditions where those conditions are indicated in the price lists in force or in price decisions.
(2) Exemptions from the provisions of paragraph 1 become the maximum admissible prices
(a) prices valid on the date of application of this Regulation, provided that they are determined in accordance with the terms of the agreements on the development of prices concluded in accordance with Section 14 of Decree No 47 / 1967 Coll., on prices; the provisions of these agreements allowing price increases shall not apply during the period of validity of this Regulation;
(b) prices whose amendments have taken effect after 1 January 1969, as decided by the central price authorities;
(c) the prices of new products, works, services and activities (hereinafter referred to as "products") laid down under the applicable rules;
(d) the highest seasonal (local) prices reached in 1969 for products with different prices according to the annual period and, where appropriate, the point of sale;
(e) the prices in force on the date of application of this Regulation for products reclassified on that date from free prices, unless they fall under point (d).
(3) The provisions of the preceding paragraphs shall also apply to the accounting of prices and surcharges agreed in the economic contracts before the date of application of this Regulation.
(4) The provisions of the preceding paragraphs shall not apply to products classified as free prices according to the lists issued by the national price authorities.
(5) The rates and, where applicable, the amounts of the trade margin of trade organisations, including foreign trade organisations, and sales, supply and purchasing organisations shall become at the maximum permissible at the date of application of this Regulation.
§ 2
Values
The branch directorates and similar bodies (hereinafter referred to as the "branch directorates') shall issue price lists for the products referred to in Article 1 (2) (a), (d) and (e) and for products classified in the category of guide prices and tariff lists and, where applicable, the amounts referred to in Article 1 (5), and shall submit them to the national price authority responsible for the registered office by 15 February 1970 at the latest. The prices of the products of the local economy, production cooperatives and private producers shall be presented by the relevant national committees within the same time limit in the Czech Socialist Republic to the Regional National Committee, in the Slovak Socialist Republic to the Regional National Committee.
§ 3
Price formation
(1) The rules governing the pricing of new products must ensure that the price level given by the maximum permissible prices pursuant to Article 1 is not exceeded.
(2) The price formation of new re-produced products may be within the competence of the trade directorates or organisations, where appropriate, only under relatively reliable methods of pricing and the rules referred to in paragraph 1, and in the case of products of a volume insignificant nature.
§ 4
Specific provisions
Where customer organisations receive funds from price reductions when implementing this Regulation, they shall be required to register and deal with them separately, as decided by the competent central authorities.
§ 5
Control and penalty
(1) Organisations and authorities are obliged to comply with the price regulation in accordance with:
(a) the rules on additional levies, *)
(b) the Labour Code as regards the imposition of disciplinary measures on workers who have infringed labour discipline by non-compliance with price regulations and the requirement of compensation on the worker for damage caused to the organisation by the violation of price regulations for which the worker is responsible for compliance with the organisation; * *)
(c) rules on the material interest of managers of economic organisations in the reduction or non-recognition of premiums and shares in the economic performance of the organisation, * * *)
(d) criminal rules on suspicion of committing economic offences. +)
(2) Collectors may not pay higher prices than permitted by this Regulation.
(3) Collectors shall report to price control authorities cases where suppliers charge higher prices than permitted by this Regulation.
(4) The price control authorities will examine the cases reported and, if the price is exceeded, impose an additional levy of half the difference between the price in force and the price charged.
§ 6
Exceptions
Exemptions from the prohibition of price increases may be allowed only under the conditions laid down by the Government of the Czechoslovak Socialist Republic.
§ 7
Relationship with existing regulations
(1) During the period of validity of this Regulation, those provisions of Decree No 47 / 1967 Coll., which do not comply with this Regulation, and the last sentence of § 3 (1) of Decree-Law No 240 / 1949 Coll., implementing the Postal Law, cannot be applied. Nor can such provisions be applied in price regulations issued by national authorities. *)
(2) Furthermore, the provisions concerning the premium for the reduction of construction deadlines under Decree No. 87 / 1966 Coll., on certain economic measures in investment construction cannot be applied.
(3) For all or parts thereof for which price agreements have not been concluded before the date of application of this Regulation, the possibilities of:
a) conclude agreements on sales prices of buildings or parts of buildings pursuant to § 38 of Decree No. 107 / 1966 Coll., on documentation of buildings,
(b) to draw up tender budgets on the basis of the wholesale prices of works and installations proposed and discussed with the general designer by the budget processor (§ 24 (2) of the same decree - the so-called "B" form of the budget).
§ 8
Efficacy
This Regulation shall enter into force on 1 January 1970.
