of 16 May 2013
amending Act No 549 / 1991 Coll., on judicial fees, as amended
Parliament has decided on this law of the Czech Republic:
In Article 11 of Act No. 549 / 1991 Coll., on Judicial Charges, as amended by Act No. 271 / 1992 Coll., Act No. 36 / 1995 Coll., Act No. 118 / 1995 Coll., Act No. 160 / 1995 Coll., Act No. 209 / 1997 Coll., Act No. 218 / 1997 Coll., Act No. 103 / 2000 Coll., Act No. 155 / 2000 Coll., Act No. 255 / 2000 Coll., Act No. 216 / 2008 Coll., Act No. 217 / 2009 Coll., Act No. 151 / 2002 Coll., Act No. 309 / 2002 Coll., Act No. 192 / 2006 Coll., Act No. 628 / 2004 Coll., Act No. 357 / 2005 Coll., Act No. 72 / 2006 Coll., Act No. 112 / 2006 Coll.
"(v) the appellant, in proceedings for compensation or non-property damage or for the issue of unfounded enrichment, who has duly claimed a claim in criminal proceedings which has been terminated by reason of the President's decision."
Transitional provisions
1. Paragraph 11 (2) (v) of Act No 549 / 1991 Coll., on judicial fees, as effective from the date of entry into force of this Act, shall also apply to proceedings initiated after 1 January 2013.
2. If a court fee has been paid in a case in which the appellant is exempt from judicial fees under this law, the court shall refund the judicial fee paid from the account.
Efficacy
That law shall take effect on the first day of the first calendar month following its publication.
