adjusting the details of the procedure for assessing archival documents as cultural monuments and the way in which to ensure increased protection of archive documents as cultural monuments and national cultural monuments
The Ministry of Interior of the Slovak Socialist Republic provides in agreement with the Ministry of Culture of the Slovak Socialist Republic pursuant to § 33 paragraph 1 (b) and § 2 of the Slovak National Council Act No. 149 / 1975 Coll., on archiving (hereinafter referred to as "the Act"):
PROCEDURE FOR ASSESSMENT OF ARCHIVE DOCUMENTS AS CULTURAL MEMORIES
Assessment aspects
(1) When assessing whether an archive document (hereinafter referred to as the document) is a cultural monument under the law, account shall be taken in particular of the content value of the document, its form, the importance of its originator, the time and place of its origin, the importance of the document for general, national or regional history, its importance for the history of science, technology, economy and culture, its uniqueness and originality, or other important characteristics for which it is of particular importance for the culture of society (§ 3 (1) and (2) of the Act).
(2) Individual documents, their files (archive funds, archive collections) or their complete parts may be cultural monuments, although some documents in these files are not cultural monuments themselves.
Submission of proposals
(1) Proposals for assessing whether the document is a cultural monument (hereinafter referred to as "the proposals") are submitted to the Ministry of the Interior of the Slovak Socialist Republic (hereinafter referred to as "the Ministry of Interior") by archives in which such documents are kept (Section 3 (3) of the Act), unless otherwise specified.
(2) Business archives established in organisations governed by national committees (§ 25 (2) of the Act) operating in the territory of the Slovak Socialist Republic of Bratislava and in the territory of Košic, submit proposals through the archives of these cities. Other company archives and state district archives submit proposals through the relevant national regional archive.
(3) Proposals concerning documents stored in archives referred to in Sections 27 and 28 of the Act shall be made by the competent authorities or organisations in a manner agreed with the Ministry of Interior.
(1) Proposals concerning documents which are not stored in archives are submitted to the Ministry of the Interior by the State Regional Archives in whose territorial district the document is located and the Archive of the Slovak Socialist Republic of Bratislava.
(2) Proposals for documents deposited in the organisations and facilities of the Ministry of Culture of the Slovak Socialist Republic (1) (hereinafter referred to as "Ministry of Culture") shall be submitted by the archives referred to in paragraph 1 with the expert opinion of these organisations and establishments.
Procedure for proposals
(1) The Ministry of the Interior or the State Archives (Section 3 (3) of the Act) will seek the opinion of scientific institutions in more complex cases before deciding on the proposal; If documents are stored in the organizations and facilities of the Ministry of Culture, the Ministry shall always seek the opinion of the Ministry.
(2) The Ministry of the Interior or the national archives responsible for the document shall inform as soon as possible the archive in which the document is kept, the archive through which the proposal has been submitted and, if the document is not stored in the archive, the person entitled to dispose of the document.
REDUCED PROTECTION OF DOCUMENTS AS CULTURAL MEMORIES AND AS NATIONAL CULTURAL MEMORIES
Reproduction
(1) In order to ensure the physical form of documents which are cultural monuments or have been declared national cultural monuments, the archives in which these documents are kept will be used for reproduction of those documents.
(2) The archives shall produce reproduction of documents immediately after the decision that the document is a cultural monument or after the document has been declared a national cultural monument; If a document declared as a national cultural monument is issued, it shall, in accordance with the instructions of the Ministry of the Interior, make special reproduction for documentary purposes.
Protection of documents as cultural monuments
Storage
(1) Documents which are cultural monuments (hereinafter referred to as "documents - cultural monuments") are left in the files of the documents in which they are part.
(2) The fact that documents which are stored in archives or in the organisations and facilities of the Ministry of Culture are cultural monuments is marked significantly on protective packaging; The premises where such documents are located shall also be marked. These premises shall be effectively secured against unauthorised access.
(3) A special plan for the preservation of cultural monuments is being maintained.
(4) The physical condition of documents - cultural monuments is checked within the time limits and in a manner specified by the Ministry of Interior; reports of the outcome of the inspection shall be submitted immediately after the completion of the inspection to the Ministry of the Interior in the same way as proposals for assessing whether documents are cultural monuments (Sections 2 and 3).
(5) Weaknesses found in the physical state of the documents - cultural monuments are immediately removed and damaged documents are preferably restored and preserved.
(6) The method of increased protection of the document - a cultural monument which is not in socialist social ownership and which is not stored in the archive or, where appropriate, in the organisation or equipment of the Ministry of Culture, will recommend to its owner the archive in which the document is recorded (Section 9 (2) of the Act) within the limits of the previous paragraphs and taking into account the conditions of the individual case.
Use
(1) Documents - cultural monuments are submitted for inspection only in reproduction. The originals of such documents may be submitted for study only with the agreement of the Director of the Archive (Head of Organisation). Consent may be given if the nature of the teaching task so requires.
(2) Originals of documents - cultural monuments can be sent to another archive only exceptionally and with particular caution.
(3) Documents - cultural monuments can be used in the territory of the Czechoslovak Socialist Republic for purposes other than consultation and study (e.g. for exhibition, etc.) only after prior discussion with the Ministry of Interior.
Registration
(1) Documents - cultural monuments are kept in a special register of the archives in which they are stored; if stored in the organisations or establishments of the Ministry of Culture, they shall be kept in a separate register of such organisations and establishments. Special records of documents - cultural monuments not stored in archives are kept by the archives designated by the Ministry of the Interior or by the Ministry of the Interior itself. Special records of all documents - cultural monuments are part of the central records of documents maintained by the Ministry of the Interior.
(2) The special registration of documents - cultural monuments consists of identifying the characteristics characterising their value as cultural monuments both in the record sheet and in the special records which are stored separately.
Protection of documents declared as national cultural monuments
Storage
(1) Documents declared national cultural monuments are kept in a particularly secure place; If they are part of a file and it is not possible to secure the whole file in this way, they should be removed from the file. Paragraph 6 (2), (3) and (6) shall apply mutatis mutandis.
(2) Documents declared as national cultural monuments may only be taken care of by staff designated by the director of the archive (head of organisation or establishment) in which the documents are kept.
(3) Conservatory and restaurant interventions on documents declared as national cultural monuments may be carried out only with the consent of the Ministry of the Interior and in a manner which this Ministry will also determine. Where such documents are held in the organisations and facilities of the Ministry of Culture, conservation and restaurant interventions shall be carried out in agreement with the Ministry, while at the same time determining the manner of such interventions.
(4) Reports on the physical state of the documents declared as national cultural monuments shall be submitted to the Ministry of the Interior regularly every year. if these documents are compromised, the report shall be submitted immediately. The deficiencies identified shall be corrected without delay.
Use
(1) Documents declared national cultural monuments shall be submitted for inspection only in reproduction. The originals of such documents may be submitted for study only in the rooms where they are stored and only with the permission of the Ministry of Interior. Consent may only be given in specific cases.
(2) Documents declared as national cultural monuments can only be exhibited in the territory of the Czechoslovak Socialist Republic if they are properly secured and only with the consent of the Ministry of Interior and according to the conditions specified by it.
(3) The Ministry of the Interior, in cooperation with the participating authorities and organisations, ensures the promotion and popularisation of documents declared national cultural monuments and the publication of the results of their scientific or other evaluation.
Registration
(1) The documents declared national cultural monuments are entered in a special list maintained by the Ministry of the Interior in order to protect them.
(2) The special list of documents declared as national cultural monuments contains the essential characteristics of these documents and details of when the Slovak Socialist Government declared them a national cultural monument and where they are stored.
(3) The Ministry of the Interior shall, in addition to a separate list, keep appropriate documentation of documents declared as national cultural monuments.
Efficacy
This Decree shall take effect on 1 January 1976.
