implementing Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence to drive motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll.
The Ministry of Transport and Communications (hereinafter referred to as "the Ministry ') provides pursuant to Article 62 of Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., (hereinafter referred to as" the Act'):

INTRODUCTORY PROVISIONS
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1) and provides for
(a) the method of identification of the training vehicle by type of training vehicle, the method of identification of the training motorcycle crew and the material from which the marking must be produced;
(b) a model application for admission to teaching and training;
(c) the content and scope of each type of teaching and training to be qualified to drive motor vehicles (hereinafter referred to as "the acquisition of a driving licence");
(d) the curriculum of basic training, the way in which the examination is carried out and organised for teaching and training teachers to obtain a driving licence (hereinafter referred to as "teaching and training");
(e) a model professional certificate of teaching and training teacher (hereinafter referred to as "professional certificate"),
(f) the method of keeping a register of teaching and training and keeping records on the applicant's licence;
(g) the syllabus of basic training, the method of carrying out and organising the examination for the examiner and the model of the examiner's certificate;
(h) the curriculum for the improvement of the training of test Commissioners, the scope of the examination and the way in which it is organised;
(i) the number of questions in the road and medical traffic rules test, their scores, the composition of the road and medical traffic rules test, and the minimum number of points required to obtain a driving licence for the relevant group of vehicles;
(j) the extent of the required knowledge for the vehicle control and maintenance test;
(k) a list of the individual knowledge, skills and behaviour and details of the practical driving test requirements;
(l) the particulars of the certificate for supporting the data for continuing teaching and training (hereinafter referred to as "the certificate of the driving school on partial completion of teaching and training").

TRAINING AND TRAINING

HLAVA I

§ 2
Identification of the training vehicle, identification of the motorcycle crew and material of the marking
(Paragraph 11 (2) of the Act)
(1) The training passenger car shall be marked with a lamp of the approved type and design, 1a) bearing on the front and rear sides the inscription "AUTOŠKOLA" and on the left and right side the letter "L." The individual letters in the "AUTOŠKOLA" sign are outside the letter "L" in blue on white background. The letter "L" in the inscription "AUTOŠKOLA" is white on the blue background. The letters "L 'on the left and right side of the lamp are also white on the blue background. The letter height shall be at least 70 mm and the width of the font line shall be at least 12 mm. The marking is placed on the roof of a training passenger car.
(2) The training truck and passenger mass transport training vehicle are marked with a square shape of not less than 300 mm on the side on which the letter "L" with a height of not less than 250 mm and a font width of not less than 30 mm is placed. The surface of the board is blue, the letter "L" is white. The marking shall be placed on the front, rear and both sides of the training vehicle.
(3) The training tractor shall be marked with a cube of at least 250 mm side on which the letter "L 'is placed on all vertical sides of a height of not less than 200 mm and a width of the font line of not less than 30 mm. The surface of the cube is blue, the letter" L "is white. The marking shall be placed on the roof of the training tractor.
(4) The training trailer shall be identified by the pane referred to in paragraph 2 which shall be placed on both sides and on the rear of the trailer.
(5) A vehicle on which training of disabled persons is carried out and which is designed to conform to their physical condition, or a motor three-wheel or four-wheel vehicle with a design speed of not less than 60 km / h-1, the operating mass of which shall not exceed 550 kg, shall be marked either as indicated in paragraph 1 or as indicated in paragraph 2, and the marking referred to in this paragraph shall be placed on the front of the vehicle on the left-hand side and also in the rear of the vehicle or on the left-hand side.
(6) The crew of the training motorcycle shall be identified by a square of at least 250 mm side in which the letter "L ', at least 200 mm high and the width of the font line, is placed at least 30 mm high. The area of the square is blue, the letter" L "is white. The marking shall be affixed to the applicant for a driving licence on his or her breast and to the training teacher on his or her back or to the applicant for a driving licence on his or her back if he / she is travelling without a teacher or, where appropriate, on his or her breast. The designation of the training cycle may be supplemented by a square of at least 125 mm side, in which the letter" L' of a height of not less than 100 mm and a width of the font line of not less than 15 mm is placed. The area of the square is blue, the letter "L" is white.
(7) The letters and the area of the marking of vehicles referred to in paragraphs 1 to 6 are made from retroreflective material of at least Class 1 according to the relevant ČSN.2)

HLAVA II

REQUEST FOR ACCESS TO EDUCATION AND TRAINING, CONTENTS AND SCOPE OF EDUCATION AND TRAINING
§ 3
Application for admission to teaching and training
(Paragraph 13 (6) of the Act)
(1) The application for admission to teaching and training is a bilateral A4 format form. The model of the application is set out in Annex 1.
(2) The first page of the application for admission to teaching and training, in addition to the birth figure, shall be completed by the applicant for a driving licence and by a person certifying compliance with the conditions for admission to teaching and training (6) before admission to teaching and training, and by the driver after acceptance of the applicant for a driving licence for teaching and training. The information on the birth number shall be completed by the applicant for a driving licence only at the time of the application for a driving licence under a specific legislation. (2a) The other party to the application for admission to teaching and training shall be completed by the Examination Commissioner during the proficiency test for motor vehicles.

§ 4
Content and scope of teaching to obtain a driving licence
(1) The training of road traffic regulations includes the following thematic units:
(a) road traffic regulations, 3)
(b) dealing with traffic situations;
(c) regulations relating to road traffic (4) to the extent necessary for a group of vehicles for which the relevant driving licence permits driving;
(d) rules on driving licences and driving licences, 3)
(e) the documents necessary for the operation of the vehicle by category of vehicles in respect of which the relevant driving licence is authorised;
(f) the civil and criminal liability of the driver, the extent and conditions of liability insurance for damage caused by the operation of motor vehicles under specific legislation. 3a)
(2) Vehicle control and maintenance training shall include:
(a) the general description and assembly of the vehicle of the category concerned;
(b) a description of the vehicle's essential systems, their characteristics, purpose, operation and basic maintenance, the principles of their correct use;
(c) the control gear of the vehicle, controls and tell-tales, their location and markings,
(d) the vehicle's basic operating data;
(e) the principles of preventive vehicle maintenance and its importance for the safety and economy of operation and environmental protection;
(f) the procedure for basic maintenance and simple repairs of the vehicle;
(g) the most widespread defects and disturbances occurring on the vehicle and the essential procedures for their detection;
(h) in the case of a person with a physical disability who will drive a vehicle designed to be fit for health, the instruction on the control and maintenance of a vehicle with a design adapted to the condition of a disabled person shall be made to the extent specified in (a) to (g).
(3) Teaching management theory and safe driving principles includes the following thematic units:
(a) factors affecting road safety;
(b) the influence of alcohol, drugs, medicines, the state of mind and fatigue on driver behaviour;
(c) regulations governing driving time and rest periods;
(d) the issue of the interaction between road users (transport ethics);
(e) the specific risks arising from the lack of experience of other road users and the most vulnerable categories of road users, such as children, pedestrians, cyclists and severely disabled persons, and the specific risks arising from reactions by disabled drivers who drive vehicles that are designed to be affected;
(f) the impact of the technical condition of the vehicle on driving safety;
(g) rules concerning the use of vehicles with regard to the environment;
(h) the basic physical conditions of running the vehicle;
(i) basic driving skills procedures for vehicle starting, gear shift, brake use, stopping and reversing;
(j) the most important principles concerning the monitoring of the safe distance between vehicles, tyre grip and braking track, depending on the adhesion conditions;
(k) driving with trailer, towing vehicles;
(l) the storage and transport of the cargo;
(m) risk factors for the driving of a vehicle in different situations, under different weather and climatic conditions, the effect of weather change, daytime and night hours;
(n) the characteristics of the different types of communications and crisis situations;
(o) periods of perception, assessment, decision-making and response, principles of predictability, recognition and resolution of critical situations;
(p) analysis of the causes of accidents;
(r) vehicle safety devices, in particular the use of safety belts and restraint systems, active and passive safety factors relating to the vehicle and persons carried;
(s) driving a vehicle equipped with electronic information, warning and control systems to control the vehicle;
(t) familiarisation with the integrated rescue system;
(u) familiarisation with the principles needed for reading on the road map;
(v) familiarisation with the basic operations at the scene of the accident in relation to road safety, including the principles for the use of the reflective vest, warning triangle and other marking of the location of the accident.
(4) Teaching medical training includes the following thematic subjects:
(a) prevention of accidents due to health reasons;
(b) general principles of conduct in road accidents;
(c) the principles of first aid and the provision of first aid for individual injuries;
(d) life-threatening conditions;
(e) the possibilities and methods of using the individual medical devices provided by the vehicle's first aid kit.
§ 5
Content and scope of practical training to obtain a driving licence
(1) Practical driving training is carried out in three consecutive stages and adapted to the relevant vehicle group. Training is focused
(a) in the first stage to carry out the vehicle check before driving and the driver's basic operations before driving, training and handling of the essential driving skills necessary for steering wheel or handlebar, pedal or accelerator handle, clutch, gear, service and parking brake;
(b) in the second stage for the exercise of basic driving skills acquired in urban and out-of-town traffic with low traffic density of vehicles with emphasis on compliance with road traffic regulations and safe driving principles, higher speed driving, training and handling of other driving skills in different traffic situations, control of vehicle equipment and equipment such as windscreen wipers, demisting, air conditioning or lighting of the vehicle, for its safe operation and for reduced visibility;
(c) in the third stage to achieve full autonomy in driving a vehicle in heavy urban and extra-urban traffic, in different categories of infrastructure, in driving a vehicle under difficult conditions, in dealing with complex transport conditions and traffic situations and in reduced visibility.
(2) Practical vehicle maintenance training is focused on:
(a) the training of the individual operations of the vehicle's basic maintenance, the control and treatment of the vehicle's essential systems and the addition of fuel;
(b) compliance with the principles of safety of work and the use of technical equipment in the performance of individual maintenance, treatment and repair tasks of the vehicle;
(c) testing for detection and removal of simple defects and defects on the vehicle;
(d) the replacement of the wheel;
(e) basic operations necessary to ensure the illumination of the vehicle, such as the replacement of filament lamps, fuses, etc.,
(f) connection of towing rope or towing rod,
(g) knowledge of the location of the mandatory equipment elements in the vehicle and how they are to be used, including practical skills in handling the warning triangle and its correct location behind the vehicle.
(3) The training provided for in paragraph 2 shall be adapted for disabled persons to the possibilities arising from their disability.
(4) Practical training of medical training is focused on
(a) training in the provision of first aid for various injuries and conditions;
(b) bleeding arrest training;
(c) training for the use of individual devices from the first-aid kit,
(d) training and mastering the rescue manoeuvre of the injured person from the vehicle;
(e) training and handling of emergency resuscitation operations.

HLAVA III

TEACHER OF TRAINING AND TRAINING
(Paragraph 23 (3) of the Law)
§ 6
Basic training for teaching and training teachers
(1) Basic training for teachers of teaching and training is focused on:
(a) the methodology for teaching road traffic regulations and road traffic regulations, driving theory and safe driving principles and vehicle control and maintenance; in the case of persons disabled for the instruction of the control and maintenance of a vehicle designed for the disabled,
(b) the methodology for vehicle driving training and practical vehicle maintenance training;
(c) pedagogical training aimed at the main teaching principles and methodological procedures of teaching with the emphasis on maintaining the attention and interest of the listeners, the correct way of expression, the choice of grammatically and stylistically correct terms, terminology, gesturing and proper performance of the teacher;
(d) principles of transport psychology oriented towards the physiological legality of human psyche, personality psychology, interpersonal communication and interpersonal relations in road traffic and adaptation to the current situation in dealing with traffic situations;
(e) the way in which persons with disabilities using vehicles are taught constructively adapted to their disability;
(f) the principles of first aid to the extent set out in Articles 4 (4) and 5 (4).
(2) The curriculum of basic training for teachers of teaching and training is set out in Annex 2.
(3) A driving school operator shall keep records of basic training in accordance with Sections 9 to 11 mutatis mutandis.
§ 7
Teacher examination of teaching and training
(1) The examination of the teacher of teaching and training shall be carried out by the applicant for a professional certificate no later than six months after the date of completion of the basic training. For the test or, where applicable, repeated examination, the applicant for a professional certificate shall be registered by the driver-school operator who carried out the basic training of the applicant at the regional authority responsible for the establishment of the driver-school operator.
(2) The Regional Authority shall immediately inform the applicant in writing of the place, date and time of the examination and, where appropriate, of the re-examination by means of the driver of the professional certificate. The Regional Authority shall include the applicant for the professional certificate for the test and, where appropriate, the re-test so that it starts no later than 30 days after receipt of the application for the test. In order to carry out the examination and, where appropriate, to carry out the re-examination, the Regional Office shall appoint a five-member commission, the chairman of which shall always be the staff of the competent professional department of the Regional Office. The Commission shall always be a representative of the driving school or organisational body of the State which conducted the basic training of the applicant for a professional certificate.
(3) In the examination referred to in paragraph 1, the applicant for a professional certificate shall demonstrate the knowledge and skills of:
(a) regulations on road traffic and medical training;
(b) an interpretation of the road traffic legislation theme;
(c) regulations relating to road traffic and teaching;
(d) the control and maintenance of the vehicle and its teaching;
(e) the theory of driving and driving safely and carrying out their teaching;
(f) practical maintenance of the vehicle and its teaching;
(g) training in the driving of a vehicle;
(h) practical control of a vehicle classified in the category of vehicles of the relevant driving licence.
(4) The knowledge test referred to in paragraph 3 (a) shall be carried out in writing by a test in accordance with the test for the proficiency test for motor vehicles. The examination shall be assessed at the "benefit 'level if the applicant for a professional certificate has reached a full number of points.
(5) The knowledge and skills test referred to in paragraph 3 (b) to (e) shall be carried out orally on the basis of one question from each of these headings and the test referred to in paragraph 3 (f) shall be carried out by verifying the practical knowledge of the vehicle.
(6) The knowledge and skills test referred to in points (g) and (h) of paragraph 3 shall be carried out on practical driving. The vehicle shall be secured at its expense by the applicant for a professional certificate.
(7) The result of each part of the test referred to in paragraph 3 shall be assessed by "benefit 'or" benefit'. If the applicant for a professional certificate has been assessed in a part of the examination by a "non-profit 'grade, he may only repeat that part once. The repeated part of the examination may be carried out not less than five working days, but not more than six months after the date of the part of the examination at which the applicant for a professional certificate has been assessed as not having benefited.
§ 8
Professional certificate
(Paragraph 21 (1) of the Law)
(1) The professional certificate is a four-sided form of 150 x 108 mm.
(2) The technical protection of the professional certificate form consists of a hologram placed on its front page.
(3) Each form of the professional certificate shall bear a registration number. The registration number consists of an alphanumeric code composed of a combination of two letters and six digits. Letters are always placed in the registration number first.
(4) Data are always entered in the professional certificate in black on the computer printer or typewriter. The entry in the box "Other records' may also be made by means of a stamp or by means of a pen in blue or black. The signature of the authorised person issuing the professional certificate shall be made legibly by pen of blue or black.
(5) If the particulars given in the professional certificate are changed or the new particulars are added and the amendment cannot be entered in the box "Other records', the Regional Office shall issue a new professional certificate.
(6) The professional certificate shall be accompanied by a photograph of the holder, which shall be in technical design in accordance with specific legislation. 5)
(7) The model of the professional certificate is set out in Annex 3.

HLAVA IV

EDUCATION AND TRAINING
(Paragraph 27 (5) of the Law)
§ 9
Registration book
(1) The driver-school operator shall keep a register in which he records data on applicants for driving licences admitted to teaching and training.
(2) The register shall contain the date of establishment, the initial and final registration number, the stamp of the driving school and the signature of the representative of the driving school responsible. Individual sheets of the register shall be numbered in ascending order.
(3) The register shall be entered in:
(a) the registration number, name, surname, title, date of birth and address of residence of the applicant for a driving licence;
(b) the type of teaching and training;
(c) the driving licence applied for by the applicant;
(d) the date of commencement of teaching and training;
(e) the date of completion of teaching and training.
(4) A copy of the entry in the register may be made only by crossing out the data and writing down the new entry so that both the original and the new text can be read. Each repair shall be dated and signed by the person who made the repair.
(5) The register is kept at the driving school for five years after the last registration.
§ 10
Class Book
(1) The driving school operator shall keep a class book for each course of teaching and training. The heading of the class book shall include the name of the driving school, the type, scope and date of commencement of teaching and training.
(2) To be entered in the class book
(a) name and surname, possible title of the applicant for a driving licence;
(b) the registration number of the applicant for a driving licence,
(c) a driving licence already owned by the applicant for a driving licence,
(d) teaching and training hours and topics discussed;
(e) participation of the applicant for a driving licence in teaching and training;
(f) the name, surname and, where applicable, title, date of birth and address of the interpreter, if they are involved in teaching because the applicant for a driving licence does not control either the language in which the teaching takes place or at all.
(3) The entries referred to in points (a) to (c) of paragraph 2 shall be made at the start of teaching and training. The entries referred to in paragraph 2 (d) to (f) shall be made on an ongoing basis.
(4) The repair of the entry in the class book may be carried out only by crossing out the data and by writing a new entry so that both the original and the new text can be read. Each repair shall be dated and signed by the person who made the repair.
(5) The class book shall be kept at the driving school for a period of five years after completion of the teaching and training course.
§ 11
Registration of vehicle driving training
(1) For each training vehicle, the driver shall keep a record of the training in the driving of the vehicle in which the training teacher in the driving of the vehicle records the data of the training in the driving of the vehicle.
(2) The register of training in vehicle driving contains the date of establishment, the factory mark and the type of training vehicle, the registration mark of the training vehicle, the stamp of the driving school and the signature of the responsible representative of the driving school. The individual sheets of the register of training in vehicle driving shall be numbered in ascending order.
(3) The register of training in driving shall include:
(a) the name, surname, possible title and registration number of the applicant for a driving licence;
(b) the date of training in driving the vehicle;
(c) the status of the training vehicle's mileage counter before the start of the training in driving and the time at which the training starts in driving for each applicant for a driving licence;
(d) the status of the mileage counter of the training vehicle after completion of the training in driving and the time of completion of the training in driving of each applicant for a driving licence.
(4) The entries referred to in paragraph 3 (a) to (c) shall be made before the start of the training in driving. The entry of the data referred to in paragraph 3 (d) shall be made on the day of the driving training immediately after the training. The correctness of the information entered in the register of training in driving in accordance with paragraph 3 shall be confirmed by the applicant for a driving licence. The signature of the applicant for a driving licence shall be made on the day of the training in driving the vehicle immediately after such training.
(5) The repair of the entries in the register of training in driving may be carried out only by crossing out the data and writing down the new data in such a way that both the original and the new text can be read. Each repair shall be dated and signed by the person who made the repair.
(6) The register of vehicle driving training shall be kept at the driving school for five years after the last registration.
(7) The register of vehicle driving training may also be kept in electronic form. In such a case, the signature of the applicant for a driving licence shall be obtained by means of a signature scanner or a similar device enabling the digital signature to be recorded and including the date of its acquisition shall be entered directly in the electronic register. Paragraph 13 (3) and (5) shall apply mutatis mutandis.
§ 12
The applicant's licence card
(1) The applicant's licence shall include:
(a) the name of the driving school;
