amending Decree No 349 / 2015 Coll., on Gas Market Rules, as amended
Pursuant to Section 98a (2) (i) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 90 / 2014 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll., Act No. 176 / 2022 Coll. and Act No. 469 / 2023 Coll.:

Decree No. 349 / 2015 Coll., on Gas Market Rules, as amended by Decree No. 416 / 2016 Coll., Decree No. 326 / 2018 Coll., Decree No. 277 / 2021 Coll., Decree No. 223 / 2022 Coll., Decree No. 405 / 2022 Coll. and Decree No. 5 / 2024 Coll., are amended as follows:
1. in Article 1 (1) (f):
"(f) the procedure of the gas storage tank operator for the sale of illegally stored gas;"
2. In Article 1, the dot is replaced by a comma at the end of paragraph 1 and the following point (s) is added:
"(s) the extent to which information is provided on the way in which the gas price is determined dynamically or otherwise depending on changes in the gas price in organised gas markets and the advantages and risks associated with the conclusion of a contract with such price determination.";
3. Paragraph 27, including the title and footnote 21, reads as follows:
„§ 27
In-service gas transport service for technology verification
(1) The transmission system operator provides a service of in-service gas transport to verify the technical parameters, operational values and demonstration of the operability of the newly installed or reconstructed equipment (21) connected to the transmission system. For the purposes of the in-service gas transport service for the verification of the technology, the customer's equipment connected to the transmission system shall be considered to be the reconstructed equipment according to the first sentence after making adjustments which result in a change in its purpose or technical parameters which will lead to a change in the maximum daily gas consumption of at least 20% from the actual maximum daily consumption in the last calendar year or which will result in a change in the hourly or daily value of the gas transmitted by the transmission system operator through the transfer point.
(2) The request to provide in-service gas transport service for the verification of technology shall be made by the customer, the gas supplier, the gas manufacturer, the gas storage tank operator or the distribution system operator no later than the fifth working day by 10: 00: 00 hours before the start of the gas transport service for the verification of technology.
(3) A request for the provision of a gas transport service for the verification of the technology shall be made by the customer or supplier by analogy, in accordance with the procedure and at the dates set out in Sections 21 (1), 22 (1), 23 (1), 24 (1) and 25 (1), by analogy, or by the gas manufacturer in accordance with the procedure and dates set out in Sections 10 to 13.
(4) The transmission system operator shall initiate the provision of a in-service gas transport service for the verification of technology at the request of the applicant, which shall include at least the date of commencement and termination of the in-service gas transport service for the verification of the technology and the grounds for initiating it.
(5) The in-service gas service for the verification of technology lasts a maximum of 12 months. The applicant shall be entitled to request the transmission system operator to terminate the in-service gas service for the verification of technology. The transmission system operator shall terminate the service by the end of the gas day for which the applicant has requested its termination.
(6) The maximum daily gas consumption at the sampling point or the maximum hourly or daily value of the quantity of gas transmitted through the transfer point shall not exceed twenty-four times the hourly capacity for the relevant sampling point or the point agreed in the connection contract when using the in-service gas transport service for the verification of technology.
(7) In the event that the customer or gas supplier has booked an indefinite transmission capacity during the service of the in-service gas transport service for the verification of the technology and has not, at the same time, made an indefinite request prior to the termination of the service of the in-service gas transport service for the verification of the technology, to reduce or increase the reservation of transmission capacity for the demand point for an indefinite period of time, the transmission system operator shall, after the termination of the gas transport service for the verification of the technology, reserve an indefinite capacity for the duration of the provision of the gas transport service for the verification of the technology.
21) § 2 (c) of Decree No. 488 / 2021 Coll., on the terms and conditions of connection to the gas system. '
4. in § 37 (1) (a) and (b), "§ 38 to 43" is replaced by "§ 44 and 45."
5. In Paragraph 50 (4), the last sentence is deleted.
6. In Paragraph 50, the following paragraphs 5 to 7 are inserted after paragraph 4:
"(5) The gas storage tank operator shall reserve storage capacity rounded to the nearest m3, kWh, kWh / day, MWh or MWh / day on the basis of:
(a) electronic auctions pursuant to Sections 51 to 54;
(b) the bidding prices of the gas container operator in accordance with Article 55; or
(c) the bidding price of the gas market participant pursuant to Article 56.
(6) The gas storage tank operator shall offer storage capacity in such a way that the storage capacity reserved in accordance with the procedure referred to in paragraph 5 (b) and (c) at no time in total exceeds 25% of the operational volume of the virtual gas storage tank. This does not apply to daily storage reservations.
(7) The gas storage tank operator may offer storage capacity, including stored gas, for gas storage purposes, in a quantity corresponding to a maximum of that capacity. The size of the reserved storage capacity according to the first sentence shall at no time exceed 15% of the operational volume of the virtual gas storage tank. ';
Paragraphs 5 to 10 shall be renumbered paragraphs 8 to 13.
7. In Paragraph 50 (13), "9 'is replaced by" 12'.
8. The heading above the designation § 51 is deleted.

„§ 51
Procedure for reservation of storage capacity based on electronic auction
(1) The gas storage tank operator shall publish in a way that allows remote access
(a) no later than 48 hours before the start of the electronic auction, the auction conditions for the annual, monthly and unused storage capacity referred to in Annex 3 thereto; or
(b) not later than 6 hours before the auction starts, the auction conditions referred to in point 6 of Annex 3 to this decree, provided that at least 14 days have elapsed since the publication of the other auction conditions set out in Annex 3 to this decree by the gas storage provider.
(2) The gas storage tank operator shall publish the terms of the auction referred to in paragraph 1 in such a way that the date of publication of the terms does not fall on Saturday, Sunday or public holiday and the time range from 18.00: 00 on the working day until 6.00: 00 on the following working day. The gas storage tank operator shall determine the date of the start of the auction so that it does not fall on Saturday, Sunday or holiday and the time range from 18: 00 on the working day until 10: 00 on the following working day.
(3) The gas storage tank operator which publishes the full auction conditions referred to in paragraph 1 (a) before 72 hours before the start of the auction may adjust the initial price or method of determining the initial price per storage capacity unit at the latest 20 hours before the start of the auction. The adjustment of the initial price or the method of determining the initial price per unit of storage capacity shall not affect the level of financial collateral.
(4) The gas storage unit operator shall inform the market operator without delay electronically in the format specified by the market operator of the publication of the auction, indicating at least the date of the auction, the type of storage capacity referred to in § 50 (4) and (8) or the name of the storage product, the total size of the storage capacity offered and the maximum duration of the reservation of storage capacity, if included in the auction conditions. The market operator shall make this information publicly available without delay in a way that allows remote access. When adjusting the terms of the auction referred to in paragraph 3, the gas storage tank operator and the market operator shall proceed mutatis mutandis with the fact that the price change information referred to in the first sentence is included.
(5) Where the gas storage tank operator offers additional storage capacity at auction, its size shall not exceed three times the storage capacity offered at auction.
(6) In the case of an auction for daily storage capacity, neither the time limit nor the procedure referred to in paragraphs 1 to 4 shall apply and the gas storage tank operator shall publish the terms of the auction in accordance with point 4 of Annex 3 to this Regulation in a manner which allows remote access within a reasonable time before the auction begins. Furthermore, for the purpose of financial collateral at auction, Sections 52 (1) and 53 (4) shall not apply; the gas storage tank operator shall determine the terms and conditions for the composition, method and date of return of the financial collateral in a transparent and non-discriminatory manner.
(7) In the case of an auction for the reservation of unused storage capacity, Sections 52 (1) and 53 (4) shall not apply and the gas container operator shall not require financial collateral to participate in the auction. ';
10.Paragraph 52 (3) reads as follows:
"(3) In the case of an auction where, in the first auction round, the sum of the requirements for the reservation of storage capacity of all active applicants is lower than the size in the auction of the storage capacity offered, the gas storage tank operator may decide, within 24 hours of the end or cancellation of the auction, to repeat the auction by publishing the terms of the auction in a manner that allows remote access. The auction will start within 24 hours of the publication of the terms of the repeated auction. The gas storage tank operator shall inform the market operator of the publication of the auction conditions without delay electronically in the format specified by the market operator. The market operator shall publish this information without delay upon receipt in a way that allows remote access. If the end of the repeated auction is to occur after the publication of the terms of the repeated auction according to the first sentence on Saturday, Sunday or public holiday, the time limit for repeating the auction shall be extended so that the last 10 hours before the auction does not fall on Saturday, Sunday or holiday. ';
11. in Paragraph 52, the following paragraph 4 is added:
"(4) When repeating the auction, the gas storage device operator shall use the auction conditions followed by the repeated auction, except for the size of the storage capacity offered and the initial price and financial collateral not required by the gas storage tank operator. ';
12. Paragraph 53 (6) reads as follows:
"(6) An active applicant who has not concluded a gas storage contract within the time limit referred to in paragraph 3 shall provide financial compensation to the gas storage tank operator for cancelling the reservation of storage capacity at the level specified in the terms of the auction. The gas storage tank operator may include financial compensation for cancelling the reservation against the financial collateral lodged by the active applicant. ';

„§ 54
(1) After the end of the auction for a storage capacity other than daily storage capacity, the gas storage tank operator shall immediately publish the storage capacity reservation confirmation referred to in Article 53 (1) in a way that allows remote access in terms of the size of the storage capacity reserved, the resulting price per storage capacity unit and the duration of the storage capacity reservation, broken down by the length of the reservation.
(2) Information on the reserved storage capacity for each auction referred to in paragraph 1 must be published for at least 5 years.
(3) The gas storage unit operator shall, upon request, provide the active applicant with the bidding and demand curves of the gas storage service in each auction round upon completion of the auction. ';
14. Sections 55 and 56, including the headings, read:
„§ 55
Procedure for booking storage capacity outside the auction bid price of the gas storage tank operator
(1) The gas storage tank operator shall publish in a way that allows remote access
(a) no later than 48 hours before the start of the time limit for the request for a reservation of storage capacity, a tender for the reservation of a fixed-price storage capacity (hereinafter referred to as "fixed-price offer"), with the requirements set out in point 1 of Annex 22 thereto; or
(b) no later than 6 hours before the start of the time limit for the request for a reservation of storage capacity, a fixed-price offer covering the scope referred to in point 3 of Annex No 22 to this Order, provided that at least 14 days have elapsed since the publication of the other elements of the fixed-price offer referred to in point 1 of Annex No 22 to this Order.
(2) The gas storage tank operator shall inform the market operator without delay, electronically in the format specified by the market operator, of the publication of the fixed price offer, which shall publish this information without delay, mutatis mutandis, in accordance with Article 51 (4).
(3) The gas storage tank operator shall publish the tender at a fixed price so that the date of publication does not fall on Saturday, Sunday or public holiday and the time range from 18: 00: 00 on the working day until 06: 00 on the following working day. The gas storage tank operator shall determine the date of the start of the time limit for the request for reservation of storage capacity so that it does not fall on Saturday, Sunday or public holiday and the time range from 18: 00 on the working day until 10: 00 on the following working day. The gas storage tank operator shall be entitled to cancel the fixed-price bid at any time before the start of the time limit for the request for reservation of storage capacity.
(4) A gas market participant shall submit an application for a reservation of storage capacity in accordance with the terms of the fixed-price offer and the requirements for the deadline, content, form or manner of the request for a reservation of storage capacity.
(5) The gas storage tank operator shall evaluate the accepted requests for reservation of storage capacity on the basis of the order of the time mark of receipt of the request for reservation of storage capacity, in the order of first accepted after no later than accepted or proportionate. If the gas storage tank operator evaluates the applications received only on the basis of the order of the time mark of receipt of the application in the order from the earliest received to the latest received, the period of booking of storage capacity shall not exceed 3 years.
(6) The storage capacity of the gas market participant is reserved by electronic confirmation by the gas storage operator. Where all the storage capacity offered has been reserved, the gas storage tank operator shall immediately publish information on the termination of the fixed-price offer in a way that allows remote access. Otherwise, the fixed-price offer shall expire on the expiry of the period specified therein.
(7) The gas storage unit operator shall send a draft gas storage contract to the gas market participant within 10 working days of the receipt of the application referred to in paragraph 6. The storage contract shall be concluded no later than 20 working days after the date of service of the application. If the market participant does not conclude a gas storage contract within the time limit specified in the previous sentence, the storage capacity confirmed to it in accordance with paragraph 6 shall be considered as free storage capacity. This does not apply in the case of the reservation of daily storage capacity where the contract is deemed to have been concluded by electronic confirmation of the gas market participant's request by the gas storage operator.
(8) The gas storage tank operator shall publish, within 24 hours of the expiry of the fixed-price offer, in a way that allows remote access, the size of the stored storage capacity, the price per unit of storage capacity and the duration of the reservation of storage capacity broken down by length of the reservation. This does not apply in case of daily storage capacity booking. Information on the reserved storage capacity for individual fixed-price tenders shall be published by the gas storage unit operator for at least 5 years.
(9) In the case of a fixed price offer for the reservation of daily storage capacity, the period and procedure referred to in paragraphs 1 to 3 shall not apply and the gas storage tank operator shall publish the fixed price offer referred to in point 5 of Annex 22 to this Regulation within a reasonable period of time.
§ 56
Reservation of storage capacity outside the auction bid price of a gas market participant
(1) The gas storage tank operator shall publish in a way that allows remote access
(a) no later than 48 hours before the beginning of the time limit for the submission of tenders, an invitation to tender for the reservation of storage capacity, with the requirements set out in point 2 of Annex No 22 thereto; or
(b) no later than 6 hours before the start of the time limit for the submission of tenders, an invitation to tender for the reservation of storage capacity, with the formalities laid down in point 4 of Annex No 22 to this Order, provided that at least 14 days have elapsed since the publication of the other particulars of the invitation to tender referred to in point 2 of Annex No 22 to this Decree by the gas storage operator.
(2) The gas storage tank operator shall inform the market operator without delay electronically in the format specified by the market operator of the publication of the call for tenders. The market operator shall publish this information without delay, to the extent appropriate, in accordance with Paragraph 51 (4).
(3) The gas storage tank operator shall publish the invitation to tender referred to in paragraph 2 in such a way that the date of publication does not fall on Saturday, Sunday or public holiday and the time range from 18: 00: 00 on the working day until 06: 00: 00 on the following working day. The gas storage tank operator shall determine the date of the start of the bidding period for the market participant so that it does not fall on Saturday, Sunday or public holiday and the time range from 18: 00: 00 on the working day until 10: 00: 00 on the following working day. The gas storage tank operator may cancel the call at any time before the start of the time limit for the submission of tenders for the reservation of storage capacity.
(4) Furthermore, the gas storage tank operator shall set out in the call a transparent and non-discriminatory method, procedure and deadline for evaluating the tenders received on the basis of technical and economic parameters of storage capacity. Where the gas storage tank operator determines in the terms of the call for evaluation of the tenders received, other than the technical and economic parameters of the storage capacity, only on the basis of the order according to the time mark of receipt of the offer in order from the earliest received after the latest received, the time of booking of storage capacity shall not exceed 3 years. The gas storage tank operator may specify in the invitation the minimum price or the method of fixing the minimum price or the content, form or method of submitting the tender.
(5) A gas market participant makes an offer to the gas storage capacity reservation operator in accordance with the terms of the call. The tender of a market participant shall always contain a fixed bid price or the method for determining such a bid price.
(6) Where the gas storage unit operator requires financial collateral, Sections 52 (1) and 53 (2) and (4) shall apply mutatis mutandis. Paragraph 53 (6) shall apply mutatis mutandis in order to determine, grant and set off the financial compensation for the non-conclusion of a gas storage contract within the period referred to in Article 53 (3).
(7) Paragraph 53 (1) shall apply mutatis mutandis for the sending of a certificate of reservation of storage capacity to a gas market participant whose supply meets the conditions of the call and has been selected in accordance with the procedure referred to in paragraph 4. By analogy, the gas storage tank operator shall send a draft gas storage contract to the gas market participant in accordance with the procedure laid down in Article 53 (3). If a market participant does not conclude a gas storage contract within the time limit specified in the previous sentence, the storage capacity confirmed to it by the first sentence shall be considered as free storage capacity. This does not apply in the case of the reservation of daily storage capacity where the contract is considered to be concluded by electronic confirmation of the acceptance by the gas storage operator of the supply of the gas market participant.
(8) Immediately following the conclusion of the gas storage contract, the gas storage tank operator shall publish for at least 5 years information on the size of the storage capacity reserved, the price per unit of storage capacity and the duration of the reservation of storage capacity broken down by length of the reservation. This does not apply to daily storage reservations.
(9) In the case of a call for tenders for the reservation of daily storage capacity, the period and procedure referred to in paragraphs 1 to 3 shall not apply and the gas storage tank operator shall publish the invitation to tender referred to in point 6 of Annex 22 to this Regulation within a reasonable period of time. ';
15. In the heading of Section 59, the word "unharvested 'is replaced by" illegally stored'.
16. in Article 59 (1), the words "Where no gas extraction has taken place under a gas storage contract after the termination of the reservation of storage capacity by a gas storage participant," shall be replaced by the words "In cases under Paragraph 74 (5) of the Energy Act where it is not possible to store gas illegally."
17. in Article 59 (1), the words "illegally stored" shall be inserted after the words "disposed of" and the words "gas not recovered" shall be deleted;
18. In Article 59 (2), the words "unduly stored 'are inserted after the word" disposal' and the words "illegally stored 'are inserted after the word" disposal'.
19. In Article 59 (3), the words "unlawfully stored 'shall be inserted after the words" sale'.
20. In Article 59 (3) to (5), the word "unexploited 'is replaced by" illegally stored'.
21. in Paragraph 61, paragraphs 4 and 5 are deleted;
22. in Article 61a (2), the word "applicant" is replaced by the word "depositors" and the word "account" is replaced by "sub-account."
23. in Article 63 (4), "reserved" is replaced by "technical."
24. in Paragraph 63 (4), "5,000" is replaced by "2,500."
25. In Paragraph 66, the sentence "If the market operator does not send the nomination in accordance with the first sentence, the relevant operators shall proceed as if the nominations were confirmed in full by the market operator. '
26. In Paragraph 69, the sentence "If the market operator does not send the renomination in accordance with the first sentence, the relevant operators shall proceed as if the renomination by the market operator had been confirmed in full 'is added at the end of paragraph 3.
27. in § 80 (6), the text "§ 96 (6)" is replaced by "§ 96 (5)";
28. in Paragraph 95 (1), point (h) is deleted;
Points (i) and (j) shall be renumbered as points (h) and (i).
29. in Paragraph 95 (2), point (h) is deleted;
Points (i) to (k) shall be renumbered as points (h) to (j).
30. In Paragraph 95, the following paragraph 7 is added:
"(7) The distribution system operator shall send to the market operator:
(a) the daily value of the accumulation change by 10: 00 at the latest on the preceding gas day;
(b) the monthly value of the change in accumulation by 12: 00 at the latest on the fifth working day of the gas month, broken down by gas days preceding the gas month. ';
31. in Paragraph 96, paragraph 5 is deleted;
Paragraphs 6 to 8 shall become paragraphs 5 to 7.
32. in Paragraph 97 (3):
"(3) The distribution system operator shall forward to the market operator by 12: 00: 00 on the ninth calendar, but not later than 12: 00 on the sixth working day of the gas month, all the information referred to in Annex 11 to this Regulation for the previous gas month for the sampling points registered in the market operator's information system and which have not ceased to provide the distribution system, except for sampling points with type C measurements which have not been deducted during the previous month. ';
33. In Paragraph 102, paragraph 8 is added:
"(8) The market operator shall make the values referred to in Paragraph 95 (7) available to the transmission system operator without delay upon receipt in the market operator information system. ';
34. The following Section 109a is inserted after Section 109:
„§ 109a
Scope of the information provided on the way in which the gas price is determined dynamically or otherwise depending on changes in gas prices in organised gas markets
The information provided by the supplier to the consumer under Paragraph 11ca (1) of the Energy Act contains in particular:
(a) a clear identification of the organised gas market on which transactions are settled, on the basis of which, depending on the changes in gas prices on that market, the price per gas supply is determined, including the reference to the website where price changes are available on that market;
(b) the time interval in the organised gas market from which the price per gas supply is determined;
(c) the minimum or maximum price for the supply of gas, if agreed;
(d) a precise description of the method of calculating the price for the supply of gas, including the degree or form of dependence on the organised gas market, and the definition of the amount or method of determining each component of the price for the supply of gas which is not dependent on changes in gas prices in the organised gas market; if the organised gas market or individual component of the price for the supply of gas is determined in a currency other than Czech crowns, the rate used for conversion into Czech crowns to determine the price for the supply of gas,
(e) an explanation of the risk of extreme fluctuations in gas supply prices, depending on the price fluctuations in the organised gas market, over the period of calendar day, month and year, including a lesson on the limited predictability of these risks and a warning that the price trend does not predict future prices;
(f) a lesson on the risk of a very high price for gas supply in the event of exceptional price fluctuations in the organised gas market in relation to the agreed length of the settlement period and the agreed duration of the contractual relationship; and
(g) information on the risk of setting a very high advance payment or a very high underpayment in the settlement of accepted advance payments and the total amount of the price for the supply of gas in the event of exceptional price fluctuations in the organised gas market, in relation to the agreed fixing of advance payments and the agreed length of the settlement period. ';
35. In Article 113 (5), the words "where the gas supplier is not a gas trader who is the supplier of the last instance in the relevant domestic zone 'and the words" a new gas supplier who is not the supplier of the last instance in the relevant domestic zone' shall be deleted for the purpose of initiating the supply to a demand point registered in the market operator's information system after the unauthorised collection or distribution by the new gas supplier.
36. in Paragraph 118 (5):
"(5) A gas supplier who has lost the power or the ability to supply gas, the market operator shall suspend the possibility of nominating, transferring and assuming responsibility for the derogation and participating in the gas intraday market, publish this information in a way that allows remote access and shall provide without delay to all registered gas market participants in the market operator's information system a list of the EIC of the customer demand points codes of that supplier. The EIC list of the demand points codes shall be provided without delay by the market operator even in the case of customer demand points for which the gas supplier does not have a transmission or distribution system service provided in the case of gas supply under the associated gas supply service contract. For customer demand points whose gas supplier has lost the power or the ability to supply gas or for which the transmission or distribution system service is not provided for in the case of gas supply under a contract for combined gas supply services, the procedure and deadlines provided for in paragraphs 5, 117 and this paragraph shall apply mutatis mutandis. ';
37. in Article 123 (1), the text "(h)" is replaced by the text "Article 95 (7) (a)."
38. In Annex 1, point 5, the words "or in m3 / day 'are deleted.
39. Annex 3, including the title, reads:

"Annex No 3
Conditions of auction for storage capacity
1. The terms of the auction shall be proportionate, non-discriminatory and transparent.
2. The auction conditions for annual, monthly and unused storage capacity shall include at least:
(a) the initial price or the method of determining the initial price; in the case of an auction for monthly storage capacity, the initial price or the method of determining the initial price for each calendar month;
(b) start of the auction;
(c) the required means of secure electronic communication, including alternative means of communication in case of failure of electronic communication on the part of the applicant;
(d) the method of determining the size of the financial collateral and the process and date of composition of the financial collateral for active participation in the auction;
(e) the production and incorporation curves;
(f) the size of the storage capacity offered or the method of determining the size of the storage capacity offered;
(g) the model of the gas storage contract;
(h) the algorithm of the auction type used, the method of determining the price change during the auction, the method of allocating storage capacity and the method of determining the resulting price per storage capacity unit;
(i) the minimum and maximum duration of the reservation of storage capacity;
(j) the duration of the auction, the auction round or the method of determining the duration of the auction and the auction round;
(k) the method of determining the financial compensation for the cancellation of the reservation of storage capacity to an active applicant for whom the reservation of storage capacity has been confirmed, but no storage contract has been concluded, including the date and manner for its settlement;
(l) the size of the additional storage capacity that may be activated and the conditions under which additional storage capacity may be activated if additional storage capacity is offered;
(m) the conditions under which the gas storage tank operator terminates or cancels the auction for storage capacity.
3. The terms of the auction for monthly storage capacity shall include an expression of the minimum and maximum duration of the reservation of storage capacity by the number of calendar months for the use of storage capacity, indicated as an integer indicating the number of months of the commitment to the gas storage contract.
4. The auction conditions for daily storage capacity shall include at least:
(a) the minimum and maximum duration of the reservation of storage capacity, expressed in calendar days for the use of storage capacity, indicated as an integer indicating the number of days of the obligation under the gas storage contract;
(b) the initial price or the method of determining the initial price for each calendar day;
(c) start of the auction;
(d) the size of the storage capacity offered or the method of determining the size of the storage capacity offered;
(e) the algorithm of the auction type used, the method of determining the price change during the auction, the method of allocating storage capacity and the method of determining the resulting price per storage capacity unit;
(f) the duration of the auction, the auction round or the method for determining the duration of the auction and the auction round;
(g) the conditions under which the gas storage tank operator terminates or cancels the storage capacity auction;
(h) the required means of secure electronic communication, including alternative means of communication in case of failure of electronic communication on the part of the applicant;
(i) the contractual terms.
5. The auction conditions for unused storage capacity also include:
(a) the date of effectiveness from which the storage capacity is reserved;
(b) the amount of the initial negative price in the case of an auction at a negative price for gas storage as determined by the Ministry of Industry and Trade decision;
(c) a maximum filling time of 90% of the newly booked unused storage capacity under the Gas Emergency Regulation and the way in which the gas supply safety standard is ensured.
6. If the gas storage tank operator moves pursuant to § 51 (1) (b), the terms of the auction published no later than 6 hours before the auction starts
(a) the annual storage capacity is the conditions referred to in points 2 (a), (b), (f), (i) and (l);
(b) the monthly storage capacity is the conditions referred to in points 2 (a), 2 (b), (f), (i), (l) and 3;
(c) unused storage capacity shall be the conditions laid down in points 2 (b), (f) and 5. ';
40. In Annex 5, point 4 (c), the text "Paragraph 95 (1) (i) 'is replaced by" Paragraph 95 (1) (h)'.

(a) the start and end of the time limit for requesting a reservation of storage capacity;
