THE LAW
of 23 March 2005
amending Act No. 90 / 1995 Coll., on the Rules of Procedure of the Chamber of Deputies, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 90 / 1995 Coll., on Rules of Procedure of the Chamber of Deputies, as amended by Act No. 47 / 2000 Coll., Act No. 39 / 2001 Coll., Act No. 78 / 2002 Coll., Act No. 192 / 2002 Coll., Act No. 282 / 2004 Coll., Act No. 359 / 2004 Coll. and Act No. 482 / 2004 Coll., is amended as follows:
1. Paragraph 48 (6) reads as follows:
"(6) The hearing of the committee of inquiry is generally public. On a proposal from a member of the committee of inquiry, the committee of inquiry may decide that the deliberations of the committee of inquiry or part of it are private. It shall do so whenever classified information related to State defence or security or other serious classified information is the subject of an investigation committee's deliberations. ';
2. In Paragraph 48, the following paragraph 7 is inserted after paragraph 6:
"(7) In addition to the members of the committee of inquiry, other persons may take part in the proceedings of the committee of inquiry or part thereof which have been declared to be non-public, provided that they have been approved by the committee of inquiry or provided for by law. ';
Paragraphs 7 to 9 shall be renumbered paragraphs 8 to 10.
3. In Paragraph 48 (8), the words "or parts thereof which have been declared non-public 'shall be inserted after the words" Members of the committee of inquiry and other persons present or present at the hearing of the committee of inquiry'.
4. In Annex No 1, in Article 5 (2), the words "The hearing of the Commission is private and 'are replaced by the words" The hearing of the Commission is public. If the Commission decides that its action or part thereof is private,'.
5. In Annex No 1, in Article 5 (2), the word "non-public 'shall be inserted after the word" present'.
6. In Annex No 1, in Article 6 (1), the words "the Commission shall inform 'shall be replaced by the words" In the event of non-public conduct, it shall inform the Commission'.
7. In Article 11 (4) of Annex 1:
"(4) The minutes, including its annexes, shall be made publicly available and may be made out of extracts and copies. If the proceedings of the Commission or part thereof have been declared non-public, only the members of the Commission shall be entitled to consult the minutes, including its annexes or any other record, and to make extracts and copies thereof. In such cases, the Commission may decide that another person may consult the minutes, including its annexes, or any other record, and make extracts and copies thereof. ';
8. In Annex No 1, in Article 13, the words "Witnesses may be 'shall be replaced by the words" Witnesses may be present in the course of a private hearing or part thereof'.
9. In Article 22 (1) of Annex 1:
"(1) The Commission shall provide the expert with the necessary explanations on the file and define its tasks. If this is the case in cases where the hearing or part of the hearing is not public, the panel shall allow experts to consult the files or lend them to them. In cases where the hearing or part of the hearing is not public, the panel may also allow the expert to be present at the hearing of the person whose hearing is under investigation and witnesses. The Commission may also allow the expert to ask questions relating to the subject matter of the expert opinion to the person whose conduct is the subject of the investigation and to the witnesses. ';

This Act shall take effect on the day of its publication.
