DECLARATION
Ministry of Industry and Trade
of 24 April 2001
on emergency situations in the gas industry
According to Article 98 (7) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws ("Act '), the Ministry of Industry and Trade provides for the implementation of § 73 (8) of the Act:
§ 1
Subject matter
This decree regulates the procedure for preventing, creating and eliminating the consequences of gas emergencies, setting out the scope and manner of limiting gas consumption and the content of emergency plans.
§ 2
Sampling stages, heating curves
(1) Limitation of gas consumption in emergency states or prevention of their generation shall be carried out according to the sampling stages, the heating curves and the emergency sampling stage.
(2) The sampling stages are applied to final customers using gas for technological purposes as follows:
(a) the first stage of take-off which means unabated take-off according to the contractual daily gas take-off;
(b) a second stage of take-off, which shall mean a maximum of half the take-off according to the contractual daily gas take-off, but not more than a reduction to the level of the safety and technological minima;
(c) the third stage of sampling, which means taking at the level of the safety and technological minima.
(3) The heating curves shall be applied to final customers using the heating gas, expressed in terms of gas consumption dependence to daily outdoor air temperature as follows:
(a) the first heating curve which means gas collection according to the contractual daily gas collection;
(b) the second heating curve, which means the amount of the collection against the first heating curve, for the population, for other customers up to 60 thousand m3 / year, for the health sector in full, for the block boiler rooms for flats, schools, etc., for a maximum of 90% and for the others for a maximum of 85%;
(c) the third heating curve, which means gas collection at the level of the safety and technological minima, for the population, for other customers up to 60 thousand m3 / year, for the health sector in full, for block boilers for flats, schools, etc., for a maximum of 80% and for others for a maximum of 70%.
(4) The emergency consumption rate means the interruption of gas supply for all final customers.
§ 3
Security and technological minimum
(1) The safety and technological minimum is set at all final customers with annual gas consumption above 60,000 m3 on the basis of an inventory of individual appliances prepared by these final customers, without production requirements with an immediate restriction of consumption to the safety and technological minimum, i.e. a zero or minimum value to ensure the safety of the sampling equipment and operators. In the case of a sampling device where the sampling cannot be stopped immediately or reduced to a minimum of safety and technology, the time shift in hours shall be determined as the time necessary to stop or reduce the sampling.
(2) For technological sampling, the safety and technological minimum shall be determined as daily consumption in m3 or as a percentage of the average day of sampling; for heating, the percentage of sampling against the first heating curve is determined.
(3) The inventory of gas appliances and the safety and technological minimum are established on forms the model of which appears in Annexes 1 and 2.
(4) For final customers, who in particular ensure the production of daily consumption food for the population, the processing of perishable foods, animal production operations with the risk of mortality, the necessary needs of health facilities, waterworks, sewage treatment plants and sanitation facilities, the safety and technological minimum is up to 95% of the contracted daily gas consumption.
§ 4
Preventing an emergency
(1) Preventing an emergency is a gas state where an emergency has not yet occurred but can be expected to occur.
(2) In order to prevent an emergency situation, the agreed daily gas supply may be limited to all final customers with a gas extraction of more than 60,000 m3 / year.
(3) Restrictions on gas consumption will take place
(a) the declaration of a second stage of consumption for final customers using gas for technological purposes;
(b) the announcement of the second heating curve for final customers using gas for heating.
§ 5
Emergency
(1) When a state of emergency is declared, the supply of gas to final customers may be limited to the level of the safety and technological minima or the interruption of the supply of gas.
(2) If the safety and technological minima of supply is not ensured by the safe supply of gas to the population, an emergency stage shall be declared to allow the gas supply to be interrupted for all final customers.
§ 6
Demonstration of sampling stages, heating curves and emergency sampling steps
(1) The national announcement of the sampling stages, the heating curves and the emergency sampling stage by the transmission system operator shall be carried out by means of the Czech Radio in regular daily sessions or other mass media, as appropriate.
(2) The announcement of the sampling stages, heating curves and emergency sampling stages for a part of the territory of the State of the distribution system operators shall take place through the Czech Radio and, where appropriate, other mass media.
(3) The announcement of the emergency demand stage is also reported by distribution system operators to municipalities, regions and authorities of the Czech Police Department mentioned in the emergency plan.
§ 7
Emergency plan
The emergency plan shall include:
(a) description and principles of handling emergency situations;
(b) the composition of emergency commissions, the way in which the commissions are convened;
(c) emergency and operational action to prevent and address emergencies;
(d) data on the connection of final customers, including gas distribution documentation, indicating gas closures and control stations;
(e) the merger plan and the reporting obligations of the natural gas operator.
§ 8
Repeal
Decree No 197 / 1995 Coll., on emergency situations in the gas industry and the control of the gas system is hereby repealed.
§ 9
Efficacy
This decree shall take effect on the day of its publication.
